Natural or Constitutional Rights? 10th Amendment Violation?

Tomorrow on LibertyPulse Radio, Jack Hunter, a.k.a. "The Southern Avenger" and myself will debate whether the Supreme Court overturning the Chicago Gun ban would be a violation of the 10th Amendment.

The Constitution doesn't "grant rights".

The Constitution instructs the gov't to protect the people's natural rights, with some specific rights particularly enumerated.

It was not unusual....

It was not unusual for people to own cannons at their homes up until and after the Civil War. Was never an issue.

10th Amendment

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

The federal government enforcing the Bill of Rights in no way interferes with the Bill of Rights.

Constitutionally, the States have no power to interfere with individuals right to keep and bear arms and the Federal govt has a duty to protect that right for individuals.

This is true post-14th Ammendment, but was not true prior.

The 2nd Amendment...

The 2nd amendment doesn't need the 14th amendment to grant the Federal govt the duty to enforce it. And neither do 3-10.

And neither the 1st amendment. The "Congress shall make no law" doesn't mean the States have a right to deny people freedom of religion or speech or the press.

Those ammendments were

Those ammendments were written to restrain the Federal government only. Some states had official religions after ratification. The 14th Ammendment applied the Bill of Rights to the states(for the better, I think).
