Editorial unfairly critical of Rand Paul

Wednesday, February 3, 2010 11:00 AM CST

I was disappointed in your Jan. 26 editorial criticizing Rand Paul regarding a question he raised about a conflict of interest on the part of Trey Grayson.

Paul and Grayson are running in the Republican primary for the U.S. Senate, as Kentucky’s secretary of state, Grayson serves as the chair of State Board of Elections.

You apparently didn’t read the conflict of interest statute which Dr. Paul referred to in his letter (KRS 11A.020). That law prohibits elected officials from presiding over matters in which they have a personal interest. What could be more of a conflict of interest than having Grayson preside over an election in which he is also a candidate? That’s like having Ken McDonald serve as referee at the next WKU basketball game. Although that would be fine for WKU fans, the other team would be understandably upset. Judges frequently reassign cases in which there may be a real or perceived impartiality. Their recusal is important because it removes any doubt about the fairness of the judicial process.

Kentucky’s conflict of interest laws were not enacted in condemnation of our state officers. These standards were intended to avoid the appearance that our elected officials might be influenced in situations where they have a personal as well as an official interest. There is a process for ensuring that the official function is carried out by someone without a personal stake in the matter.

Likewise, Dr. Paul’s request was not an attack on Trey Grayson’s integrity. It was simply a request that Mr. Grayson follow the law so that people won’t have to wonder whether the referee over this election is unbiased.

Grayson's no stranger to election funny business

"But Crayton insists that the balloting was inconsistent, and that there were several times during the four meals set aside for the election when council executives were not present to collect votes.

"I went to vote and there was no one at the table, and several other people told me they tried to vote and no one was there," Crayton said.

Crayton said he was upset because he lost to Bryan A. Henry '95 by only eight votes, which he felt was an insufficient victory for Henry considering the conduct of the election.

Garza, however, characterized the election as one of the best-run of the year.

"I took every precaution from the very beginning," Garza said.

She worked closely with Kirkland House Committee Chair Trey Grayson '94, who helped her publicize the election and witnessed Garza's counting of the ballots.

"I understand the problems of the election process and didn't want anything like what happened in the fall to happen again," she said.

Last fall the general council elections were disputed at several stages when candidates claimed that council negligence was skewing election results. "

WOW!

He was involved in election funny business before he even graduated Harvard! Great find.

What part of "request that Mr. Grayson FOLLOW THE LAW" don't "they" understand? If Mr. Grayson doesn't want to follow the law, why would anybody want him in office???
