NO to McCain/Lieberman/Scott Brown's S. 3081 Enemy Belligerent Interrogation, Detention, and Prosecution Act !!

Previously posted on the Daily Paul, via the Smoking Argus, Ron Paul Forums and the New American. S. 3081 outlines the process by which Americans may be held indefinitely, without notice of their Miranda Rights, and without ever being charged with a crime.

SPONSOR: Sen. John McCain (R-AZ)

Please start calling your Senators today to vigorously oppose this bill, and spread the word. There is a complete corporate news blackout on this.

The waning authority of the state.

(Thankfully the referenced bill was killed near the beginning of the year...thank goodness!)

"for this would result in a terrible condition."

"What exactly is this terrible condition? It is, say the authors,

"the tyranny of weakness," a condition where citizens become indifferent to its [government's] demands and cease to rely on it to realize their wants. In a politically bankrupt regime the major division is not between different parties competing for office, but between those who are meant to govern and the mass of citizens indifferent to who governs.

So to Rose and Peters the ultimate horror is indifference, a lack of enthusiasm for one's government manifested in indifference to its commands.

In a politically bankrupt world, the citizens try their best to avoid political edicts, which they conceive to be external to themselves, and to escape paying taxes as best they can. And, horrors! They even cease to rely on government to "realize their wants."

Oh, my! What ever shall we do without our benevolent zionized neoliberal overlords to tell us what the curfew is and micro-manage every single hour of our day.

That is exactly what Gary Peters wants in his society. No wonder tens of millions are opting out of that society....

and it so begins,

another fight, even before the New Year has even begun!

I think it may bode well for these mooks to occasionally check outside their windows for their pissed off constituency/Bosses holding their modern-day 'pitchforks.'

and they keep pushing... and pushing... and pushing...

The co-sponsors of that bill

The co-sponsors of that bill are the domestic enemies you have heard about. They are working to establish a totalitarian state. What is the difference between living in Nazi Germany or one of the Communist states if a citizen can be held indefinitely without ever being charged with a crime?

The senators are dangerous and need to be exposed as such. They are trying to overthrow Constitutional government. Our freedoms are more important than the "security" they offer us.

This is the same mentality that caused American citizens who's families were from Japan to be locked up during World War Two. They hadn't committed any crime, yet they were deprived or their rights.

Better to die free than to live as a slave.

Wonder if

any of the McCainiacs out there are noticing all of the nazi legislation he is trying to pull off lately? I want to see some McCain bashing signs at the next tea o con event. Even better I'll go and take them myself and see what the half awake zombies have to say ! They really been coming out of the wood work lately looking for blood and are a scary bunch. Still proudly displaying their Mccain/Palin stickers on their high dollar cars. I have had 3 unprevoked attacks by these morons in the last 2 weeks. Glen Beck parrots for the most part. Really explode when presented with facts and love to ask if you think the government had anything to do with 911. My answer is always at the very least incompetence. They can't stand that answer. They want you to say yes thinking it will confirm you are a nut and render them right and you wrong. Hate to say it, but there evidently is a problem with right wing nuts.
No real knowledge. Just pissed off because their team lost. They will call you every name in the book before you open your mouth. I've been hanging in there and backing my statements with facts and documentation. They won't even answer a question ! And get mad as heck when you show them the truth or they can't back up what they say except by quoting Beck and not even doing that very well. Meaning to or not Beck has created dangerous monsters and you never hear him talk about any of the crazy legislation the republicans are putting on the table.
No apologies to anyone here that still thinks McCain would have been better or that still sticks up for Beck.
Neither of them are friends of liberty or the Constitution. As if I am not sickened enough by Bush and Obama, I shutter to think what McCain would be doing... Well I suppose he would be doing the bidding of the NWO also, but I think he would be even more cooperative and enjoy it even more. Just look at him ! He is doing it now. In the background like a cockroach where most people won't notice because they are still asleep or half asleep being led in the wrong direction and not thinking for themselves. Sorry for the RANT !

Thats why the left is pissed

Thats why the left is pissed about right wing nuts, because they aren't really into educating themselves about different viewpoints. Id have to say that some of them are pissed because their team lost, like you said.

BUT then there is also the REVOLUTION happening with real people. It seems like everybody forgot that Sarah was neo-con McCain's VP choice. He wouldn't have chosen a liberty Repub... he chose her for a reason.

These legislators are

These legislators are attempting to overthrow Constitutional government.

I guess that makes them anti-government.

Very important

Yes this is Obama coming for what's left of our rights

Why don't the Tea-o-cons, who are so worried about birth certificates, see this? The way you put it to a Tea-o-con is: Bush pussyfooted around with diluting our rights in the name of fighting terrorism, but still he was kind of careful, maybe hesitant. Obama's coming after them and no bones made, straight down the line and in broad daylight. New Stalinism. Point to someone and he disappears.

