A rookie mistake feeds a left-wing smear.

Rand Paul was 1 when Congress enacted the Civil Rights Act of 1964. Now 47, he is the Republican nominee for U.S. Senate from Kentucky, his first ever foray into politics. To his evident surprise, the hypothetical question of how he would have voted in 1964 has been drawing a lot of attention.
Politico's Ben Smith characterizes as "evasive" this response Paul gave when asked the question by National Public Radio (we've corrected Smith's transcription errors):
"What I've always said is, I'm opposed to institutional racism, and I would have--if I was alive at the time, I think--had the courage to march with Martin Luther King to overturn institutional racism, and I see no place in our society for institutional racism," he said in response to a first question about the act.
"You would have marched with Martin Luther King but voted with Barry Goldwater?" asked an interviewer.
"I think it's confusing in a lot of cases in what's actually in the Civil Rights Case (sic)," Paul replied. "A lot of things that were actually in the bill I'm actually in favor of. I'm in favor of--everything with regards to ending institutional racism. So I think there's a lot to be desired in the Civil Rights--and indeed the truth is, I haven't read all through it, because it was passed 40 years ago and hadn't been a real pressing issue on the campaign on whether I'm going to vote for the Civil Rights Act."

I have a theory as to why
I have a theory as to why Rand is gaining such favorable treatment. All of these pundits, and writers, or any average citizens have recognized the truth and wisdom in Ron Paul's ideas. These same people made fools of themselves in their criticisms of Ron Paul not so long ago. In the interest of saving face and not admitting how blind they were in the past, they will not support Ron. Rand is as close as you can get to Ron, and they are eager to support the truth.

This response and others, to the ugly
smear campaign show that many people have heard the libertarian message and have understood at least some of the philosophical principles and find value in them.
And a minority of writers and communicators have taken upon themselves to articulate and even defend those ideas, and not just run with the herd in its race-baiting hysteria.

The wall street journal is a worthless piece of toilet paper.
We did find one use for it: We use them on the 4'th as a tamper for the cannon. The front section of the WSJ and 4oz of powder make quite a racket.
I'm glad Paul is not the
I'm glad Paul is not the consummate politician that his detractors are. His answer is a two tiered answer which is NOT AN EVASION. He was very clear about his defining difference between institutional and publicly funded civil rights as opposed to the individual rights of private property owners. What is it the critics don't get in their socialist thinking when they hear or read a real republican's views on the constitution and the abuse of individuals' rights.

When
Trey Grayson smeared Rand Paul, Paul always came fighting back and turned it into a positive.
I think he has his hands full here but he can do it. We just need time and a little more support. More and more people will catch on to the fact that Rand isn't a racist and wouldnt repeal the CRA.
Civil Rights Act of 1964
The authority for the Civil Rights Act of 1964 was the power designated to Congress to "regulate commerce among the several states". If that was not a legitimates use of Congressional power in 1964 why should it not be repealed? It it was a legitimate us of Congressional power then what Constitutional limits are there on such power?

I don't see that above statement implying what you (below) might be concerned about. That would be drawing a pretty assumptive conclusion without knowing the intent of those words. Reminds me of what my ex wife did much of the time.
