WASHINGTON - Her confirmation all but assured, Supreme Court nominee Elena Kagan neared the end of a final grueling day of Senate questioning Wednesday, fielding GOP challenges on abortion, gays in the military and other divisive issues while sidestepping Democrats' invitations to blast conservative decisions by the court she's hoping to join.

Kagan, prompted by Democratic supporters on the Senate Judiciary Committee, gave a blunt denunciation of "results-oriented judging," the adjusting of judicial reasoning to fit a preconceived conclusion, but she refused to join them in applying the criticism to the current court under Chief Justice John Roberts. "I'm sure that everybody up there is acting in good faith," she said.

"Solicitor General Kagan will be confirmed," Sen. Patrick Leahy, D-Vt., the panel chairman, confidently declared during a break in the hearings.

Republicans, despairing of their inability to get President Barack Obama's nominee to reveal her legal views or say anything that might threaten her confirmation, acknowledged as much.

"I assume she will be," said Sen. John Cornyn, R-Texas.

Barring an unexpected turn, Kagan will succeed retiring Justice John Paul Stevens and become the fourth woman in the Supreme Court's history. It would be the first time that three of the court's nine justices were women.

Kagan: "prohibiting speech on its content"

Ms. Kagan seems to believe that under certain circumstances, speech may be restricted. She believes that the Supreme Court should focus on whether a speaker’s message is harming the public.

Have any of the Republicans on the Senate Judiciary Committee even bothered to question her about the relationship of government limiting free speech and the 1st Amendment?

At a 2007 graduation ceremony for Harvard Law School graduates, she sharply criticized key members of the Bush White House over the administration's secret wiretapping program. Signaling out former Attorney General Alberto Gonzales and ex-chief of staff Andy Card by name, Kagan blasted the program to secretly eavesdrop on phone conversations involving terror suspects.

"This is a story, to put it bluntly, of some lawyers who failed to respect the rule of law and of others ... who stood up for and vindicated it," Kagan said, praising former Justice Department official Jack Goldsmith who opposed portions of the wiretapping program.

All she cared about was who was being wiretapped.
She'd have done the same thing as the Bushies in a heartbeat, and probably worse.

Yeah, Kagan is a real mixed bag

She believes the Federal government is right in restricting "harmful" speech, even if the govenment is wrong, as long as it acts in good faith.

Kagan endorses indefinite detention for 'enemy combatants' even if they are picked up nowhere near a battlefield, or even in another country.

She supposedly endorses expanded executive power.

Kagan doesn't fit into a nice neat "liberal" box. She seems to be a kind of liberal/neo-con mix.

The problem with her is there is very little information to go on. If she is confirmed, she will be the first S.C. judge in 38 years to not have had prior experience on any bench. Is that bad? Not necessarily. We just don't have much of a paper trail. Her academic writings are not extensive, though apparently she showed some depth in what she did write. Her time at Harvard was mostly administrative, not academic, so there isn't much there, either.

So who knows what we're getting. I suspect a rubber stamp for Obama.
