PHOENIX – A federal judge on Wednesday blocked the most controversial parts of Arizona's immigration law from taking effect, delivering a last-minute victory to opponents of the crackdown.
The overall law will still take effect Thursday, but without the provisions that angered opponents — including sections that required officers to check a person's immigration status while enforcing other laws.
The judge also put on hold parts of the law that required immigrants to carry their papers at all times, and made it illegal for undocumented workers to solicit employment in public places.
U.S. District Judge Susan Bolton ruled that the controversial sections should be put on hold until the courts resolve the issues.
The ruling came just as police were making last-minute preparations to begin enforcement of the law at 12:01 a.m. Thursday and protesters were planning a large demonstrations to speak out against the measure. At least one group planned to block access to federal offices, daring officers to ask them their immigration status.
The volume of the protests will be likely be turned down a few notches because of the ruling by Bolton, a Clinton appointee who suddenly became a crucial figure in the immigration debate when she was assigned the seven lawsuits filed against the Arizona law.
Lawyers for the state contend the law was a constitutionally sound attempt by Arizona — the busiest illegal gateway into the country — to assist federal immigration agents and lessen border woes such as the heavy costs for educating, jailing and providing health care for illegal immigrants.

PHOENIX — Arizona asked an appeals court Thursday to lift a judge's order blocking most of the state's immigration law as the city of Phoenix filled with protesters, including 50 who were arrested for confronting officers in riot gear.
Republican Gov. Jan Brewer called U.S. District Judge Susan Bolton's Wednesday's decision halting the law "a bump in the road," and the state appealed to the 9th U.S. Circuit Court of Appeals in San Francisco on Thursday.
Outside the state Capitol, hundreds of protesters began marching at dawn, gathering in front of the federal courthouse where Bolton issued her ruling on Wednesday. They marched on to the office of Maricopa County Sheriff Joe Arpaio, who has made a crackdown on illegal immigration one of his signature issues.
At least 32 demonstrators were arrested after blocking the entrance and beating on the large steel doors leading to the Maricopa County jail in downtown Phoenix. Sheriff's deputies in riot gear opened the doors and waded out into the crowd, hauling off those who didn't move.
Dozens of others were arrested throughout the day, trying to cross a police line, entering closed-off areas or sitting in the street and refusing to leave. Former state Sen. Alfredo Gutierrez, who ran unsuccessfully for governor in 2002, was among them.
Marchers chanted "Sheriff Joe, we are here, we will not live in fear," and in the crowd was a drummer wearing a papier-mache Sheriff Joe head and dressed in prison garb.
Arpaio vowed to go ahead with a crime sweep targeting illegal immigrants. Phoenix police made most the early arrests, but other protests were planned later in front of a county jail.

Hoping you won't read the decision for yourself and see that nothing has changed, the liberal media is plastering the airwaves with stories about how they won. In fact, in the notes the judge wrote that she only actually considers the part of the law that requires all officer to always check immigration so apparently law enforcement officers still have the option to do it if the want to, and circumstances indicate it would be prudent. But this law has ALWAYS been a political straw horse to distract the people from the real issues. Law enforcement has always had the ability to check the status of immigrants in the course of their normal duties. There are numerous federal criminal statutes that are regularly enforced by state LEOs.
In Old English Common Law, Libera Lex referred to the Law of Freemen. The Founders used Latin names to hide their identity. Alexander Hamilton, John Jay & James Madison used Publius on the Federalist Papers. In that spirit I created Libera Lex.
Fact!
Sheriff Joe has been using these laws for years.The laws are there already,with this decision I see even more use of them.In the end it may turn out that having 1070 pass as a whole,was better than the laws already on the books.It did include protections that are not in the current laws.Sometimes folks just don't look far enough ahead.

Sheriff Joe
has a lot of guts to actually stand up and uphold the laws. He recently said in an interview that he, and his officers will continue to enforce the federal laws which they have been doing for years. Nothing has really changed, which is fine by me. Illegal entrance in our country is against the law, I just don't understand why some here think it's okay for foreigners to enter our country without the proper documentation. Unfortunately, our country is being torn apart bit by bit. What we need is to secure our borders, stop hiring illegals, no more free medical services, and we need to stop funding welfare to non-citizens.

Is it against the law...
to chain yourself to the jailhouse doors? Of course it is, and they deserve to be arrested for it. The sad thing is these people are making him deal with them, and not allowing him to go out, and catch the people committing murders, and molesting kids. Civil disobedience is all these protesters will be charged with, and that comes with a slap on the hand, along with a couple hundred dollar fine.

The elites, by allowing a porous border to exist, give to the poor by way of access to government benefits and protection, distracting the middle class from the true plunder being inflicted upon them via inflation, taxpayer bailouts, etc., occuring daily before our very eyes.

The judge is on firm ground regarding aspects of the law that allowed law enforcement to require proof of citizenship.
even if you disagree, the fact that there are checks and balances for this law, that even judge Napalatano questions, is good.

To some the will of the people is mob rule. Jefferson said it long ago the fundamental question has always been whether the people will govern themselves or be governed by a small elite.
The reality is the law and the Constitution means whatever the elite say they mean. They use them to force their will on the people. If they're going to rule they should at least have to stand for election.
This isn't the first or last time the elite will use the courts to deny the will of the people.
Napalatano and others labor under the illusion that the Constitution means what the literal words say.
The Constitution means what the courts say it means, nothing more nothing less. They can change the meaning to suit their purposes.
This discussion about how the judge was going to rule was always nonsense. She was always going to rule as she liked based on whatever(maybe her feelings).
Decisions in America are based on who has the power, who has the guns behind them.
The idea that decisions are based on a literal meaning of the Constitution or the rule of law is a fairy tale.
Come on, see the world for what it is. It's about who has the power and who doesn't. Who rules and who obeys.

but how can the people enforce the Constitution when the people don't know what it means?
You and I would disagree but the courts will tell us they're enforcing the Constitution. How can we say they're not when they decide its meaning?
There is no objective meaning of the Constitution apart from the federal courts. That's what the "Living Constitution" means.
We can demand the borders be secured until we're blue in the face, but nothing will happen if they ignore us.
It's no accident the border is porous. The elites from both political parties want it that way.
Only because Arizona forced the issue is this being discussed. In the past both parties largely ignored it because they were in agreement.
Obviously a Leadership Issue,
or lack thereof.
When speaking in unison Constitutionally, The People have more power than the Court.
Resistance leadership should be focusing the People on the Constitutional solution. Same as Bush, the current President is failing in his Constitutional duty, and we have to hammer that point until we are blue. When enough people do so, they WILL listen. But leadership among our ranks will have to make it happen. Otherwise, the "elites" will continue having their way by keeping us "dispersed". I think we all have to recognize we have been fragmented into "manageable" groups, and they just continue to go about their dirty work. Our common denominator is the Constitution. If we stand on that and demand the President secure our borders NOW, we may get somewhere. That's better than just saying there is nothing we can do...that will lead to either slavery or bullets, neither being a very pleasant alternative.
