Why does Arizona consider going to a Federal court at all?
If the State of Arizona believes in it's STATE RIGHT which superceeds the Federal government. Then why would ARIZONA show up in a Federal Court room ? The Federal government was NEVER been provided with the RIGHT or authority to take away the STATE's own border control ?
It is NOT an immigration issue, as there are foreigners invading . They are NOT immigrants "unless sanctioned" by the Federal government . What is an immigrant, PERIOD ? Legal or illegal ? You are not an immigrant unless you have a permit . Without a permit you are SIMPLY a criminal .
There is NO Federal jurisdiction attached to these foreigners, who are STATE invaders and crimainals . They have NO legal OR illegal "(immigration)" status .
DO NOT recognize FED. jurisdiction, they have non .

That means the federal gov't cannot make a claim for them ..They are invaders.

We cannot claim them as anything.They have never given a statement as to their intentions. The FEDs cannot simply say, they are illegal immigrants because the Mexicans never stated that immigration was their intention.

Another Factor: Debt

would step up and pass their own versions, regardless of the Arizona case, the DoJ would be so bogged down with casework and bad press that eventually everyone would have to concede that the federal gov't failed de facto on setting and enforcing immigration policy.

The state of AZ equates to Republicans.
The federal government equates to Obama.
When AZ says we want to buck federal law and kick out the Mexicans, they are being doubly racist.

With the just hours old injunction placed on the new Arizona SB1070 law, not even allowing it to go into effect or able to prove any injured parties involved, a few items are even more obvious in our shattered Republic.
1) The Constitution for the united states of America is all but gone.
2) The “Whitehouse” can covertly and overtly rule over any aspect of the country.
3) The Rule of Law is gone.
4) “Judge” Susan Bolton can seemingly only rule on emotion, not fact.

Now our federal government even claims the right to murder its own citizens. For many,Many years now in every state they have the right to detain you and arrest you for not having proof of identification of some sort.You can even get a written violation if your current address does not match your ID.It all depends on how the officer fills out the paper work.You must be a legal citizen of the county and the U.S. to fight it.So whats different?,Nothing,I see a whole bunch of creative paper work coming up.

First they must have reasonable suspicion that you have committed or are about to commit a crime. (Terry v Ohio), other wise they can't stop and ID.
Second, if they claim reasonable suspiscion, then Hiibel v Nevada says - that a detainee was not required to produce written identification, but could satisfy the requirement merely by stating his name. Some “stop and identify” laws do not require that a detainee identify himself, but allow refusal to do so to be considered along with other factors in determining whether there is probable cause to arrest.

The use of force by either the federal or State government is not going to end the illegal immigration problem.
As Ron Paul has pointed out, the free goodies passed out by the federal and state governments are the magnets that are attracting illegal immigrants. End the largesse, both to citizens and illegals, and the incentives are gone. Misinterpretation of the 14th amendment is also a factor. Children born in the US to foreign citizens have no right to citizenship by virtue of simply being born within US borders, because they are not "subject to the jurisdiction thereof"; they are subject to the jurisdiction of their homeland, but as long as the Supreme Court judges can't read and makes it up as they go, we face the danger of "anchor" babies.
The Arizona law was just theater and would have had little effect. The federal opposition is just theater also. But if you are opposed to the Democrats who are now in power, you should be cheering the federal court intervention. Just think how both the Obama administration's going to court and judges ruling will affect elections this autumn. It certainly will not work well for Democratic candidates.
The real problem in the Southwest is not immigration itself. It is the failure of Hispanics to be integrated into the US culture. By keeping separate language and strong emotional ties to a foreign homeland, a separate nation is being formed in the Southwest and eventually this nation will break apart from the US and either operate independently or become part of Mexico.

This is and always has been an Executive Branch responsibility. The President has all the authority he needs Constitutionally (as well as the duty) to secure the border. Any other "solution" is a distraction, and will NOT solve the problem.

The welfare state is not going to be repealed, and if some state tried the courts would rule against it(they'd find a pretext).
The question is whether we're to be slaves working for foreign nationals who sneak across the border.

This is like my kids trying to tell me to change the rules! The states laws are supreme, even in the Richard Mack VS Clinton the supreme court ruled the feds do not have authority to tell the states or counties to do anything. The states created the federal government and AZ should simply ignore their ruling. Nullification is the answer.

Maybe dissoultion of the federal governmet is the answer.
We execute individuals that murder, rape and cause mayhem; when governments go rogue like the federal government has, perhaps the solution is to dissolve it; end it just like the USSR ended.
All the States need is a mutual defense compact and a few simple agreements for free commerce. Something along the lines of the a new "Articles of Confederation" could easily replace the present federal government, so long as they did not foolishly assume the debts of the federal government.
Dissolution is the ultimate nullification.

Until the people in the states decide to deal with the Feds by taking their power away, nothing can be done.
Here again, the people act and one Fed says no.
Nullification, assertion of states rights, etc. are subject to one Fed simply saying no.
Pull the monster's teeth through a Constitutional Convention. There is no other way for those who are serious about controlling the Feds.
Some politicians aren't serious, but only want to use an issue like this to get elected.
