Strange news from the IRS about my 2009 tax return

0 votes

The IRS adjusted my return and ADDED $327. :D

I'm 100% sure I didn't make a mistake. Is there some stimulus program for 2009?

So who has the fortitude to send it back?

I would.Or I would write it off as a campaign contribution.

Mine didn't seem as high

Mine didn't seem as high either. I expected to owe several hundred dollars, but I'm only owing a few hundred. Not sure why. Maybe it's my bailout program

exactly

This is exactly what happened to me, too. But I haven't received the letter explaining it. My return check was $400 higher than expected from my filing.

You'd think I'd be happy, but I'd be happier if they just left me alone.

REJECTED

Our tax return was rejected 2 times....We found out why..That so called stimulas we got last year..We are being made to pay it back..Every penny of it...Its not like my husband made/makes a lot of money..He spent a good deal of time unemployed..(and STILL cant find work) so we lived on under 25,000.00 before taxes!
Living on less now....

I believe in Hope & Change..I Hope the government will Change

Same thing happened to me

I received a $400.00 credit above what I had computed also. The letter from the IRS stated it was from the "Making Work Pay" section. From what I have learned so far, it is a stimulus of sorts for 2009 and 2010 for all employed workers under a specific salary level. Some employers added it in your regular paycheck...but if not, it comes as a lump sum when you file your taxes.
$400 single and $800 married.
I'm still checking it out also...don't want to take something I don't qualify for and then have to repay..sheesh.

Turbo Tax - HR Block TaxCut Detail

This Year TaxCut and TurboTax knew about this and stuck it in similar to the child tax credit. So a lot of people did this in thier taxes but missed it because it was very automatic within the programs.

I think it was AGI or income based. If you made over a certian amount from W-2 then you got it.

"A voluntary acceptance of

"A voluntary acceptance of the benefit of a transaction is equivalent to a consent to all the obligations arising from it, so far as the facts are known, or ought to be known, to the person accepting."

Elaborate...

please

this is a piece of California

this is a piece of California code,
http://law.onecle.com/california/civil/1589.html

This should give you an idea of how government thinks.
Your acceptance of a "tax credit", "free healthcare", "tax deduction" etc. will be deemed acceptance of the obligations that come with it.
The old saying "you cant get something for nothing" stands true.

That is...

California contract law.

Basically it is saying if you receive the benefit of something you are obligated to pay for it.

Pretty standard contract law...

true, the IRS deals in

true, the IRS deals in Contracts. My only point was that the govt. LOVES getting us to voluntarily consent to adhesion contracts any chance they get...heres a few examples:

see:
CVC 17459

The acceptance by a resident of this state of a certificate

of ownership or a certificate of registration of any motor vehicle or

any renewal thereof, issued under the provisions of this code, shall constitute the consent by the person that service of summons may be

made upon him within or without this state, whether or not he is then

a resident of this state, in any action brought in the courts of

this state upon a cause of action arising in this state out of the

ownership or operation of the vehicle.

see:
Sales Tax
"Although you are required to pay sales tax directly to the Board of
Equalization, the law provides that you may be reimbursed for those
taxes by your customers. It is presumed that the customer agrees to
the addition of tax if:"

see:
Cal Civil Code 1589

A voluntary acceptance of the benefit of a transaction is equivalent to a consent to all the
obligations arising from it, so far as the facts are known, or ought to be known, to the person accepting.

CVC 17460

The acceptance or retention by a resident of this state of a

driver's license issued pursuant to the provisions of this code,

shall constitute the consent of the person that service of summons

may be made upon him within or without this state, whether or not he

is then a resident of this state, in any action brought in the courts

of this state upon a cause of action arising in this state out of

his operation of a motor vehicle anywhere within this state.

see USC Title 18 4107
"(4) his consent to transfer, once verified by the verifying officer, is irrevocable."

see:
Federal Rule of Procedure Rule 8(b)(6)
(6) Effect of Failing to Deny.
An allegation — other than one relating to the amount of damages — is admitted if a responsive pleading is required and the allegation is not denied. If a
responsive pleading is not required, an allegation is considered denied or avoided.

Consent is suppose to be something that you knowingly and willfully make, not something hidden in a 40,000 page law...
Just remember, that by accepting a tax refund, you are surely consenting to something, if nothing else, that you are a "Taxpayer" as defined in USC Title 26.

Actually

there is a tax credit that you may have qualified for. it was supposed to be given to you in your paycheck but it didnt happen for everyone. Here it is:

Hmm....

Never heard of the Making Work Pay and Economic Recovery Pay tax credits before.

They supposedly will be in force for 2010 tax returns also.

Thanks for the info.. checking it out :)

h, i did my 1040 and saw

i did my 1040 and saw nothing of the 'Making work pay' thingy. But, then I did my girlfriends 1040 EZ and it was on there SCHEDULE M, so I am going to apply it to my 1040.

For three years ....

I computed 1040 vs 1040EZ for a few people and the EZ always returned less money. The regular 1040 isn't much more difficult than the EZ so I tell people to not do EZ.

Probably has to do

With a child tax credit or a child care credit that is not incorporated ion the 1040..Some type of credit that is not on the 1040ez..
