Ray McBerry's Legislative Plan to Enforce State Sovereignty
Ray McBerry is a candidate for governor of Georgia in 2010. The more I hear from him, the more I see the likeness of Thomas Jefferson, James Madison, etc. After seeing the launch of his new legislative plan to restore state sovereignty, I know that he is exactly the type of candidate he appears to be: a man who is willing to actually fight Washington D.C. head-on. And by 'fight,' I don't mean writing some angry letters to the president or sending out some press releases; I mean that he will actively resist and undermine unconstitutional federal laws and policies.

The State Authority and Federal Tax Fund Act will require that all federal tax collection on the people be first filtered thru the state government, which will check the tax for constitutionality and block the collection of any that fail the constitutional test.

Even more amazing, the State Authority and Anti-Racketeering Act --- which reads like it is based on Jefferson's Kentucky Resolutions of 1798; see http://www.princeton.edu/~tjpapers/kyres/kyadopted.html --- provides for felony racketeering penalties against any federal official (presumably even federal judges, because the bill specifically refers to "judicial officer[s]") who tries to enforce any federal law in state territory other than for those select few crimes and powers explicitly enumerated in the Constitution.
And there's 6 more pieces of legislation set to be released on top of these! And according to the first link, these bills already have sponsors in the Georgia legislature. McBerry is currently behind in the polls but I believe he said that he has the largest grassroots organization of any gubernatorial candidate. The primary is still quite some time away, so McBerry may well be able to win this. The theoretical potential for having a governor like McBerry and a legislature willing to consider and perhaps even pass the aforementioned types of laws is a development of epic proportions, and is precisely what we need across the country in order to win back our republic.

We can't afford to not take McBerry's campaign seriously. As much as I am excited about and supporting the Congressional campaigns, gubernatorial campaigns like this one are exponentially more important than any race for House or Senate possibly could be. Hey, I have a great^n grandfather who voted for the Kentucky resolution. At least I assume he did, because it says the vote was unanimous. He was in the first Kentucky legislature.
He also fought at the Battle of King's Mountain. He was a colonel. Nasty business that. Revolutionaries versus Tory colonists.
Between revolting and legislating, he fought Indians, I regret to say.

McBerry is genuine
I have never seen any other candidate come out as boldly for state sovereignty as McBerry. Just read his legislation. Many supposed conservative and libertarian candidates won't even talk about the kind of things McBerry is saying.

Check out state Senator Randy Brogdon who is running for governor of Oklahoma. I don't think he's quite as confrontational as McBerry, but he's still a solid choice. Brogdon helped block REAL ID in Oklahoma and helped lead the state sovereignty resolution to passage (and he wanted to pass a state sovereignty bill that had the force of law).

Millions agree that a tax on one's income is unConstitutional, but few want to fight the IRS alone. This plan gives strength in numbers... whadda they gonna do?- Arrest the whole damn State!

States defending the people
What's great about the idea is that it places the state directly in-between the people and the feds, so if the feds have a problem with it (and they will), they need to take it up with the state. Thus, the state would be fulfilling its duty to protect the people from federal usurpation.

Someone would need to set it up the same way as for the Congressional money bombs. It would need a pledge website and a grassroots army (i.e., people like us) to promote it. The thing is, though, I suppose people are more willing to donate to Congressional campaigns in other states than they are to state government offices because votes in Congress directly affect us all regardless of which state we live in, whereas a governor tends to only affect the state of residence.
Hopefully, however, people see the tremendous ideological significance of having a man like McBerry as a governor and seeing what he can do. His actions may well be what it takes to rally other states to similar courses of action.

whether we live in georgia or not we need to help guys like this all we can. it's a foot in the door. i'm pretty sure most in the liberty movement would grasp the significance. don't we need 12 governors to start arresting members of congress? maybe i'm thinking of something else.

Arrest Congress?
I've never heard of anything about governors being able to arrest members of Congress, but governors can definitely fight against unconstitutional federal policies. State resistance to unconstitutional federal actions is what nullification is all about, and it's exactly what we need. The federal government is big and powerful, but not powerful enough to deal with active resistance from multiple state governments.
The only problem
is the money. The Fed can just print whatever money they need and totally bypass all taxes. But, this would prove that the Fed is a corrupt organization and DC thinks it can do whatever they want.

People still believe that the federal government needs the income tax to do all that they do, not realizing that most of their funds come from the Fed (and, of course, most of what the federal government does is unconstitutional, anyway). If people saw how useless the income tax really is, and what a scam the Fed is, it would be a big victory.
