EFF: Censorship of the Internet Takes Center Stage in "Online Infringement" Bill - S.3804

Senator Patrick Leahy yesterday introduced the "Combating Online Infringement and Counterfeits Act" (COICA). This flawed bill would allow the Attorney General and the Department of Justice to break the Internet one domain at a time — by requiring domain registrars/registries, ISPs, DNS providers, and others to block Internet users from reaching certain websites. The bill would also create two Internet blacklists. The first is a list of all the websites hit with a censorship court order from the Attorney General. The second, more worrying, blacklist is a list of domain names that the Department of Justice determines — without judicial review — are "dedicated to infringing activities." The bill only requires blocking for domains in the first list, but strongly suggests that domains on the second list should be blocked as well by providing legal immunity for Internet intermediaries and DNS operators who decide to block domains on the second blacklist as well. (It's easy to predict that there will be tremendous pressure for Internet intermediaries of all stripes to block these "deemed infringing" sites on the second blacklist.)

COICA is a fairly short bill, but it could have a longstanding and dangerous impact on freedom of speech, current Internet architecture, copyright doctrine, foreign policy, and beyond. In 2010, if there's anything we've learned about efforts to re-write copyright law to target "piracy" online, it's that they are likely to have unintended consequences.

"Please receive this email as a clear warning. Your "Online Infringement" Bill - S.3804 is going to fire up the liberty movement in this country like you can not imagine. You have not seen a close senate race in 30 years, but apparently you want one. The internet is already buzzing with the unintended consequences this bill will create - specifically the implications for free speech on the internet. I understand the pressure elected representatives receive from powerful copyright holders but that is no excuse to compromise our rights guaranteed to us by our constitution (even if the majority of your campaign contributions come from large music groups, software companies, and others who stand to gain from the censorship this bill would create).

This bill will allow for a loophole which can be used in the future by unethical politicians to silence the people who oppose its policies, commercial ties, corruption, etc. We are through allowing our rights to be gradually eroded by horrible legislation like this. This bill will not pass, and we will remember who introduced it."

Another career politician hard at work

Patrick Leahy hasn't had any real competition for his senate seat in 30 years. I doubt he would be pushing this garbage bill if there was a liberty candidate trying to take his precious senate seat away from him.

Sounds awful

Though it won't help with the potential problem of shutting down web servers I thought it a good opporunity to share some encryption and anonymity tools for surfing and e-mail.

This legislation is one more reason to learn about internet proxies, SSL, and PGP.

Some good, free, easy, web-based proxies:

Proxify Offers SSL encryption
Frost Does not currently support SSL

SSL plugin for Firefox - automatically applies SSL features to many popular websites:
HTTPS Everywhere developed by the aforementioned EFF.

And finally, for e-mail, PGP:
Pretty Good Privacy

These tools offer powerful encryption and anonymity -when used correctly -, but they do not render one impervious to brute force decryption which major governments will have the resources to do.

However, the more people who encrypt and anonymize their web traffic and e-mail the more difficult it is to conduct a surveillance state...knowing who to target for decryption analysis becomes much more difficult as the volume of encrypted and anonymous traffic increases.
