Why do police have power?

There was a time, not too long ago, when Sheriff's and deputy's were the enforcers of law. These officers enforced common law, and went into action upon someone calling for them, or witnessing a crime. In fact, some of us can STILL remember the phrase "would you like to press charges?" If the answer was "no" all was done, because without an injured party there is no crime, if no one alleges personal injury, there is no injured party.

So what happened?
All cities, towns, states etc. are now "Companies", within the past 100 years they became incorporated, and as corporations (this can be found at www.DnB.com) created a corporate position known as police officer. We know that "officer" is a corporate word, such as Chief Executive Officer, Chief Financial Officer, Administrative Officer, and so on. These new "police officers" are allowed to enforce rules over their administration only. For example, in Dublin, California, the Dublin police have jurisdiction over City Employees, State Employees, County Employees, and employees of any political subdivisions therein, such as Waste Disposal workers, Utility Company workers, and so on. The ONLY other way that a human can fall under their jurisdiction is through consent, in other words, they have to give up their right to be governed by common law, and instead request to be governed by statutory law. Statutory law can include things like; jaywalking, seat belt requirements, cell phone laws, and other "laws" where there is no injured party.

How Can Humans Consent?
Each "State" is different in terminology, but exactly the same in content. In California a human can consent in 3 ways.
1) By registering a vehicle. The ONLY humans REQUIRED to register are employees of the positions listed above.

CVC 4155:
"Registration under this code shall apply to any vehicle owned
by the United States government, the state, or any city, county, or
political subdivision of the state, except in the following
particulars"

This means, if a human, who is NOT employed in one of the positions mentioned, state employee, city employee, etc., registers a vehicle, then, they will be treated as an employee of one of those positions, and thus, under the jurisdiction of local police officers, and therefore giving their consent to be summoned.

"The acceptance by a resident of this state of a certificate
of ownership or a certificate of registration of any motor vehicle or
any renewal thereof, issued under the provisions of this code, shall
constitute the consent by the person that service of summons may be made upon him within or without this state, whether or not he is then a resident of this state, in any action brought in the courts of
this state upon a cause of action arising in this state out of the
ownership or operation of the vehicle."

CVC 21052
"The provisions of this code applicable to the drivers of
vehicles upon the highways apply to the drivers of all vehicles while
engaged in the course of employment by this State, any political
subdivision thereof, any municipal corporation, or any district,
including authorized emergency vehicles subject to those exemptions granted such authorized emergency vehicles in this code."

this code is a little confusing, because parts of the CVC do not deal with "drivers of vehicles upon the highway" so it clarifys in the beginning that the provisions that DO apply to drivers of vehicles, apply to all vehicles...

2) By having a "drivers license". The ONLY humans REQUIRED to be licensed are those engaged in commerce and those employed by the positions previously mentioned. Remember "used for commercial purposes" has specific meanings.

"(10) Used for commercial purposes.— The term “used for commercial purposes” means the carriage of persons or property for any fare, fee, rate, charge or other consideration, or directly or indirectly in connection with any business, or other undertaking intended for profit."

the terms "directly or indirectly in connection with any business" STILL refers to the "carriage of 'persons' or 'property'", AND must be "INTENDED for profit."
This includes, but is not limited to:
Taxis, Buses, Limos, Ferry Service, Trains, Fishing Boats, Moving Trucks, 'for hire' semi trucks, ambulances, police cars, etc.
using your Private automobile to drive a friend to work is NOT commerce, although it is indirectly connected with any business, it is NOT intended for profit.

3) By signing away your rights. When one of these police officers offers you a citation, you do NOT have to sign it. In fact, if you do, you are consenting to their jurisdiction.
Think of it like this:
one day you are walking on the side walk in your shorts. You happen to be walking right next to the Ford Factory. All of a sudden, an administrative officer from Ford approaches you, and hands you a citation for "wearing shorts". He reminds you that Ford has a strict policy of 'NO SHORTS ALLOWED'. He wants you to sign the citation...you tell the officer that you dont work for Ford, he points out that you are wearing a 'Ford' hat...and recommends that you sign the ticket. You consent, and sign the ticket. You have just allowed this "officer" to have jurisdiction over you, now you will have to go to 'court' to fight it.
NOW, if you said "I AM NOT SIGNING THE TICKET" and walked away, there would be nothing he could do, except get you fired from Ford.
WITH POLICE, you can NOT do this, because POLICE do NOT understand their limits. They, by no fault of their own (some fault), believe that they have jurisdiction over anyone in their town. Instead, OF COURSE ASSUMING THAT YOU HAVENT ALREADY CONSENTED TO A SUMMONS BY HAVING A LICENSE OR REGISTRATION, you simply tell the officer that you do not wish to sign the ticket. He will probably say that he will arrest you if you dont. Then, I ask "under what statute or authority" they NEVER know the answer, and usually say something like "I just will", this is where you say "O.K., then sign "UNDER DURESS" and your name.

as soon as you get home you write "REFUSED FOR FRAUD, SIGNED UNDER DURESS" across the ticket and mail it to the police station and to the court that would handle it. BE SURE to do this within 72 hours, and be sure to make a copy for your records. I would also get it certified mail.

or you can sign it and pay the corporation, they will then literally deposit that amount into their bank and create a bond out of it.
