A group of high school students in Tennessee has lost a lawsuit aimed at forcing school administrators to allow them to wear T-shirts to school displaying the Confederate flag.
A lawyer for the students had taken their free speech fight to the US Supreme Court. On Monday the high court dismissed the case, Barr v. LaFon, without comment.
The action stems from a lawsuit challenging a 2005 policy banning images of the Confederate flag at William Blount High School in Maryville, Tenn.
The ban was enacted during a period of heightened racial tension at the school following an altercation between an African-American student and a white student. In the months that followed, racist graffiti began appearing on school walls, including a drawing of a noose next to a Confederate flag in the boys' restroom.
Between August 2005 and March 2006, school officials encountered 452 student dress-code violations, including 23 involving displays of the Confederate flag, according to court documents.
Three students, Derek Barr, Roger Craig White, and Chris White, filed a lawsuit claiming the school's anti-Confederate flag policy frustrated their desire to express their Southern heritage by wearing clothing depicting the Confederate flag to school.
School officials said their policy was aimed at preventing a disruption to the educational process in light of growing racial tensions on the campus. Director of Blount County Schools, Alvin Hord, said he did not ban the Confederate flag because it was a "racist symbol," but because of the ongoing racial confrontation at the school.

It's not a racial thing
I'm from Virginia, and the Confederate Flag still flies around the Shenandoah Valley. Not because there is racial hatred, but because THE SOUTH SHALL RISE AGAIN! YEEEEHAAAWWWW! Seriously, that is why it is flown. I'm sure southern kids wear the stars and bars as a statement regarding our current government rather than anything else. Perhaps they wear it as a suggestion for secession. I know I would!
Here in the Valley, everyone gets along. Black, White, Red, Yellow . . . it's a regular melting pot around here.
Feebs with respect we Southerners should not be
expected to show we mean no harm. Our First Amendment rights should not be based on whether others are offended or not.
When any of us have to justify our Constitutional rights to others, we have lost them. They become not ours by right but by permission.
this is not all tn
this is just one school up in east tn...
"School officials said their policy was aimed at preventing a disruption to the educational process in light of growing racial tensions on the campus"
-maybe they should actually begin an educational process and mediate between the two camps in order for a little truth to emerge and peace to be established so the students can get back to sleeping in class and the teachers playing tetris...

The same thing was done in western Tennessee many
years ago. See: Watkins Overton High School in Memphis.

Time for the school board to be fired along with admin.
everyone wear confederate flag clothes to school.
It's not about being offended.
The question is do all Americans have free speech rights protected by the First Amendment? The answer is no.
Southerners are in effect less than first-class citizens. The Supreme Court has so ruled, and this is why I have only contempt for Washington D.C.
the people should be the supreme court
.
We'd need a really big building
Really really big.

Anyone offended by the Confederate battle flag is in dire need

So Tennessee students are not allowed to express their
Southern heritage because of ongoing racial tensions, but other southerners are allowed to express their heritage?

exactly..
people have certain situations where they have the power. The more students they send home, the less funds the school gets. I'd like to see that school operate on 10% of its funds.
Oh, I get it!
Because some school district finds a "racial tension" issue resulting in what appears to be a single "schoolboy fight", they ban the expression of all students in the entire school.
Looks like the school was looking for some excuse to further implement their oppressive "political correctness" policies.
This happens to be an hour from where I live.
I'll be looking forward to watching this HS principal, and members of the School Board losing their jobs over this after the next election.
Let's see how much they "love" their "political correctness" policies when they are in the unemployment line.
but BigT

This should spur confederate flag t-shirt sales in Tenn.

This sentence makes no sense. He is indeed banning it because it is assumed to be a racist symbol. He is playing the race card is issues that do not warrant that card being played.
can they wear the israeli flag
live free or die,
what would happen if some of the students wore an israeli flag? the israelis are far more racist than anyone.
