Rob McEwen: Your readers need to appreciate: Gold is money. It is currency. I think the number of people familiar with gold will grow as people see gold as a currency. China, India, Russia are buying gold to diversify their foreign reserves. To restore the confidence in currencies, I think some central banks, such as the Chinese and possibly the Russian, will increase their gold holdings to the level that the percentage of their total currency will be greater than that of any other currency in the world. At that point, they will assert that their currency should become the reserve currency of the world.

The US Dollar met its demise in December, 1913. Our gold left our folks hands in 1933-1934 to the Fed Reserve. Our Gold Certificates turned over for Fed Reserve bank notes ( promissory notes redeemable for nothing). Our Silver Certificates were turned over later for the same nonsensical Fed Reserve bank notes ( promissory notes redeemable for nothing). About that time, 1965, the silver was removed from our coin (we got copper tokens plated with nickel. In 1971, even the International Central Banks (much like the Fed), lost there privilege to redeem Fed Reserve notes for silver (they too got but a promissory notes redeemable for nothing). We are now a world awash in promissory notes... Receipts for nothing.

Even Gold & Silver Certificates were a sham. They did not denominate the weight nor purity, of the metal that they supposedly could redeem. The Dollar denomination took on a new meaning... National Debt... The printed Dollar Fed bank note became a debt receipt... for a debt supposedly due to the Fed Reserve... Why this charade has continued for 98 years is beyond me.

Promise them nothing... But give them a receipt.

End the Fed: Loaning you blind, since 1913.

Is this the "Year of Metal?"

I'm expecting

that the rally in stocks will fizzle out and reverse lower before the week is over. They'll prolly hold up through today but I think upside is limited from here(dow at 12,460, S&P 500 at 1283). I am still bearish metals, but I think equities are the better short right now. I have been willing to give my silver shorts a lot of room, and am still holding short, but there is a chance metals could rally during the initial turn down in equities. I'm going to try and hold short in silver and short stocks too, but I don't want to give back too much of my gains in silver so if it goes much above $30 or $31 I may stand aside temporarily, but eventually metals will move lower with stocks (if they don't do so from the get go).

INTERNATIONAL. Legendary global investor and chairman of Singapore-based Rogers Holdings, Jim Rogers has been talking about his 2012 predictions.

In a nutshell, he is neither too optimistic about the stock market for 2012 nor about what’s going to happen in the world in the next two or three years.

Speaking to Australia Financial News Network (AFNN) December 23, Rogers said: "The problems are going to continue to get worse until someone solves the basic underlying problem of too much spending and too much debt."

He sees the biggest risk to global growth in 2012 as "too much debt...too much consumption...and the central bank in the US which keeps printing money."

Asking for advice

We are older and concerned that we are alone in a very rural area, and although our home is off grid, and survival oriented, we want to sell and move to Montana to be near like minded people and our children and grandchildren. My husband was wondering if we could sell it for say half federal reserve notes and the rest in US silver coins valued at half the value of the property, but only count as face value. Is this legal? Is this even okay? And could it count as less on taxes, seeing that US coinage is still legal, although if silver, is obviously worth more? I figured since our property is survival oriented and off grid, it may be possible to find people who would want to do this. Would appreciate any advice, and or steering me to right people who would know. Thanks so much. Go Ron Paul. I pray daily for him.

My informal opinion

is that with the iRS you could not get away with valuing the coins at face. They would have to be valued at market. But this wouldn't affect the purchase price. That you would agree to with the buyer. The quantity of coins would then be adjusted to match the agreed upon mix between FRN's and coins.

The good news is that you get a generous exclusion for income tax purposes on the gain on the sale from your principal home. Depending on your situation, you may be entitled to a $250k or $500k exclusion

You have infinite options. Sell, barter, lease, swap...

You may pass on your home to others in many ways.

Without laboring on any details, consider many options in addition to using US silver coins as a form of legal exchange. US silver coins are still legal tender for all debts, public & private. Legal tender laws generally have to do with payment of debt. Tax collectors will want to collect their due. They consider your taxes a debt due to them. You may minimize their assessment in many ways.

Who is to say what the value of what you exchange is? The value is determined by you & the recipient. If you sell for a low price, the tax collector has no authority to stop you.

  • If you sense you will be taxed upon sale, you may consider paying the tax if it is small... & be done with it (as a senior, your principal home has a huge capital gain tax exemption upon sale).
  • Exchange into like property following the tax code (eg: another real estate property... even bare land to build or farm).
  • Lease (eg: 99 year).
  • Trade with a contract-of-sale extending over multiple years (spread any inflated capital gain).

Yes you may accept various forms of payment. Specifically, your question has been argued with the IRS many time over the decades with varying results. I will write no more about it. Best wishes.

nobody has true ownership of

Nobody has true ownership of their home. This is due to purchasing with FRN's instead of paying in dollars. The TRUE owner of a property will not likely agree to sell you land with allodial title for silver, as that would make you the lawful owner as opposed to the legal owner. True ownership of land is more valuable than gold or silver. When you pay with FRN's you DISCHARGE the debt, which is not the same as satisfying the debt, If the contract is for dollars, and you pay with FRN's, then you have not satisfied the consideration. This is what THEY SEEK, for you to NOT satify the note, thereby only discharging the note, but not satisfying the note. You gain legal ownership, just as a tenant obtains level ownership with a lease. But it does not obtain lawful, allodial, ownership. If you are selling a house, you probably didn't own it to begin with, you owned legal title to the house, which is the same as a lease agreement with you as tenant. If you are buying a house then the owner you are buying from probably does not own the house either, and does not have the authority to sell allodial title.

If a smart person insists on receiving a signed discharge AND satisfaction (would the satisfaction be from the bank or the seller) would that be sufficient to OWN the house in the complete sense of the word? Or would it not matter because as you say the seller probably didn't own the house either?

If you live within an

If you live within an incorporated township, then you're not going to get anything more than legal title to your property. The one who you pay taxes to, that is the true owner. If that owner is "incorporated" through the State, then they have "joined with" the State, with that State being the superior (the same is true with marriage if you get a marriage license, you are "joined with" the state, the state being the superior in the 3 party contract).

The are some cases of allodial ownership of land in the United States, they are rare. Look into land patents. Read Black's Law Dictionary definitions of "allodial title" and "legal title" to understand the differences. Legal title only gives the privilege, under conditions, to occupy the land. It is basically no different than a lease/rental agreement.

When people own land by allodial title, they are free. They can literally declare themselves King, establish their land as their Kingdom, makes their own laws for their Kingdom...they are sovereign. When people own land by legal title, they are living in a fuedal system.

You can't discharge AND satisfy a debt. Bankruptcy discharges a debt. You didn't pay, but you are relieved of that debt. You still have an outstanding debt, a debt you did not honor, but the government gives you immunity from your responsibility. This is ONE of many of the "privileges and immunities" of a United States citizen. The government has provided you with immunity from the Law.

If you had a contract to pay in dollars, but you instead paid in Federal Reserve Notes, then you did not satisfy the debt. Dollars are not defined as being funny little pieces of paper, and so you cannot pay with funny little pieces of paper. But the government gives, again, immunity from not paying your debts. But with the benefit always comes a burden. You cannot accept the benefit without also accepting the burden.

The seller (named as "tenant" on owner's legal title) has the right to convey his legal title. The true owner is no where involved in the deal, other than filing for his benefit the change of legal ownership, so he knows who to collect the rents from.

Judge James Layman Brown, a shrewd observer close to the scene, said, "This was the one clause in the law that made more contention, I honestly believe, than any other statute that was ever written on earth."
