Can the State Take Blood from a Newborn Baby?
Submitted by Tdogg8008 on Mon, 03/15/2010 - 11:44
Is the state allowed to mandate that the hospitals take blood from your new born baby? This is the case with my wife and I. Our baby is due in late June, and the OB told her it is state law they draw blood on the baby. The doctor said they had to follow this mandate since they are receiving state funds. Any comments would be greatly appreciated.

What state?
Check your state's requirements and laws using this map:
http://genes-r-us.uthscsa.edu/resources/consumer/statemap.htm
Then find the appropriate state opt-out forms, or make your own if your state does not have one. http://www.vaclib.org/ has some info on this, as well as vaccinations. Just search for your state.
A common wording of the parents' refusal to the PKU test is something like, "No PKU test will be administered in the hospital because the baby must nurse for at least two days before this is done. It will be my responsibility to see that the test is performed by a pediatrician at a later time. "
And, of course, if your newborn is not at risk of the few genetic diseases/syndromes this "heel stick" test screens for... you will obviously not subject your baby to that.
Yes, you can change to a midwife, but if Mom chooses to have a hospital birth... have the baby "room in" with her, and NEVER leave the baby with the nurses, or let them take the baby away for any reason unless you are able to go with them and stop them if they try to "heel stick" the baby. There are reasons why the baby might need to be looked at (jaundice, poss. strep B infection, any # of reasons- but don't let them take the baby away for one reason, and then perform this test and tell you later "oops, we forgot you didn't want that!" They do this all the time!)
I had one baby in MA, one in NH and both hospitals gave me the "it's state-mandated" crap. But my babies NEVER left my sight (or my husband's or my mom's) and so they never had the chance to give them this heel stick (or a pacifier or formula). :)
I signed out against medical advice for both births within a 48 hour period (they were both C-sections, but I was doing fine, up & about, had no issue of pulmonary thrombosis, etc... and just wanted to go home & get baby away from their needles and formula.)
If they are harassing you, stall them. The PKU test should not be performed before 48 hours, as the newborn needs to ingest the natural phenylK contained in breastmilk (or added in formula) before their blood is tested. Hopefully, Mom will be well enough to leave before 48 hours, and you can both take your baby & go.

This PDF file is from 1982, and will be an eye-opener to any parent-to-be. This is essentially WHY and HOW mandatory PKU screening came to be: http://ajph.aphapublications.org/cgi/reprint/72/12/1401.pdf

Good luck, and Congratulations!

Bullies can do whatever they feel they can get away with. Stand up to them. On the other hand hospitals and doctors kill hundreds of thousands of people every year. Why would you submit your family to that role of dice?

This is what I would do if I were you: I would NOT have a birth in the hospital.
1. Have a homebirth. Look for midwives now. Don't wait!
http://morningstarmidwifery.com - this is where I live. I don't know where you are. There is www.midwife.org ALTHO these are only 'nurse midwives'.
Each state has different qualifications, laws etc.
Do a search for midwives in your state and closest to you and call them up.
2. Do NOT file a Birth Certificate.
3. Do NOT get a taxpayer id# (SSN)
2. & 3. Are of course a personal choice. And if you decide to do either they can
both be done later.
The homebirth is too, of course, but for me it would not even be an option.
I forgot - Vaccinations. That would be a big issue.
Please keep in mind. In a hospital you will be told that these things MUST be done. That's not true. But it would be a fight for you and your wife.
They could even threaten you. I don't know. My boys are between 25 and 30 so it was a while ago. But - that's my point. Nowadays the feds and the state think they own you and your baby.
I truly hope this is what you decide to do. Don't let your OB talk you out of it.
Both of my sons were homebirths and it was fine.
It's the most natural thing in the world.

Just say no! Tell them to
Just say no! Tell them to provide the law requiring it. Do not fill out a birth certificate just record it in your family bible or journal. Stand firm tell them you do not wish to contract your child to the state, they are making your child a surety for the national debt, that is what you are doing. Better to have at home if you can.
Most people give in to thier pressure. There is no law requiring a birth certificate don't let them tell you there is. I doubt there is a law you must give the childs blood either if there is it is only required of United States corporate citizens and if the child does not have a Birth Certificate then they are not US Citizens but free Americans. If they threaten not to let you take the baby home tell them they will be arrested for kidnapping and sued for millions of dollars. Stand your ground!
Don't sign your child over in to fiat debt slavery keep him/her a free American!
If Americans don't start standing thier ground on this and getting educated then it's over for all of us!

Additionally, aren't there a ton of vaccinations
"required"? Probably for U.S. citizens or XIVth state citizens.
Best thing you can do is not get a social security card. Maybe print up, notarize, and have the doc sign a birth certificate of your own making. Stay out of the system. Insist the child be your sole responsibility until s/he can deem him/herself fit.

Been going on for years...the purpose for the program is trully disturbing.
Texas just passed a law requiring parental consent before blood can be taken and given to the Defense Department and others.
You should contact your state legislator.
They have been doing that for
They have been doing that for 37 years now. The answer is to home-birth.
Yup...
AJ was talking about it yesterday.

It's your child.
I'd say get a restraining order issued by a court, and let the feds fight for their intrusion in court.
I'll bet you win.
Thanks for your comment,
Thanks for your comment, BigT, but it seems easier said than done. Who would the restraining order be against, the hospital?
