Need quick advice! Court Date in 3 hours!
I know I put things off a bit. I actually forgot it was today.
Alright here is what happened. I wrecked my car into a neighbors mailbox (already fixed his box and paid and not bad damage) my car couldn't drive though and was smushed up (im a bad driver, and I admit it...but this wasnt even about driving!)Someone drove by and helped me 0ut and I turned on the hazards so I could go about 100 ft to my house and see what to do. I couldnt move the thing! but it was on the side and not holding up any traffic at all.
Truth I fell aslep at the wheel, but they don't know that. and that proves I wasnt speeding anyways! What can I say to them?
Now I have a speeding ticket for 300$ (they just sent it to my house because they knew where I lived because they did a search I guess on my car that day and located my address and came by 3 times. creepy I thought. I didnt talk to them. (I know thats weird but they were really scary looking and banged so hard on the door. I just didn't want to talk to em, I was rattled after the acident too AND sleepy!
So they gave me speeding ticket and yet they were no where around at the time, they just guessed I was due to the damage (I wasn't speeding) then gave me a ticket for expiration of whatever (ill ay the 33dollars there) and then a final ticket for "abandoning a vehice" I had hazards on and I was three doors away from it
Is it legal. the speeding one is the most costly and one I care about. Court date in texas at 1pm. Going with my dad. He took pics of mailbox Sory I m typing fast and this may be the dumbest question ever, but you guys are great at this stuff.

You have a right not to incriminate yourself. Make them prove everything.
Bring photos of the repaired mailbox and your receipts, if any, to show that you were responsible. Print a copy of your house and the mailbox on MapQuest or Google, to show why you went to the house to use the phone.

I am not a lawyer but anytime you go to court the burden of proof is on the police officer. You plead not guilty to speeding and they have to prove you were speeding. Obviously there is no evidence, radar, testimony or anything else.
If they ask why you crashed say you temporarily lost control of the car or something.
As far as the abandonment issue is concerned, based on what you said, they probably have you. You didn't answer the door when they knocked they assume you weren't there. You have to prove you were. Unless you have evidence you were there you should just pay it but don't pay the speeding!!

Remember they have to prove guilt
you do not have to prove innocence. Does the officer have video, pictures of the offenses? Does the officers have a record what is showing on Radar? Could the officer made a mistake?
A radar beam widens out the farther it gets from the unit, was there other traffic it could have picked up? what was the officer doing when he witnessed the offense.
A criminal offense must have a victim. Who was the injured party? Did the injured party file a complaint. Was there damage to the injured party? The state can not be the victim. the officer is only a witness.

but I would pay it and then go get some sleep.
