Former attorney general John Ashcroft may face personal liability for the decisions that led to the detention of an American citizen as a material witness after the Sept. 11 attacks, a federal appeals court panel ruled on Friday.
In the decision, a three-judge panel of the Ninth Circuit Court of Appeals in Boise was sharply critical of the Bush administration’s practice of holding people it suspected of terrorism without charges, as material witnesses. “We find this to be repugnant to the Constitution, and a painful reminder of some of the most ignominious chapters of our national history,”

My guess....
is that the Obama Politburo wants to use this event as blackmail. If the Republicons do not go along with ObamaCare, Chairman Obama can threaten to drop the goods on several key Republicons and throw the party into disrepair just before the 2010 elections.
Or maybe the Chairman has decided to ram ObamaCare down our throats...knowing it will be very unpopular. In which case, dropping the torture bomb on the Republicons may drive down their turnout.
I doubt they will actually drop the bomb...just use extortion and blackmail.

"You don't know where these things are going to end up," former CIA agent Peter Brookes told me. "They could go to very high levels in the government."
There is no obvious enthusiasm in the Obama administration for second-guessing the CIA's efforts after September 11, 2001 to keep America safe.
President Obama has said several times he wants to "look forward, not back."
Republicans immediately criticized the new investigation and even some Democrats said it would be unpopular.
"This is not very good politically for the administration," said Democratic strategist James Carville. "The public clearly doesn't have much of an appetite for this."
But Attorney General Eric Holder said evidence of abuses was compelling enough to require it. No one knows what other evidence will ultimately compel the administration to do.

It would indeed be nice if one of these "responsible" public
officials were actually held responsible for their actions. According to the article:
"Mr. Ashcroft, who was represented by the Justice Department, disputed Mr. Kidd’s version of the facts and claimed his position granted him immunity." This is essentially the "Nuremberg Defense". "I was only doing my job. I was only following orders."
Government "officials" (public masters) have, for a long time, relied upon the claim of "sovereign immunity" to escape personal responsibility for actions taken under the alleged protection or mandate of so-called laws that are themselves repugnant to the word and intent of the U.S. Constitution. If one refers to Sixteenth American Jurisprudence, Second Edition, Section 177, it says that:
"The general rule is that an unconstitutional statute, though having the form and name of law, is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.
Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it…
A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the land, it is superseded thereby.
No one is bound to obey an unconstitutional law and no courts are bound to enforce it."
The foregoing principle should be applied to any government official, regardless of their position on the government totem pole.

Unless Mr. Ashcroft appeals the decision, the case will go back to federal district court for further hearings, which could involve extensive investigation of the former administration's antiterrorism policies.
One can only hope.

Even though I'd like nothing more than to see this guy fry along with many others, I fear this situation will only add fuel to the Left vs. Right blame game (sponsored by the media no doubt), keeping the sheep in a perpetual state of insanity.
Pardon the off topic comment, but speaking of the sheep... I'm reminded of the presidential campaign and handing out I don't know how many RP slim-jims. I used to get so depressed and disappointed in my fellow Americans because >90% of them would only ask one question, "Is he a Republican or Democrat"? No concern for his policies or voting record etc. - All that was needed to make an informed decision was whether he's blue or red. And living here in Calyfownia (as Arnold would say), particularly in the SF Bay Area I'm sure you can guess what happened next.
