Submitted by Michael Nystrom on Thu, 11/12/2009 - 09:31
Tom Woods, Kevin Gutzman and guest host Judge Andrew Napolitano discuss how states can reduce, curb and nullify the power of the central government.

I'm sorry I missed this
I had it quick listed but seems now Fox is removing all videos associated with them from youtube and I've noted that "conservative" accounts are being deleted like mad.
If anyone has this on another video site, I'd appreciate a link. Thanks.

"This video has been removed by the user." is all I get . . .
"This video has been removed by the user." is all I get from the link.
What a disappointment: I was looking forward to watching the whole program over the weekend.
Is the entire program available anywhere else for viewing?

Many thanks for the good link!
I'm looking forward to Judge A. Napolitano's public lecture series on constitutional law.

The facts about a convention
All 50 states have submitted 750 applications for an Article V Convention. There is no need to nullify federal laws when you can pass amendments to correct the issue. The texts of the applications can be read at www.foavc.org. The Constitution mandates a convention call if 34 states submit 34 applications for a convention.
PIG to the Constitution
I don't think you read the book very carefully. A neocon would be horrified by that book. It is not just "judge-bashing." It is a full-scale assault on "constitutional law" as it has been taught for a very, very long time. How many neocons mercilessly take apart John Marshall, for crying out loud, or the politically sensitive legislation Gutzman eviscerates?
Well what are we waiting
Well what are we waiting for? Show me where to sign. Tell me where to march. I'm sick of this fascist crap.
Constitutional Convention
Didn't anyone else notice how a "Constitutional Convention" got slipped in there without being challenged?

Gutzman on a Con Con
"Yes, I can guarantee that the Convention would not yield a severely altered constitution. How? Because a convention can only propose; it cannot foist anything at all off on us.
"I also note the false assumption underlying your question: that we currently live under a constitution, and that it is unaltered. In reality, as I've explained twice at book length, we live without a constitution -- that is, without a document that circumscribes the powers of federal office-holders. Pelosi laughs at the very thought. Literally. And she's right: it doesn't limit her powers.
"Congress does not have the power to determine the method of ratification, it has only the power to call the convention once the 38th state instructs it to do so. A second ratification convention would be just as the first, in 1787-90, was.
"Can I guarantee that bad amendments wouldn't be ratified? What would they be, exactly? How could the situation realistically be expected to worsen? We live with unlimited government; the call would go out from legislatures for limitations on the government; they wouldn't then ratify increases in the power of the Federal Government. I'd like to know what limitations on federal power you think stand to be lost. It's as if you think we're going to have control over marriage, property, apportionment, criminal punishment, primary education, and other such matters usurped from us.
"Oops: they already have been.
"I'd say that keeping our unconstitutional government is a very foolish idea, and it becomes worse by the day. Geithner announcing one day that he'll inject $1T into the banking system next day; Pelosi taking control of the medical profession; the Depression ongoing (and on its way to getting much worse, as I understand). How very quaint that you want to save us from unlimited central government."
Ratification of the status quo
Gutzman is confused about the danger of the Concon: It is not that it will create a more centralized government but that the State governments are now corrupted by a long history of usurpations by the Federal government, and hence cannot be expected to defend their own interests let alone the interests of the people. To make it in State government, you basically have to buy into the legitimacy of a strong Federal government -- and that is precisely the kind of people who will be proposing amendments in the Concon. They will ratify critical aspects of the status quo.
An alternative proposed by the Freedom First Society is for an educated electorate to utilize their Constitutional power via the US House of Representatives to repudiate, at the Federal level, the unlawful activities of the Federal government.

There are other alternatives such as county sovereignty.

Did this really air on Faux News?
That's what she said.

States can nullify Federal law
and juries can nullify state law.
Just one last kick in the nuts, then a final deathblow
Three of my favorite people
Three of my favorite people to listen to about the Constitution/free markets. The Politically Incorrect guide to the Constitution by Gutzman was excellent and of course Tom Woods is an excellent speaker.
I will disagree on the PIG
I will disagree on the PIG Constitution book, only because you can hear the Judge bashing from even the most hardened neo-con, and I was expecting some criticism of other culprits.
Ventura 2012
There's a history lesson in there
that answers the judge's question,
"How did we get from a small government with maximum individual liberty that recognized limitations on it, to a big fat government that doesn't recognize any limitations on its powers"?
This is a must watch.

Slavery
The Feds will blither about slavery and the 14th Amendment until they create a race war.

Judge > Beck
Hopes and prayers for Glenn Beck's speedy recovery, that being said I think the Judge has a superior grasp of the issues and the potential strategies. Even though the topics discussed are far ahead of most American's ability to grasp (alas), the savvy viewer will note that all three of these gentlemen are playing dumb. I would honestly prefer to see the judge in his own prime-time slot, he knows what he's doing. And definitely more Tom Woods. I'll leave my personal views of Beck for another comment.
WRT a Constitutional Convention I think we should all be very wary. Article V powers are well known by TPTB and if you think they haven't thought about this one and already prepared for it I offer the following link as counterpoint:
