I got a red light camera ticket in the mail in Texas, Has anyone had success fighting these?
I recently received my first ever "you ran a red light" ticket in the mail. It's probably just a coincidence but I just got this device from progressive insurance that I hook up underneath my steering column that is supposed to track my driving habits and possibly save me more money. Maybe it's synced up with the cameras in some way...?
I am not a reckless driver and I don't recall running any red lights as that would be something I would be trying to avoid at all costs. This ticket in the mail came as a surprise and I would rather not pay $75.00 for it.
Has anyone had success fighting these in court and coming out victorious?
I heard there were some efforts being made to prove they were unconstitutional but I'm more interested in results experienced by real-life citizens who fought the law and won. Anyone have an experience to share?

I noticed a few around my area of NJ a while back and mentioned them to a lawyer friend. He said that they are simply revenue generators for the local governments. If I'm remembering correctly, he also said that they were not enforceable.
He mentioned that the cities and towns purposely make the fine extremely low, with no insurance or drivers license points. This is because they do not want people coming into court to dispute these tickets. The whole point is to generate money for the towns, not to serve justice. If I'm remembering correctly, I believe he also mentioned something about people who are accused of a crime having the right to question their accuser and stuff like that.

every court date since I don't give into their crap of pre-paying the fine as they would like to rid themselves of the possibility of you showing up in court & depriving them of revenue, alternative taxes. They don't spend 5c/ giving you an envelope for nothing. It's also the 1 chance I get to meet a judge face-to-face & ask him a ? or too when I otherwise wouldn't get the opportunity. You know, you can do your best recruiting for political causes in the courthouse, but you have to wait & only talk to those who passionately defend themselves against traffic tickets, b/c those are the most likely to make change within their community, such as volunteer for Ron Paul or Constitution Party. Out of the 100s of people you meet just handing stuff out, the people at the courthouse will most likely be receptive. Don't bother w/ the 1s who lose 1/2 a day from work just to plead guilty to the judge & be done w/ it. Just remember, the judge is an atty., he just has the authority to make decisions other can't.
If you notice on the back of the letter you get, there is an invitation for you to furnish the name of the driver & some even have you get it notarized, I believe in an effort to have you put it on the back-burner so your fine can be doubled. You must look up the law & see whether you have to assist w/ the prosecution of the driver. Do not rely on what's written on the notice, government employees make mistakes all the time. If you don't, then don't supply the name & see what happens, just say I know I wasn't & I"m willing to believe you weren't. And really, even if another person was driving, whose to say they drove through that intersection & what's your obligation to ask them? If you weren't w/ them, are you in the position to speak for them? They're not under oath, you are!

Try writing the DA
Tell them someone claims to have photo evidence of you committing an offense and has agreed not to send it to the authorities if you pay them money.

DC some time back but my experience may not be applicable to your situation.
Mine involved a "speeding camera". The DC police have police cruisers w/ automated speed triggered cameras that they move around the city. Most people just pay the fine when it comes in the mail. That is what they want you to do. I requested a hearing. Since the system is set up/calibrated by a particular P.O. that P.O. technically issues the summons for all the tickets the camera writes-that is, the particular calibrating officer "signs" the summons as if he had personally clocked you speeding and wrote the ticket.
As you may be already aware, if the ticket issuing officer, the one that signs the summons, does not appear for your court date the case is dismissed. I went for my first court date and the officer was there so I requested a continuance. In most jurisdictions, DC included, the first request for a continuance is automatic so my request for a continuance was granted. When I went for my second court date the officer did not show. The non-judge, non-legal trained, smug, rubber stamp hearing officer(their job is mostly to generate revenue for DC while pretending justice is being served) delayed that officers cases as long as possible and had people attempting to contact him to come to the hearing venue. After all of the other officers cases scheduled for that day had been heard, the hearing officer had no choice and had to begin, slowly, processing the dismissals of the no show officers cases/tickets. Eventually all tickets for that officer were dismissed including mine.
I do not know if any of that will help in your situation but I hope so and good luck. It is far more than money at issue with these cameras. Fight as hard as you reasonably can.

I have a similar story
I pled "not guilty" and a trial was scheduled. There was a snow delay and I went to have it rescheduled, but they wanted me to sign something. I didn't know what it meant so I refused. When I got home, I looked up what the law was it referred to and it was something about waiving my right to a speedy trial.
It turns out, the officer was in training for the rest of the trial dates that were still within the speedy trial time period. Of course, they didn't tell me and I showed and the officer didn't. Case dismissed - the only winner of the day.

To avoid future occurrences there are several products available that make the cameras blind to your license plate. I have not used them but I am almost positive they work. They all use the same principle which is to make your plate so shiny that the camera flash reflects back to the camera and obscures your plate so it is unreadable.

driving? Is your face clearly the one behind the wheel or is it shadowed or blurred? If it does not appear to look like you, you can't be cited.
There's a guy in AZ who does this occasionally on purpose wearing a monkey mask, but they can't cite him because they can't prove it's him driving. It could be someone else who borrowed his car. There's a link somewhere here on DP.

I think they then try to get you to say who was driving your car. But I question their ability ticket the owner of the car on default. Wouldn't that be coercion?

Here in AZ these are quite common. They are not only unconstitutional, but not considered valid unless served by a human being (accuser). Most of us here know that if you just ignore the notices in the mail, they go away. My advice would be to not respond in any way shape or form. I have even had process servers try to serve me. Don't respond.

And if you're lucky enough to have an Administrative Officer listen to your defense like I did, then you're out of luck! My AO thought he belonged on the Supreme Court, he wasn't an attorney or even a paralegal. But he had "20 years experience" when i asked. I guess he felt he had to justify himself, which he didn't. But try to fight it anyway. I actually called in a complaint because the company that facilitates the ticketing, is a civilian contract company. The local people were never in their office or answered their phones. When I called headquarters to complain they were surprised no one was in the office. Another fine example of inefficient contractors taking over legal aspects of government.

Unfortunately it's civil not criminal
So the charge is against your property not you. Your property does not have the same burdens of proof. It is preponderance of evidence vs. beyond a reasonable doubt. That is why it does not go on your record and the fine is relatively low.
You could have fought it before 2 legislative sessions ago when the cities were issuing these citations against state law...if anyone would have bothered to sue, it could have resulted in millions of dollars being returned to camera victims at a cost of many more millions to administer.
There is a very active coalition of law enforcement pushing for these with the vendors hiring independent hired guns to work on keeping cameras and expanding them. The legislature is generally against them but they gave in because of the pressure from these groups.
