Vicki, the dispatcher said that the following article is not true. HOWEVER, she then said that the CITY is taking over the jurisdiction within the city and that the sheriff's department will have jurisdiction still in the county, but not within the city of Hardin. Sounds like double speak to me. She told me to talk to Rondale Davis 406-665-9780 at 8 am because the subject is very complicated and she can't explain it. I said it sounds like you are actually confirming this article to me. She said I am NOT comfirming it. There has been a lot of controversy over a private firm running a private jail. But the fact is that the sheriff's department is losing jurisdiction over the city and if nothing else, that is very concerning.

UPDATE:
It is 9:30 Montana time and I called Rondale Davis. He is out for the day. So I called the city and was given Sue who is with Two Rivers. She said nothing is going on in her city. She said American Police Force is ONLY operating the private jail. Nothing more. She said there are negotiations that have been ongoing about what the city police will do and what the sheriff's department will handle. But that is normal and usual business. She said anything the sheriff's department is giving up is going to the city police and NOT to the American Police Force. She said she has a spokesperson who can further explain it if necessary. The spokesperson is Becky Shay at 406 281 0031.

It is 1:10 in Montana and according to Alex Jones and his guest Steve Quayle, they certainly are doing all that has been reported in this article above.

If the sheriff there is like mine here in Texas he knows nothing about the state laws much less the Constitution. The important thing is THAT YOU UNDERSTAND THE CONSTITUTION AND YOUR STATES LAWS, MOST IMPORTANTLY YOUR STATES CODE OF CRIMINAL PROCEDURE AND PENAL CODE. These are yours and yours alone. If you don't exercise it/them and defend them they will be taken away. Like Michael Badnarik says "If you stand on a railroad track, hold up the Constitution, will it keep the train from creaming you" Nope, it's a piece of paper, it's the contents that matter most and your ability to relay them in a meaningful way.

Sherriffs are elected in the County gov't ..they work for the County Court ..They cannot be subjugated in County matters.. The County court holds Deed to City property ..The city is a corporation operating within the County...The County would be within legal right to defend said jurisdiction...Get a new Sherriff.

Folks it doesn't matter who they hire they are all private corporations all ready the city the police department the sheriff etc. They do what they do with your consent. You need to learn to withdraw consent.

I hope they openly hire a different private corporation to police the area that will make it easier to expose them all and refuse to contract with them.

You need to stop assuming they have jurisdiction over you and reacting to every little thing they do. They only have it if you consent to it period. Learn to withdraw consent.

OK, this is what is going on in the city of Hardin MT.

At their last meeting, there was a motion to allow a company to come in and run the new city jail.

It will be run by 80 percent of the locals and the rest will be brought in from the outside. They are in the process of hiring a Chief of Police. He will hire his deputies and I guess the other twenty percent will be hired by this offshore company.

It will be a housing hold over for medium to low level prisoners. The minutes will be posted on the web soon. I will get it and post it here.

If you call, be sweet, Milisa is a peach. The Sheriffs dept. has nothing to do with this because it is in the city limits. Makes sense, but Hardin never had a jail run like this before. In fact it never had a chief of police, this is my undertanding but don't run off to the presses until I have confirmed this.

I'm Not Sure I Understand

Typically, all cities are incorporated. (Not saying its constitutional). Cities set up a budget which city residents pay for and county commissioners allocate a percentage to the city because the city should bring in tourists or business. Once the city is set up it is called a municipality hence MTSU (Municipal Taxing Support Unit) and the sheriff of any county does not have jurisdiction in each MTSU/city. However, a city can sub-contract with the sheriff for patrol.

Ok, so

in Hardin, they don't have a police department apparently, so apparently they have been letting the sheriff take care of it and so apparently they are now taking that back away from the sheriff and giving it to APF, because they still don't have a police department but they are negotiating with teh sheriff to remove some of his jurisdiction duties.

Then the people living in that city - when they set up their own police department - will pay higher property taxes to pay for their new police department that will arrest them, ticket them, and hold road blocks to check their papers. Now you understand the constitutional provisions for the only two constitutional law enforcement offices:

City versus county

Can't say anything about the private police force or the jail, but a Municipal police department having jurisdiction within a city and the Sheriff having jurisdiction outside the city is normal. In fact, I would say it is the rule rather than the exception in cities over a certain size.

but what we have here is a city without a police department and so perhaps the sheriff was taking care of it until now. Since APF has arrived, they want to take over the policing of the streets. NO, NO, NO. Not in America. Private companies are not suppose to patrol our streets.

Why not private companies to police the streets?

They would have the same Constitutional limits as a public agency because they are acting as an agent of the City. Plus, because they are operating for profit, they would probably be much more diligent in keeping their officers under control. Let me explain why.

Suppose a cop that works for the city beats up a citizen. The citizen sues the city and wins a million dollar judgment. The city just passes the million dollar cost onto the taxpayers and keeps the cop on the payroll because it doesn't want a hassle with the police union. But how long do you think a private cop working for a for-profit business would stay on board after costing the company $1 million? Not very long, would be my guess.

And how often do you hear about security guards beating people up or killing people compared to cops? I'll take private cops any day.

I'm wondering

Why a city of 3,500 people needs much more than a justice of the peace and a deputy or two. Here's this little bity town and this $12 million (ballpark)

officials or civil service employees.

The law has not yet been changed to handle this.

Until it is, it is bad news.

However, the law also hasn't been changed to provide any immunities or protection for those private contractors either. So they are to be treated as common criminals if they assault you or your property. They have no jurisdiction outside of what a citizen would to make an arrest. They cannot be conferred the powers of government.

So that means if they attempt to arrest you and you are not in the act of committing a violent crime in front of them when they do so, you can resist with all force necessary.

If they forcefully enter your home against your will, they are breaking and entering. They cannot get a search and seizure warrant as those are only issued to peace and police officers. They are private citizens. As intruders, you can take WHATEVER means necessary to secure your home and the safety of you and your family.

Yes, this all sounds bad. While it makes it easier to terrorize unarmed citizens. The rest of us will either be left alone, or they will quickly and willingly give up their contract as they start dropping like flies.

This will be Blackwater's future U.S. headquarters!!!

Give them incentives to come to Hardin and employee the populace, not come to Hardin and throw them in jail to stimulate the local economy.
