Limbaugh on the radio today about the KSM trial. Rush to judgment.
Rush was going into apoplexy about the KSM trial, and how it might not ensure that KSM is going to be convicted, to receive the death penalty that the neocons want.
He moaned that there was some possibility that there might even be a semblance of a fair trial, and that this could create a problem that no "procedures" were followed for Miranda warning, and that there is the admission of torture by the administration, and he "might get off" (gasp!)
And then he went on to say that "this is why we have military tribunals and the military commissions act" to handle these things. The unstated parenthetical, of course, was that these things are to ensure the railroading of anybody they want to send to the gallows, to keep them quiet.
And then I could tell his eyes were bugging out when he starting screaming about how this might bring things out that could "put the spotlight on the Bush administration" and "might even bring indictments of Bush and Cheney and others" by "people who want to see the United States destroyed".
Oh! It was priceless!

He's freaking out because the real info might come out about 9/11 and all the dirt that the Bushies did.

to blurr the boundaries of our sovereign country? So now we can give foreigners captured in foreign countries the same rights as our own citizens? This sets a dangerous precedent for how we will prosecute any illegal alien or foreigner in general. Is everybody in the world now a citizen of the USA? Constitutionally, I can't figure this one out. It seems that this should be a military tribunal case, but since we never legally declared a war, I don't know where the case should go. Anybody know the Constitutional answer? Even Judge Napolitano was confusing on this issue on O'Reilly Factor the other night.
Constitutionality of Trying Foreigners
The Bill of Rights. Adopted by the Congress in 1789 and ratified by the several states on December 15, 1791. The Sixth Amendment of the Bill of Rights states....
"In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district where in the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense."
No where in the Amendment does it say "citizen" which would imply one who is not foreign. It also states in the beginning "In all criminal prosecution..." which is (in my opinion) what the *crimes* of 9/11 fall under, in regards to the constitution. He should rightfully be tried "by an impartial jury of the State and district where in the crime shall have been committed". Now, thanks to George W. Bush with the Military Commissions Act of 2006 we can say Khalid Shaikh Mohammed is not entitled to the protection of the Sixth Amendment, BUT (And this is the BIG BUTT) likewise, do to the Military Commissions Act, Neither do we. Since, we as supporters of policies against the Federal Government, it would classify us as "enemy combatants". The thing to understand is as Americans who live in a very small world now (Compared to the founding fathers world) we no longer can accepted that we have exclusive rights that the rest of the world does not.
If we think we can deny LIBERTY to others, then we do not deserve it ourselves.
And above all (which makes it even more sublimely poetic that those men 237 years ago wrote the words the way that they did to insure that those accused of a crime will at the least be given a small bit of hope, no matter how guilty one may be portrayed, to protect themselves) we KNOW he is innocent. We really don't want to admit it but we KNOW. We have known for a very long time. He MAY be linked to terrorist. He MAY have killed in his lifetime. And he MAY even have had a hand in the Death of 2,976 Americans. But morally speaking, We know who is truly to blame. We know who started this mess. And we know who REALLY should be in that courtroom at 500 Pearl St. in New York. Lets not kid ourselves, we will for first time since September 11th, 2001 witness in a public trial the evidence of that day. The way the founders had designed it.

When he first came radio, I listened. When he had a TV show, I was actually in the audience for a taping! He sounded good... made all the right noise for a young, impressionable guy like me.
Then he tipped his hand.

I guess I can't help think this to works to scare people into thinking that the bad man goes free and some how they will wiggle more of our freedoms away from us. I hope, I'm wrong. It would be nice if TRUTH prevailed for once. Wouldn't it be nice if ALL the evil secrets were revealed. I mean going back years, because all this underhanded stuff didn't just start.
