An Army investigation found that Soldiers should not have been sent to man traffic stops in a small Alabama town after 11 people were killed in March during a shooting spree.
The report from the Department of Army Inspector General found the use of military personnel in Samson violated the Posse Comitatus Act, which prohibits federal troops from performing law enforcement actions.

There's your necessity right there Chris. A lot of these guys aren't real big on laws and 70 year old trials. They just follow orders. All they want is to earn a living, serve their country and raise a family. If they aren't made aware of their duty to disobey unlawful orders, they will be led into doing some despicable things and harming their fellow countrymen. One breach of the constitution will lead to another, and another and another, as this incident in Alabama illustrates. Just look at each successive wto or G20 meeting, the security response ratchets up a notch. Nightmarish robocops now fill the streets, gassing, assaulting and using experimental weaponry, not on dangerous foreign combatants, but on peaceful citizens exercising their right to free speech. Tell me again Chris Matthews why we don't need to remind them of their oaths to the constitution?
Good on whoever made a stink about this and got the army inspector to check it out. When nothing seems to surprise me anymore, the fact that the posse commitatus act is still in effect nearly bowled me over! We must remain vigilant though. If we're not careful posse commitatus breaches like these will become standard operating procedure and soon the laws and rights of the people will be routinely violated without a second thought. They're just following orders, now obey!

So, the Posse Comitatus Act is still in force? I remember reading something in the past year or two about a new law that basically invalidated Posse Comitatus....

the John Warner National Defense Authorization Act for Fiscal Year 2007 but
was repealed by HR 4986: National Defense Authorization Act for Fiscal Year 2008.
So we still have the Posse Comitatus Act.