Come to think of it, if you look at the facts, it fits. I never in a billion years thought Bush would be looking quaint. At least he bothered with backflips and "wartime powers." Obama is a magician, he may be doing the impossible: giving Bush a run for his money for "worst ever."

S. 3081 Tea Party-we care in Racine, WI

I am a proud Tea Party member in Wisconsin and I have actually passed out fliers on this issue as well as other legislation, including H.R. 257, H.R. 2159, H.R. 45, H.R. 257, H.R. 808, H.R. 1022, H.R. 2296, H.R. 2324, H.R. 2401, S. 556, S. 843, S. 843, S. 941 (Gun control bills); H.R. 5741, H.R. 1388, S. 277 (Draft Bills); H.R. 2749, H.R. 999, S. 510, 3767, S, 1296, S. 429 (Fake Food Safety Bills); H.R. 2454, 2998, S. 1733 (Cap and Trade Bills); S. 3002 (Fake Dietary Supplement Bills); S. 787 (Clean Water Act); H.R. 4061, 3458, S. 773 (Fake Cybersecurity Bills); House Resolution 1553 (Which will lead to Nuclear War!!!!); H.R. 2639, which was orginally introduced By Obama in 2008, which would destribute wealth of U.S. citizens to the UN; H.R. 669, H.R. 2811 (Nonnative Wildlife Invasion Prevention Act); S. 1619, H.R. 4690 (Livable Communites Act) which is the scariest bill in U.S. history, welcome to our country under UN control; S. 1261, H.R. 3471 (PASS ID Act) which would revive the REAL ID Act; and H.R. 4646, S. 2965 which would charge a 1% transaction fee on ALL bank transfers!!! I am warning people in the Tea Party but they seem like they are controlled by Michele Bachmann and Sarah Palin (who is related to Obama and Rush Limbaugh). It's not easy to awaken these people from the slumber of the main stream media.

Thanks for all your...

work ... alot of very good information...

If this is Obama's works,

If this is Obama's works, then why is all of the co sponsers of this bill republican? Don't get me wrong I am no fan of Obama, but I will not say he is worse than Bush, as Bush basically was very close to declaring martial law, and was probably one of the most unconstitutional presidents America has ever had.

What Zon said!

Bingo, completely agree. Bush and Obama are tied for last place when it comes to defending liberty.

A Re-Affirmation of Our Rights, This Overthrow is Treason

Moved to main thread.

A re-affirmation of our Sixth Amendment rights under the US Constitution. A letter to the Sergeant at Arms of the United States Senate:
Bill Pickle
S-151, US Senate Office 151
Washington, DC

Whereas, the first duty of all Constitutional officers who swear The Oath is to "protect, uphold and defend the United States Constitution against all enemies both foreign and domestic,"

Whereas, after 9/11 the federal government has steadily trod upon our rights under the Sixth Amendment of the Constitution, the right to a jury trial no matter what the charge, which began on May 8th, 2002, upon the arrest of American citizen Jose Padilla, who was designated "enemy combatant" in his own land under the tissue-thin claim of wartime powers in the first war declared to have "no end,"

Whereas we lend no credence whatsoever to fallacious, odious arguments which betray the bedrock principle of a presumption of innocence before the law, secured in our Bill of Rights by dint of sacrifice on ground named Lexington, Yorktown, Bunker Hill, Valley Forge, Ticondaroga, and others,

Whereas we have not forgotten these sacrifices, written in blood on battlefields,

Whereas, the claim to authority to deprive any American of his or her Sixth Amendment right to a jury trial, with counsel, no matter what the charge, is a wishful fantasy of tyrants,

Whereas, the claim that "terrorists" do not deserve Sixth Amendment rights is bankrupt prima facie, since a determination of guilt must precede the bearing of that guilt,

Whereas, the application of Ex parte Quirin by the Fourth Circuit Court of Appeals in the case of Jose Padilla is a flawed application of precedent, since an indefinite, never-ending "war on terror" has no precedent. The standard for a precedent to apply in law is "for the facts of the case to be substantially similar." The present "war" bears no similarity to the World War II context of Ex parte Quirin, since the enemy cannot be seen, cannot be determined to be defeated, and possesses no command from whom to accept surrender. In all facets the "war on terror" is a novel set of facts under law.

Whereas a war which imposes the rules of the battlefield upon ordinary citizens in their own land indefinitely can only be a dream of tyrants from time immemorial,,

We Patriots hereby call an end to these stealthy and determined incursions upon our Sixth Amendment rights, which began on May 8, 2002 and is now taking its boldest form in a call by certain senators of the Republic, who have sworn the oath to defend the Constitution, and instead seek to subvert what is the very bedrock of the Constitution, our "inalienable" rights under the Bill of Rights.

