It is apparent this article's author has no clue as to the proper meaning of "natural born Citizen."

There are TWO and ONLY TWO ways you can be a Citizen.

#1 - by virtue of your birth - aka Natural Born Citizens: you are born in one of the States of the Union to two parents who are also Citizens. (note, your parents do not have to be "natural born" also but they must be citizens) This is written in the Law of Nations which was adhered to as understood law at the time the Constitution was written. Birthright citizenship is rooted in geography and parentage.

#2 - by an Act of Congress - aka Naturalized Citizens: you don't meet the conditions of #1 and Congress has passed a law saying that if you otherwise meet certain other conditions and APPLY for citizenship, yourself or for your child, that citizenship will then be conferred upon you. You may meet some of the conditions of #1 and so Congress has opted to not hold you back from being a citizen entirely so parents can APPLY for naturalized citizenship for their children shortly after birth.

John McCain is NOT a Natural Born Citizen. He WAS born to two citizens parents, but he was NOT born in one of the States of the Union. He was born in a private hospital in Panama. No amount of Congressional laws, or resolutions can MAKE him what he is not. The only power Congress has in this regard is to affect laws of NATURALIZATION - thus the resolution declaring McCain "natural born" is by definition, merely an act of naturalization. (#2)

Any discussion of the hospital in Panama, or Panama itself being part of US held territory is IRRELEVANT. The requirement is that he be born in one of the several States, and Panama was clearly NOT (and still isn't) a State of the United States of America. There is even question as to if McCain EVER was naturalized. He may not even be eligible to serve in the Senate. (at least until Congress passed that resolution) Any discussion of "military bases" (which he was NOT born on) is also IRRELEVANT, because #1 - the military itself is clear that such a birth requires naturalization and that #2 - the law on naturalization does NOT includes any territory held by the US but only military and consular installations. (this hospital was on neither) Even if McCain's birth hospital was on a military or consular installation, or even if territories were considered properly part of the US, he STILL would not be a #1 Natural Born Citizen, because his citizenship would be by virtue of an Act of Congress defining such places as acceptable, and NOT by fact of his birth according to the Law of Nations.

The Congress CANNOT define any word in the Constitution as it sees fit in any law. Without an amendment ratified by 3/4ths of the States, each word in the Constitution can ONLY and FOREVER mean what it meant to the people who passed it at the time. (the same goes for admendments) And at the time the Constitution was ratified, the laws on Natural Born Citizenship were understood to be what they are in the Law of Nations.

Any Act of Congress which seeks to confer citizenship, even without application, is under their power to "establish an uniform rule of naturalization" and thus means anyone so obtaining their citizenship is by LAW "naturalized" and not "natural born." (there is also the question that since this resolution applied only to John McCain it does not constitute "an uniform rule" and so would not pass Constitutional muster. It is as invalid an ineffective as if it were never passed. Since Congress also can't pass ex post facto laws, they could not pass a law making McCain a citizen AFTER the fact of his birth, though they could pass a law granting anyone who met his birth conditions to receive an automatic approval upon application for naturalization.)

The only way to change the definition of "natural born" is via a Constitutional amendment.

McCain was NOT, and is NOT eligible to the office either, and I really wish people would get that through their thick skulls.

It also shows that this author is partisan, because he can't accept that McCain cannot have been "declared" a Natural Born Citizen by Congress.
