Financial advice needed for debtor single lady
A friend is an excellent worker at a company for 20 years and makes 65k a year. This is good money for where we live, the cost of living is lower than major cities.
She got married, had a son, they bought a home, got divorced and she took over the home ownership. She has now had the home 15 of the 17 years. The husband left a lien on the home. She also has taken a home equity loan. I believe she possibly may not have any equity in the home at this time.
She owes 20k on a credit card. She has a monthly payment on a car.
She co-signed on her son's student loan of 40k. He is to pay $750 a month. He is 24 years old, graduated, got a job, lives at home with her, and got laid off. My friend received a letter three days ago that the school loan payments are out of collections and unless she pay's $450 a month (towards $14k she is now responsible for) , they will garnish her wages. The son hid his letters from her.
My friend did not contact me nor anyone to get any advice and sent a check out. She is talking of selling and downgrading her transportation and getting a second job.
She received a letter concerning getting a second mortgage.
She has an 401k that has a decent amount in it. With the stock market where it presently is, she may have 60k.
She is a honest women who does things by the book. She received that letter, panicked, and sent out a check. She lives day to day. She does not do drugs so there is no vice involved.

I am trying to get her to stay calm and that she needs to start researching information and get a good plan of attack together. I suggested she form a support group on how to deal with her son.
So, I am not qualified to really offer her advice concerning financial matters. This includes her home.
I was asleep until late 2007 when I got introduced to Ron Paul. All my knowledge has basically come from here on the Daily. During these last two years, I paid off my debts.
I told here over the last year to roll out 15% our of her 401k , get some silver and cash just in case for the future, and leave this obscure. She has not.
That is about the best I could do. I told her I have read about strategies concerning selling the home and using the 401k tor paying off debt.
She talks of doing bankruptcy. But, the thing is she will just go with whatever information the banks and government will tell her because she will be scared.

IF you are taking charge of your life and willing to do the work. I sense that your friend is not one of them. She ran up debts when times were good and now has found herself buried. Unable to face her situation calmly, she is reacting to the forces that are pushing and pulling her in all directions. Ultimately she will expend her energy, her time, her money, and her health just trying to keep all those forces from overwhelming her.
Any solution will require her active participation. Frankly, any solution (second job, sell the house, cash in the 401k) is better than the current situation. Advice from numerous sources may confuse her and cause her to delay action our of fear of doing the "wrong" thing.
I advise that she do SOMETHING to relieve some part of her debt. I don't even care if it is not a good solution. As long as it is a net plus to her situation, it will help her build confidence to make other changes in the future.
Sometimes the last thing a person needs is specific advice. If they can gain some experience from dealing with their problems in the school of hard knocks, they will become more capable of dealing with future probems more appropriately.
You know, she actually is a pretty tough woman.
She grew up poor in a rough, changing neighborhood of the city. So, she did very well. My opinion is the divorce, house lien, raising a troubled boy, not having a man to fix things ( hence, credit card) caused her, like others, to become a debtor ( a modern American, unfortunately).
She is calling this new financial debt burden and also for her son, "bump in the road". This is because she is looking at it from the view that, things could be worse. Well, sure thats true. But living life is supposed to be about always gaining knowledge and trying to do the best you can. These are not bumps. With her income she should be living very well.

Before you follow the financial assisted suicide of some below
Tell your lady friend to contact several people before surrendering assets because of some arbitrary formula. That is only for the mentally tough. It doesn't sound like your friend qualifies if she has allowed her co-dependent son to put them both in jeopardy.
Credit cards are often very easily disposed of. In fact many folks have gotten significant monetary awards in successful FDCPA suits. Have her send her son a certified letter stating that unless he starts cleaning up his debts she will file fraud charges and he will go the way of Bernie Madoff - to jail. There is a technical term for kids like this; "mother fucker" - That's what he's done and he might as well deal with it now.

is for the "mentally tough". But I am glad it is given. What this does is provide questions to ask of professionals.
I know you have pointed in the professional direction and much appreciated.
I told her that kicking her son out is not what I recommend. That doesn't help either as far as a family unit nor help him become responsible.

My $0.02 Cents......
1, Food, Electricity and shelter.
2, Make a list of what she spends every month down to the last cent.
3, Cut unnecessary things she can live without (cableTV, video rental services, etc...)
4, She doesn't need to file for bankruptcy with that annual wage amount (65k).
5, If she pays more than 10% of her annual wage amount (65k) on the car, she needs to sell the car and get a cheaper one.
6, If she pays more than 22% of her annual wage amount (65k) on her house, she needs to sell the house and move to a cheaper apartment or a house that's for rent, if she can't sell the house, then, sometimes is best to walk away and minimize the loses.
7, Talk to the Credit Card Companies to see if a payment plan can be arrange, or an APR decrease.
8, If she can't negotiate with the CCC, and it's because she is still current, she will need to default and wait until they offer her a settlement, she probably can get a deal for $0.30 to $0.40 cents on the dollar if she can negotiate that.
9, School loan is doable if she drastically changes her behavior with money ( not that I know how she behaves with money, only going by what I read in the OP).
10, Don't contract any company that arranges repayments with the CCC and tells you they can reduce your debt if you pay them 2K or 3k, most of them don't work and she can do this herself.
11, She shouldn't take anything out her 401k, especially not for paying CC, she could pay them and end up in the same boat all over again and then will be 401kless and a debtor again. If she can't manage money well taking money from her retirement account will only worsen her situation, not to mention she could most likely be penalize for withdrawing from her 401k.

I think there is more debt than the 20k in CC, car ($??) and 14k of school loans, obviously I'm excluding the house payment, but if those 3 are the main problem then she can deal with them with what she earns in 2 to 2 1/2 years if she is determine to get out of debt.
She is earning over 5k a month to be this broke and thinking of bankruptcy, I think that having a detail list of what she spends her money on she can then make adjustment to her life style.
Careful about walking away from the house
In some states, apparently, you are responsible for any shortfall between what the house is sold for and what you owe. Missouri is one of those states. I learned this from my company's CPA.
She did listen
to me last year and canceled her cable. This got her son out of the house instead of watching tv. That worked and saved her some cash.

School loans make more debt slaves
It's truly frightening. Inflation has driven the cost of education beyond reach. Then the government takes over lending money which makes it even worse. They are evil. When I was in school you could take a loan out and the interest would not start accruing on the loan until six months after graduation. Plus the interest was a flat 6% and never went up. Now these kids borrow money and from Day 1 interest starts accruing and the interest rates are very high. They make it so it is virtually impossible to pay off. My son is in the same position. I cosigned on a small portion of it and paid a lot of that off. But, he didn't get that fancy job they promised him at graduation so he is struggling.
School loans never go away. She can file bankruptcy but the only bankruptcy she can declare on the school loans is Chapter 13. She has to pay it back. If she could, she should sell her home, especially if she has no equity in it. I am sure that others here have better ideas but I know from my son's experience that it is hard for a young man to make it in today's world. The evil powers that be set them up to fail.

I would first run this by Dave Ramsey. He's real good at helping folks get their priorities lined up, and then giving them steps to paying things down. Plus it's free.

My sister in law has been out of law school for 9 or 10 years, defaulted many times, on the loan, even declared bankruptcy, and she still has the student loan. She pays each month now, and it never goes down. She owes as much now as she did 10 years ago.

The reason I am saying that is, it sounds like she hasn't taken your advice so far. She is probably thinking bankruptcy how bad can that be.
