Question about the terror trials scheduled to take place in NYC instead of a military setting...
I'm really torn on this one. On one hand, I don't like the idea of a terrorist getting the same rights as an American citizen, but on the other hand I don't know how the government can do anything but that.
Yes, he was captured overseas, but we are not at war with anyone. At least not officially. Hasn't the government put themselves in this awkward position by not actually declaring war on Afghanistan? If war was actually declared then I can see people being outraged of these terrorists being tried in NYC and not a military court. But since it wasn't how can you say he did anything more then commit a crime (a horrible one at that, but still a crime, not an act of war)? He didn't represent a country but an organization. How is Al Quida any different then the say the mob?
How is he any different from a criminal that is captured overseas and then extradited back to the States? How is he different from McVaigh? Should McVaigh have tried in a military court? Lindsey Grahm's outrage the other day seemed a little contrived and a little late. Any thoughts on this? Thanks. Peace...

The average Joe out there
THINKS that war was declared.
They don't even realize that it was not a declaration of war that was passed in Congress.
They just got all starry-eyed about what Shrub was saying on the TV, and lined up like robots to believe whatever he said.
So, the neocons are still playing off that deck, and using the ignorance of the people to try to push for a closed-doors military tribunal, so that nothing comes out in public about their lies and criminal activities.
The neocons only want this tribunal to hide their own guilt from the public.
That's the bottom line.
I'm not even sure the average Joe realizes that congress is
required to declare war by the constitution. When was the last time we actually declared war? WWII? It has become some common for us to just go bomb people that we feel we need to attack. Eisenhower's warning about the industrial military complex was dead on.

as i stated on one of the rand posts
seeing how the word terrorist is tossed about now, second only to racist, i firmly believe they should be tried in our courts.

Sorry for the self bump, but I'm hoping some legal minds out
there can shed some light on this for me. Thanks.
