"State" means the District of Columbia

This is THE trick!!

When congress makes a law that applies to the "States" you ought to know what "States" means.

Read section 104:

The reason I point this out:
Congress use to be a little more honest, and wasn't trying to trick us so much, so they defined "State" as:

    ";and the word "State" to mean and include a Territory, and District of Columbia"


NOW, they make it a little trickier:

    "(10) State
    The term “State” shall be construed to include the District of Columbia, where such construction is necessary to carry out provisions of this title. "

since they have dropped the "means" and left the "includes" people are assuming that "includes" means "also"...the intent of the Revenue act, and the reach of the Federal Government, has remained the same. "here such construction is necessary to carry out provisions of this title." should be telling however, because ONLY the District of Columbia can have a "Direct Tax", whereas the states of the union cannot, unless apportioned.

    "Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. "

well, we know D.C. doesnt have representation, so why would they need a direct tax apportioned??

Title 26, 7701 knows this, and with more words of art they write:

    (c) Includes and including
    The terms “includes” and “including” when used in a definition contained in this title shall not be deemed to exclude other things otherwise within the meaning of the term defined.

well, since we now know the meaning of the word "State" defined, as a Federal Enclave, then the word "State" shall not be deemed to exclude, Puerto Rico, Guam, American Samoa, the Virgin Islands, and any other Federal Territory or Enclave.

This is from the Alaska Omnibus Act, after Alaska had just become a state of the union....

“Sec. 22. [Internal Revenue.] (a) Section 2202 of the Internal Revenue Code of 1986 (relating to missionaries in foreign service), and sections 3121(e)(1), 3306(j), 4221(d)(4), and 4233(b) of such Code (each relating to a special definition of ‘State’) are amended by striking out ‘Alaska,’.
“(b) Section 4262(c)(1) of the Internal Revenue Code of 1986 (definition of ‘continental United States’) is amended to read as follows:
“ ‘(1) Continental United States.—The term “continental United States” means the District of Columbia and the States other than Alaska.’
“(c) Section 4502(5) of the Internal Revenue Code of 1986 (relating to definition of ‘United States’) is amended by striking out ‘the Territories of Hawaii and Alaska’ and by inserting in lieu thereof ‘the Territory of Hawaii’.

“Sec. 5. [Soil Bank Act; amendment.] Section 113 of the Soil Bank Act (7 U.S.C., supp. V, sec. 1837), is amended to read as follows: ‘This subtitle B shall apply to the continental United States, except Alaska, and, if the Secretary determines it to be in the national interest, to the State of Alaska, the Territory of Hawaii, the Commonwealth of Puerto Rico, and the Virgin Islands, and as used in this subtitle B, the term “State” includes Hawaii, Puerto Rico, and the Virgin Islands.’

So the continental "United States" in this section really means "Continental Federal Zones", which is why Alaska is specifically excluded after its entering statehood. And now the term "State" that use to say “State” includes Alaska, Hawaii, Puerto Rico, and the Virgin Islands.’ is now amended to exclude the state of Alaska.

I'm a legal assistant, and I've read my city's ordinances, and I see lots of really bad drafting.

My City actually proposed banning personal property "visible from the public right of way." I asked if they meant for the homeowner to streak naked from his car at the curb (personal property banned on the driveway) to the front door (clothing is personal property). Not to mention garden hoses, window curtains, mail, groceries, potted plants, etc.

Where the bad drafting came in, is they revised an ordinance from last mid-century that said personal property that is unsightly, old, acccumulated (and many other words describing everything) "and substantially" (meaning "really") reduces the whole neighborhood's property values, by changing "and" to "or."

Obviously, a complete ban or even partial ban on personal property visible from the PROW would also reduce property values.

If we interpret the Constitution according to its original meaning based on the Federalist Papers, etc., then, unfortunately, we may find that the meaning of "State" is a moving target.

Health bill passed by Congress is similarly limited in scope to only the Federal Zone.

But it really doesn't matter when even Ron Paul doesn't make the argument and instead says "of course it applies everywhere" and the "best we can hope for is repeal."

We're screwed and there is no way out of this.

Most people simply refuse to understand these word games Congress plays.

I dont get building permits. I just had PG&E (electric co.) tell me I needed a permit to hook up electric. I told them I refused to get permits, and for them to provide me which section of code required me to have a permit. Their legal department contacted me and said; "generally people have permits before we hook up electric service, but I read your letter and I cannot provide any law requiring you to have permits for Electric. But you will need to hire a private inspector for the electric service."

I had Comcast tell me that a Social Security number was mandatory for Cable...I talked to legal dept. They said a Social Security number is preferred, but a $100 deposit will also be acceptable.

I have had SEVERAL conversations with Social Security, and everytime they begrudgingly admit that Social Security is NOT mandatory.

This is why I question EVERYTHING, and I dont cave in without a true law to back up their statements.
