"State" means the District of Columbia

This is THE trick!!

When congress makes a law that applies to the "States" you ought to know what "States" means.

Read section 104:
http://books.google.com/books?id=9UQFAAAAYAAJ&lpg=PA166&ots=...

The reason I point this out:
Congress use to be a little more honest, and wasn't trying to trick us so much, so they defined "State" as:

";and the word "State" to mean and include a Territory, and District of Columbia"

http://books.google.com/books?id=9UQFAAAAYAAJ&lpg=PA166&ots=...

NOW, they make it a little trickier:
http://www.law.cornell.edu/uscode/uscode26/usc_sec_26_000077...

    "(10) State
The term “State” shall be construed to include the District of Columbia, where such construction is necessary to carry out provisions of this title. "

since they have dropped the "means" and left the "includes" people are assuming that "includes" means "also"...the intent of the Revenue act, and the reach of the Federal Government, has remained the same. "here such construction is necessary to carry out provisions of this title." should be telling however, because ONLY the District of Columbia can have a "Direct Tax", whereas the states of the union cannot, unless apportioned.
see Article One, section 2

"Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. "

well, we know D.C. doesnt have representation, so why would they need a direct tax apportioned??

Title 26, 7701 knows this, and with more words of art they write:

    (c) Includes and including
The terms “includes” and “including” when used in a definition contained in this title shall not be deemed to exclude other things otherwise within the meaning of the term defined.

well, since we now know the meaning of the word "State" defined, as a Federal Enclave, then the word "State" shall not be deemed to exclude, Puerto Rico, Guam, American Samoa, the Virgin Islands, and any other Federal Territory or Enclave.

Any disputes?

This is from the Alaska Omnibus Act, after Alaska had just become a state of the union....

“Sec. 22. [Internal Revenue.] (a) Section 2202 of the Internal Revenue Code of 1986 (relating to missionaries in foreign service), and sections 3121(e)(1), 3306(j), 4221(d)(4), and 4233(b) of such Code (each relating to a special definition of ‘State’) are amended by striking out ‘Alaska,’.
“(b) Section 4262(c)(1) of the Internal Revenue Code of 1986 (definition of ‘continental United States’) is amended to read as follows:
“ ‘(1) Continental United States.—The term “continental United States” means the District of Columbia and the States other than Alaska.’
“(c) Section 4502(5) of the Internal Revenue Code of 1986 (relating to definition of ‘United States’) is amended by striking out ‘the Territories of Hawaii and Alaska’ and by inserting in lieu thereof ‘the Territory of Hawaii’.

“Sec. 5. [Soil Bank Act; amendment.] Section 113 of the Soil Bank Act (7 U.S.C., supp. V, sec. 1837), is amended to read as follows: ‘This subtitle B shall apply to the continental United States, except Alaska, and, if the Secretary determines it to be in the national interest, to the State of Alaska, the Territory of Hawaii, the Commonwealth of Puerto Rico, and the Virgin Islands, and as used in this subtitle B, the term “State” includes Hawaii, Puerto Rico, and the Virgin Islands.’

So the continental "United States" in this section really means "Continental Federal Zones", which is why Alaska is specifically excluded after its entering statehood. And now the term "State" that use to say “State” includes Alaska, Hawaii, Puerto Rico, and the Virgin Islands.’ is now amended to exclude the state of Alaska.

also see:

“(4) Paragraph (8) of section 9 of such Act (20 U.S.C., supp. V, sec. 244 (8)), relating to definition of State, is amended by striking out ‘Alaska,’.

“Sec. 24. [Vocational Rehabilitation Act; amendment.] (a) Subsection (g) of section 11 of the Vocational Rehabilitation Act (29 U.S.C., supp. V, sec. 41 (g)), relating to definition of State, is amended by striking out ‘Alaska,’.

“(2) Subsection (d) of such section, relating to definition of State, is amended by striking out ‘Alaska,’.

“(2) Subsections (h) and (i) of section 210 of such Act (42 U.S.C. 410 (h), (i)), relating to definitions of State and United States for purposes of old-age, survivors, and disability insurance, are each amended by striking out ‘Alaska,’.

“(d)(1) Paragraph (1) of section 1101(a) of the Social Security Act (42 U.S.C., supp. V, sec. 1301 (a)(1)), relating to definition of State, is amended by striking out ‘Alaska, Hawaii,’ and inserting in lieu thereof ‘Hawaii’.

“(2) Paragraph (2) of such section (42 U.S.C., 1301 (a)(2)), relating to definition of United States, is amended by striking out ‘Alaska,’.

“(c) Section 1(b) of that Act is amended by striking the period at the end of paragraph (3), inserting in lieu thereof a semicolon, and adding the following paragraph:

“(4) Paragraph (8) of section 9 of such Act (20 U.S.C., supp. V, sec. 244 (8)), relating to definition of State, is amended by striking out ‘Alaska,’.