The Constitution can be changed only by Constitutional Convention. Those who propose to change it by any other means are derelict in their duty to defend her. We direct the Sergeant at Arms of the United States Senate to place Sen. John McCain (R-AZ), Sen. Scott Brown (R-MA), Sen. Saxby Chambliss (R-GA), Sen. James Inhofe (R-OK), Sen. George LeMieux (R-FL), Sen. Joseph Lieberman (I-CT), Sen. Jefferson Sessions (R-AL), Sen. John Thune (R-SD), Sen. David Vitter (R-LA), Sen. Roger Wicker (R-MS) under arrest to be tried for the crime of treason, as "domestic" enemies of the Constitution as the Oath of the arresting officer requires.

We say again to all tyrants who would follow in their path of treasonous intrigue against We the People: "Don't Tread on Me."

Well written and well said!

Your post alone deserved a bump, so here it is. I may print it off to mail to LeMeiux and Inhofe.

Love won! Deliverance from Tyranny is on the way! Col. 2:13-15

Anybody know where Rand Paul stands on this issue?

I mean, given his positions on Gitmo and military tribunals, and all.

Has he given any statement about this?
Perhaps it might be a good idea to find out.

Ayla Brown is available.

I guess I will e-mail my disgust to both Inhofe and ...

LeMieux! This really fries my brain to the point of explosion! I am particularly disappointed in Inhofe, I had respect for him because of his standing up for the Ron Paul delegates in the last primaries. Someone may have gotten to him, just as they got to Coburn on the bailouts, but it still is a huge letdown.

I'm fed up.

They're not listening in D.C. What is it REALLY going to take?

"Necessity is the plea for every infringement of human freedom. It is argument of tyrants. It is the creed of slaves." William Pitt in the House of Commons November 18, 1783
"I know major allies who fund them" Gen. Dempsey

Call, email, fax & write till your blue in the face. Once their in the give a shit less what the hell you think, except for what the special interest and lobbyist want. WAKE-UP y'all. Example Scott Brown he's been in Washington for about a month and is co-signing this Gestapo piece of crap!

All hail Scott Brown and the patriotic Eight!

I'm impressed by such a bold and stunning move to protect the children. All of you here complaining about our patriotic American government that works tirelessly to defend the people ought to be ashamed of yourselves. I'm glad that our system works so well, and that even although the majority of people may not want it those people in Washington DC who are brave enough to act can 'get things done' to ensure the safety of our children!

/end sarcasm

I feel somehow polluted, and quite dirty even writing that above. But I did it to prove a point. Regardless of the issue at hand, there will always be people who are opposed to it and those who are for it. That's human nature. What you need to decide is if you want liberty and freedom or to cram your ideology down someone's throat at the end of a barrel of a gun. Pick one people, because those are your choices. I choose freedom, and consequently, I find it repugnant that those of you here crying for liberties lost are all too eager to force other people to be subjected to the rules you want under the leaders you'd approve of.

Keep complaining out of one corner of your mouth and begging for the rules and rulers you want out of the other. It's what you've all been trained to do.

Thanks for this heads-up! I

Thanks for this heads-up! I just called my CA Sens. Feinstein and Boxer to strongly oppose this monstrosity. Hopefully mentioning that it was sponsored by McCain will deter them, but I took the liberty of reading Sec. 5 to each aid I spoke with and explaining how dangerous it is to extend this treatment to US Citizens.

I'm used to getting mad, but

I'm used to getting mad, but this made me really pissed off.

Check this out:

An individual, including a citizen of the United
States, determined to be an unprivileged enemy belligerent
under section 3(c)(2) in a manner which satisfies Article
5 of the Geneva Convention Relative to the Treatment of
Prisoners of War may be detained without criminal
charges and without trial for the duration of hostilities
against the United States or its coalition partners in which
the individual has engaged, or which the individual has
purposely and materially supported, consistent with the
law of war and any authorization for the use of military
force provided by Congress pertaining to such hostilities.

Bad news Bump!

Those God-forsaken statists!

This is Treason

enough is enough. Put them on trial. Then the firing squad. We must make a stand now.

God Bless America

Let's flood the talk shows

The best to way to give this visibility is to flood the talk shows. If the MSM is blocking any news on this, we can take the news to them. Flood the phones on Hannity, Mark Levin, Rush, Savage and the assorteds. Please have a polite but angry talking points ready before calling these shows. Pretend as if this is a good chance to pour some dirt on McDummy and promote "our guy" JD hayworth. Though we all know the JD is also a NeoCon, we can use his name to promote our opposition on this. Be creative and listen to previous callers and change your talking points a little bit so as to not appear to be spamming these shows.

Time for some Guerilla tactics on this. If they use cunning to screw us over, we can use the same too.
