Census!!!

Ok, I need help understanding what I am constitutionally required to fill out on this blasted Census "Survey." It's extremely detailed and very invasive. Please give me a source or a link to something that tells me what I am REQUIRED BY THE CONSTITUTION to cooperate with.

The headcount is what the census is for, to divide the

states into representative districts. The rest of it is just unconstitutional snooping.
The fine is only $100, and I am certain there will be many people who will not fill it out. It is most likely a threat with no consequences if you don't comply.
I have personal experience with this, as we always received the Agriculture census with the same threat if you did not fill it out, and we never did.
We did get phone calls (threatening) and they seemed to want me to say I 'refused' to fill it out. So I would tell them I didn't believe in the census, the results were used against farmers and ranchers. Then they would ask, "Do you refuse to fill it out?" And I would say, "No, I don't refuse, I don't have time right now"
One time they said in exasperation, "Mrs. S., don't you realize that you allocation of FUEL will be tied to what you put down on your ag census?" Then they got an earful--that didn't set well with me.

We have received the Ag census requests for over 30 years and I have never filled one out. No fines either.

I think he might be onto something when he says he thinks they want to build a profile on us.

That would certainly be consistent with the data-mining projects the gov't has embarked on against the American people.

There is just no valid reason for the gov't to be asking, no...DEMANDING such information with threat of penalty for not cooperating.

Something is just not right with this "Census" project. :(

I have no other homeland.. division causes strife ..The IRS pulled this same info crap back in 1984- 85 . for their revenue sharing crap..I'm against singling any one group for any purpose as ALL Americans are to be treated equal ..If someone wants my pay or job come & get it, LEGALLY. Build your own community..Like my parents had to.

That survey should be pretty easy to fill out because it would only involve one question: How many people are in the household?

The intrusive, extensive "surveys" are quite disturbing in light of gov't data-mining projects.

These "surveys" are also quite disturbing when, as Michele Bachmann pointed out in artistsforRP's video link below, Census information was used to round up Japanese-Americans during WWII to put them in camps.

If the Constitutionally-authorized purpose of the Census is to count people to determine representation, for what purpose is the other information being used?

Since when has the Constitution superceded law or force?

If you refuse to give out the information or you deliberately give inaccurate information, you can be in legal trouble. According to United States Code, Title 13 (Census), Chapter 7 (Offenses and Penalties), SubChapter II, if you're over 18 and refuse to answer all or part of the Census, you can be fined up to $100. If you give false answers, you're subject to a fine of up to $500. If you offer suggestions or information with the "intent to cause inaccurate enumeration of population," you are subject to a fine of up to $1,000, up to a year in prison, or both. Here's the official verbiage:
221. Refusal or neglect to answer questions; false answers

(a) Whoever, being over eighteen years of age, refuses or willfully neglects, when requested by the Secretary, or by any other authorized officer or employee of the Department of Commerce or bureau or agency thereof acting under the instructions of the Secretary or authorized officer, to answer, to the best of his knowledge, any of the questions on any schedule submitted to him in connection with any census or survey provided for by subchapters I, II, IV, and V of chapter 5 of this title, applying to himself or to the family to which he belongs or is related, or to the farm or farms of which he or his family is the occupant, shall be fined not more than $100.

(b) Whoever, when answering questions described in subsection (a) of this section, and under the conditions or circumstances described in such subsection, willfully gives any answer that is false, shall be fined not more than $500.

(c) Notwithstanding any other provision of this title, no person shall be compelled to disclose information relative to his religious beliefs or to membership in a religious body.
Sec. 222. Giving suggestions or information with intent to cause inaccurate enumeration of population

Whoever, either directly or indirectly, offers or renders to any officer or employee of the Department of Commerce or bureau or agency thereof engaged in making an enumeration of population under subchapter II, IV, or V of chapter 5 of this title, any suggestion, advice, information or assistance of any kind, with the intent or purpose of causing an inaccurate enumeration of population to be made, shall be fined not more than $1,000 or imprisoned not more than one year, or both.

Personally, I'm considering refusing to fill it out and, thus, to fork up $100. However, there is no way, I'd give money to some census canvaser...it has to be on my taxes or some other official matter. I wonder if that $100 is tax deductible?!

It would be curious to know what the questions are that are

required by the sub chapters listed since refusing to answer those are the only ones that get you the $100 fine.

The other fines are easy to avoid by not answering anything but the enumeration question.

So if you don't lie or try to falsify the numbers and simply refuse to answer anything but the head count, the fine is $100. Big deal. If they try and prosecute you, challenge it. If you lose, you pay $100.

Or answer the headcount and then write "I reserve my rights" or "I plead the 5th" for all the other questions. The federal statute will only be enforced if you can be proven to have answered falsely. By reserving your rights, you have answered each question and at the same time expressed the unconstitutional nature of their invasive aspects of the questionnaire.

Federal courts have looked into this issue and have in my opinion erred. They looked to see if on the few census that were performed there were questions beyond the headcount. The answer that they found was affirmative, but they didn't critically examine their conclusion. At that time, there was the 3/5 slave provision and no franchise for women in effect and the questionaire asked how many slaves were in the household, how many women, and how many men. Based on the wording, the courts have held that asking questions beyond a headcount has precedent and is within the authority of the Commerce department. At the same time we do not have to answer any question with details which would violate our 4th and 5th amendment rights. In order to reconcile the statute with our liberties, it is safest to expressly state the reservation of rights for each question that you do not wish to answer.

In my opinion, the Constitutional authority for the census is to count heads in the district and nothing more. Accordingly, since they have chosen to do that by abode, they have authority to ask how many people live in your home. I do not believe they have authority to ask anything beyond that.