SIDE NOTE: importance of punctuation:
“(c) Section 1(b) of that Act is amended by striking the period at the end of paragraph (3), inserting in lieu thereof a semicolon, and adding the following paragraph:

important information and discussion. Wish my brain could absorb and understand this all better. There is just so much to learn and understand and then cope with it. I can and I will though, it will just take some time.

Incompetence

Incompetence is more common than we give it credit.

I'm a legal assistant, and I've read my city's ordinances, and I see lots of really bad drafting.

My City actually proposed banning personal property "visible from the public right of way." I asked if they meant for the homeowner to streak naked from his car at the curb (personal property banned on the driveway) to the front door (clothing is personal property). Not to mention garden hoses, window curtains, mail, groceries, potted plants, etc.

Where the bad drafting came in, is they revised an ordinance from last mid-century that said personal property that is unsightly, old, acccumulated (and many other words describing everything) "and substantially" (meaning "really") reduces the whole neighborhood's property values, by changing "and" to "or."

Obviously, a complete ban or even partial ban on personal property visible from the PROW would also reduce property values.

If we interpret the Constitution according to its original meaning based on the Federalist Papers, etc., then, unfortunately, we may find that the meaning of "State" is a moving target.

What do you think? http://consequeries.com/

Ill bet there is a "Savings

Ill bet there is a "Savings Clause" somewhere in that city ordinance...such as "no rights are affected by the provisions of this code"

When the city told me to take down my Ron Paul signs I pointed out that section, they left me alone!

I find it interesting that "NC" has statutes that pertain to

United States land. http://www.ncleg.net/gascripts/Statutes/StatutesTOC.pl?Chapt...

If "United States" has automatic jurisdiction over the whole geographical area of the United States then why have these statues...?..

Do you live in California? I am moving out to the Sebastopol area come June, and would love to pick your brain a bit. I would of course be willing to pay you for your time, it seems you know a lot about the laws, and I would like to absorb some of your information. Thanks.

The R3volution requires action, not observation!!!!

Don't move to California!

You will just have to turn around and go back."Trust Me"
I was just on the phone with one of my service contracts through Bridgestone,Penske rentals, the dispatcher said she could not get enough trucks back to Ca. to fill the demand of the people moving out,She estimated about 40,000 a month on their way out.

If I disappear from a discussion please forgive me. My 24-7 business requires me to split mid-sentence to serve them. I am not ducking out, I will be back later to catch up.

I would never charge anyone

I would never charge anyone anything for helping them to be free.

Sharing information about freedom is the same as if I extended a stick to pull you free of quicksand, it is my duty, and everyone's duty, to share with their brothers and sisters on this land, whatever they know that may help in anyway...

I am a "transient foreigner"...I am often in California, Arizona, Texas, etc. ;)

As far as picking my brain, I have found no better place for info than www.sedm.org and www.famguardian.org
for example

or

Thank you - all three of you!

One of these days all your words will be known and understood by all, and I pray this time occurs sooner rather than later.

Again, my thanks. In Liberty.

Yes yes, and I'm willing to hazard a guess that the recent

Health bill passed by Congress is similarly limited in scope to only the Federal Zone.

But it really doesn't matter when even Ron Paul doesn't make the argument and instead says "of course it applies everywhere" and the "best we can hope for is repeal."

We're screwed and there is no way out of this.

Most people simply refuse to understand these word games Congress plays.

I've tried to explain this very simple smoke and mirror trick and every time "I" am the one they accuse of "playing semantics" and not Congress. Go figure.

I know what you're saying,

I know what you're saying, but I have my "Closing Notices" just like this one: http://www.losthorizons.com/EveryWhichWayButLoose/Chris%20Or... from the IRS, and a 2" stack of Certified Mail receipts from affidavits that were never rebutted.

I have no license plate or drivers license, and I travel almost 1000 miles a week in my full size Dodge. I have a blank white plate with stickers that say "NOT FOR HIRE", and the VIN is always covered. I have a notarized secured party declaration like this: http://www.thecountyguard.org/right-2-drive-handout.html
I added a picture to mine for I.D. reasons.

I dont pay property tax anymore, http://www.thecountyguard.org/property-taxes-web.html

I dont get building permits. I just had PG&E (electric co.) tell me I needed a permit to hook up electric. I told them I refused to get permits, and for them to provide me which section of code required me to have a permit. Their legal department contacted me and said; "generally people have permits before we hook up electric service, but I read your letter and I cannot provide any law requiring you to have permits for Electric. But you will need to hire a private inspector for the electric service."

I had Comcast tell me that a Social Security number was mandatory for Cable...I talked to legal dept. They said a Social Security number is preferred, but a $100 deposit will also be acceptable.

I have had SEVERAL conversations with Social Security, and everytime they begrudgingly admit that Social Security is NOT mandatory.

This is why I question EVERYTHING, and I dont cave in without a true law to back up their statements.
