Video of LVRJ's Agent Who is Suing the Daily Paul

It is an mp4 that has to be downloaded and played locally on your computer. So far I have been unable to find it on YouTube.

OK. I'll use difrerent words.

Righthaven has no cause in this action, because it didn't own the rights to the pertinent content at the time it was posted. IT WASN'T THEIRS.

The publisher (MN/DP) could reasonably know who owned the rights when the piece(s) were published, but could not possibly have known who might acquire those rights in the future. Should someone do so, it is incumbent upon them to issue a "cease and desist" order to inform the publisher of their new rights in the material. Righthaven didn't do that -- intentionally, it would appear.

But their claim is that their rights were violated upon the publication of the material they later acquired. That's a totally bogus claim. ON THE FACE OF IT, their lawsuit is frivolous and predatory, and they should not only be denied their claim, but be cited for contempt and remanded for prosecution of extortion.


the federal judge refused to dismiss on this basis.
He said that because the copyrights were transferred with both "the exclusive copyright ownership, together with accrued causes of action" that this transferred the right to sue, even though the infringement occurred before the transfer.

That simply boggles the mind. Even if the transfer of ownership included a codicil to that effect, two contracting parties can't change the fact that an injured party must exist for a transgression to be committed against such a party. An injured party can't transfer its IDENTITY to another party.

Lately it seems brains are a disqualifying trait for the federal bench....

Righthaven suing my friend Ron!?!

At the start of the segment on Righthaven, they flashed a copy of a law suit "v. Ron Futrell, an individual".
When I lived in Las Vegas, Ron was a friend and a member of our LDS church ward.

He was also the sportscaster for one of the local TV stations and so was fairly well known around Las Vegas.

Its a small world.

legal team? This is the type of case they might really like to get their teeth into. Maybe too commercial for the ACLU?

LVRJ's Agent?

It looks to me Righthaven is acting as it's own agent since Righthaven purchases ownership. LVRJ technically has nothing to do with these "suits". It should be easy to show he is purchasing those rights for the sole purpose of litigation, so how has he been damaged? He has stated his objective is to "monetize" intellectual rights on the backend. This is usury, or using law for the sole purpose of making money.
Another observation: Righthaven is working with LVRJ exclusively. Has he been hired by LVRJ? Why just them? RICO? I wonder if I could buy any of those rights for the same price Righthaven is paying...any idea what that figure is? My bet is it ain't much.

Bottom line Michael,I think you've got tons to throw back if you can get the right legal help. Simple defending against this is not best IMHO. Need to fire back with both barrels.

I do not see how they can sue

for a purchased company , as ANY information would be second hand information. Illegal for them to testify or sue on behalf of another injured party. ?
ALL hear say evidence.

Civil Disobedience

Obviously I'm coming at this from the anarcho-capitalist/civil disobedience viewpoint but if I were Michael, I would videotape myself tearing up any lawsuit papers I got and not spend 1 penny on any lawyers to defend myself in court. Then show the video to the world as a testament of peaceful disobedience.

Legitimacy of intellectual property aside, the battle we're facing, not just with this case but in general, is a battle that we cannot win in terms of money. Let me explain.

Dr. Paul will never raise anywhere the amount of money as the establishment candidates. The same goes for this case. We simply don't have the resources to hire the best lawyers to win in court. Sure, we might win a battle here or there, but only at significant costs that we cannot sustain long-term.

This is because they've won the money game already. Hell, they print the stuff! The fact is, the establishment wants us to play the money game because they know we'll lose every time. If we want to win, we've got to disobey Gandhi style. And if we are going to disobey we must realize that disobedience strikes not only the issue we are disobeying, but the heart of the system as well. This is why it would behoove us to better understand the philosophy of anarcho-capitalism.

Not too late to consider class action countersuit

All the defendants together - counter sue.

it is not too late, I think it is a great idea. Seems there's many an attorney that would kill to handle this case for us all. Great publicity for the law firm and all his clients in the suit.

Just finished

watching. That fellow sure is polished and they are using the DP as a genie pig test case. If you go forward you will need a good lawyer team because although he comes across as a sensible person they have big guns pointed at the internet and our freedoms.

I have read a lot on the government plans for the internet and I am sure you are well aware also. You have a couple options, you can go to trial and possibly lose or you can avoid trial and pay, hang on for a while and eventually shut down. If you win at a trial they have the option of hitting you up again to wear you down or they will eventually pass laws and still get their way eventually. Winning a trail could encourage others to fight back.

I love the Daily Paul and everyone here but it would be selfish of me to push on you what I would want done. You have had a lot thrust upon your shoulders and I have been honored and happy to have discovered Ron Paul and the Daily Paul. I will respect whatever decision you make and will support you in whatever the decision is.
