South Carolina fires cannonball at Fort Obamacare!!!
This bill passed today (Tuesday, 3/9/2010)!!
http://www.scstatehouse.gov/sess118_2009-2010/bills/424.htm
Be it further resolved that it is the policy of the State of South Carolina that:
No law shall interfere with the right of a person to be treated by or receive services from a health care provider of that person's choice;
No law shall restrict a person's freedom of choice of private health care systems or private health care plans of any type;
No law shall interfere with a person's or an entity's right to pay directly for lawful medical services; and
No law shall impose a tax, penalty, or fine, of any type, for choosing a health care provider, to obtain or decline health care coverage or for participation in any particular health care system or plan.

The main point of the legislation was to impose new taxes.
The courts may throw out the requirements to have insurance and the penalties for not having it, but they will not eliminate the new taxes.
And if history is any indicator of what happens when taxes are imposed beyond the ability of people to endure the pain, revolution follows. The American Revolution in 1776 was about taxes. And contrary to the "free the slaves" bull crap, the Civil War in 1861 was about taxes also.
I don't find the threatened lawsuits coming from States as all that noteworthy. What would be noteworthy would be for a few of the States to fund their State Militia (composed of all able bodied citizens), train them, and send them to capture Washington DC.

Hello Medicare
"No law shall interfere with a person's or an entity's right to pay directly for lawful medical services; and "
I'd love to have that in my state as it seems to allow medicare patients to pay directly for care without going through medicare. Well, that is a hope anyways.
They'd probably come back with those medicare restrictions being contractual though.... sigh.
law
it is law!
Freedom is NOT free!
Is this just a resolution
Is this just a resolution (like the 10th Amendment resolutions that have been passed in several states) or is it actually a law? We have a law like this in FL proceeding through the senate but it will actually be part of our state constitution, thus it will mean something.
We will
be the first again!
Freedom is NOT free!
southcarolina has a long history
of resisting creeping central government tyranny.
It will be interesting to see how this goes.
Not to disappoint y'all
As for the good news from SC, these are the same bastards who over-extended their authority over Governor Sanford, to accept funds from the Federal gov't TARP bribe. It's an election year, they will do and say anything to get re-elected.
Don't be fooled again, all politics are local. Please vote out all -ALL- state incumbents in SC this fall (Nov 2010 just in case you hadn't voted in recent years...). Remember Flimsey Gramnesty still in Senate, should be unloaded as well when his term is up. Please vote out Bob Inglis this time - he has exhausted his value to SC.
Spread the joy
Have all the states move a resolution like this.
This needs to be sent to all your state governors pronto!
I am doing this right now to mine in Minnesota.

It is a good thing to see. I've derived some encouragement
to see other state legislatures recognizing the importance of the 9th and 10th amendments and the limits that were supposed to be placed on the central government.....but aren't. I hope other state legislatures will echo the sentiments and stance taken by the legislature in South Carolina.

did it pass the State House and Senate?
and does it have to go to the Governor?

It passed the full General Assembly
It Passed both houses and was married and passed the full Assembly.
No it does not require the blessings of the governor. But Sanford would have no problem signing on.
