"regulate interstate commerce" means: to keep regular. It does not mean to restrict. It was plainly included to prevent states from erecting trade barriers between themselves. It was not designed for Congress to prohibit commerce but to foster it.

"necessary and proper" does not mean any and every damned thing Congress wants to do. Each law must be "necessary" meaning NOTHING else can be done about the problem being addressed and that this law absolutely MUST be passed. "Proper" means that it is an appropriate area of law for Congress to legislate in. If the power is not specifically delegated to the Congress, or this is an area that is reserved to the states, or if the law itself does something otherwise inappropriate (such as forcing state employees to enforce a law, or taxing occupations of common right) then the law does not meet Constitutional muster. Additionally, only laws which are to carry in the listed 18 powers are even allowed per the rest of the clause.

"in pursuance thereof" with respect to treaties. Treaties cannot contradict the Constitution. The UN charter with respect to the US is null and void for this reason.

Indefinite detention without charges, and without contact with others is "authorized" by the Patriot Act. The President and the Secretary of the Treasury are "authorized" to exercise this power.

Search warrants must be created by a Judge on probable cause. The Patriot Act "authorizes" the FBI to sign their own warrants.

Just to show you how long this has gone on....

About 15 YEARS ago the Federal Housing Department decided to "crack down" on "unfair housing practices" that discriminated. SO, they began a program of calling landlords and trying to get them to say ANYTHING that they could be prosecuted for in this vein (with fines of up to $50K - $100K per offense).

And what did they consider "discrimination"??????
If you said that the unit (a 500 sq ft, one bedroom apartment) was TOO SMALL for a family of 10, .....that was discrimination. If you made any indication that YOU, as the OWNER of a property would NOT ALLOW more than so many people in the same family into a unit that was too small,...... that was discrimination. If you wanted to charge more in a deposit, to cover damages that might incur from so many people cramming into a small unit, ......that was discrimination....... The OWNER, who takes all of the responsibility and expense of running his property, was not allowed to use his judgement and make business decisions for his own property. And even SAYING THE WORDS was the punishable offense. AND.... the Housing department was attempting to ENTRAP landlords into MAKING these statements by making bogus calls.

They took away free speech and an owners rights to make decisions about his own property MANY years ago. And on the FEDERAL level.

Congress delegated the authority to declare war to the President. There is no authorization in the Constitution permitting the Congress to pass that buck to the President. In addition to the President not having the Constitutional authority to declare war, war still was not declared, anyhow. The US no longer declares wars, probably because our military would be expected to win them if they were declared.

Anyhow, as Ron Paul has said, ONLY Congress has the Constitutional authority to declare war.

Why? Because it will contain no penalty for violation of the Constitution, just like the original piece of written crap.

Unless individual citizens have no protection for violence against violators of the Constitution, then it is like running a household with no rules for kids and they run wild, absent consequences.

So any Constitution, to be protected, must have severe punishment against violators. Yet the violators are always those who occupy the seats of government power, unwilling to do anything to upset their power.

Here is how to deal with it:

If a citizen kills a politician or bureaucrat who has voted for, signed or enforced any law that violates the Constitution, the killer cannot be charged with a crime, and if he is and a jury finds him innocent based on their reading of the Constitution, the lawyers who prosecute him shall be executed within 30 day of the verdict. A special judge randomly chosen from the population by lottery shall preside at such a trial instead of the a normal rubber stamp federal judge.

It should be obvious that there is no consequence to violators under the present Constitution, and look at the results. The only option is for extra-Constitutional action, Revolution. So if you want freedom and a document that guarantees it, you must have a severe penalty in that document for those who violate it, and this penalty must be able to be enforced by individual citizens outside of government (assassins) who are protected by the document and by the actions of individual citizens not part of the power structure (real citizen jury).

Yet I can pull stories where after the trial (on tax protesters and such) where the judge said what they did was worse than rape. Or other instances where the judge jury tampered. Or the judge changed the meaning of the law to get the conviction he wanted. Or the judge not informing the jury of their rights. or the judge not respecting the 4th ammendment rights of people or informing people of their rights. etc etc etc we need to have some judges removed for contempt of court.
