For those who are not familiar with the Olofson Firearms case, David Olofson is a U.S. Army reservist who was tried and convicted by the U.S. government on the charge of “transferring an unregistered machine gun” after he lent his 20-year old AR-15 rifle to a friend, Robert Kiernicki, and it malfunctioned on a shooting range, emitting multiple rounds and immediately jamming three times in a row, which aroused suspicion that the rifle was an automatic weapon. Someone called the police, who then called the BATFE. Olofson was convicted in July, 2008 and sentenced to 30 months in prison. He appealed, but the Seventh Circuit upheld the conviction, accepting the U.S. government’s absurd argument that any gun that fires more than one shot per trigger pull, for any reason, even a malfunction, is a “machine gun.”

ATF abuses continue
As a member of Gun Owners of America, I have been knowing this for a long time. I think that it is too bad that ATF was able to get an easy conviction on this. It shows you that this can happen to anybody who owns a semi-automatic rifle that happens to malfunction. Unfortunately, the NRA has pretty much ignored this case. http://www.gunowners.org has some more information about it. People have donated money to help Olofson and his family.
This just showcases
the aburdity of that "machine gun law", and the tyrannical nature of the BATFE.
It's long past due for the BATFE to be dissolved and go the way of the dodo bird.
I remember this incident.
It still pisses me off to this day, especially since I've repaired several ARs that have produced the result. It happens on occasion. This guy just happened to have it go wrong at the worst time, and he got screwed.
As to who turned him in, to be honest, it could be anyone, not necessarily some snitch or plant or whatever. You'd be amazed how many honest shooters go to a range, and when things like this happen, they freak out because of ignorance and out of want to protect the range (liability that can shut the range down) or do their 'civic duty,' they drop a dime.
Similar incident happened once at a range I was on. A 1911's sear was defective, broke, and it went runaway. The good thing is that once it happens, the gun is empty before anyone knows what happened so it doesn't usually cause damage or cause a stir, but some dork called the police about it. I came and talked to them to help out and told them what likely happened.
The police disregarded the call after I talked to them and I just fixed it for the guy. Cost him about $25.00 for a new sear and 10 minutes of my time, no big deal. There's always someone looking to be a vigilante I guess.
