I realize this if off topic but...
I've been reading this blog for a few years and the is the first time I'm posting. Let me say that I am completely in favor of freedom and I want the Federal govt to do less than what is authorized in the constitution, and also that a state govt like what Debra Medina proposed would be grand as well. My question is the following: 5th Amendment "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger;" I'm referring to the 'OR PUBLIC DANGER' phrase. Doesn't that make it sound like it's legal to suspend habeas corpus and other rights during times of public danger (whether that "public danger" is real or fabricated what have you). I'm definitely not in favor of the 'enemy combatant' rules and that the govt can lock up anyone for any reason. I'm just looking for clarification on this point. Any and all information would be great... thanks in advance! Feel free to email me if you'd like.
