L.A. Sheriff Will Enforce Federal Pot Laws if Prop 19 Passes

Los Angeles County Sheriff Lee Baca held a press conference on Friday to announce that “Proposition 19 is not going to pass, even if it passes," meaning his deputies will continue to enforce federal cannabis laws even if California law changes.

Baca foresees far-reaching consequences should Prop 19 pass – ranging from an increase in traffic accidents to harboring drug cartels. However, his personal experience with pot is a bit limited. “Asked if he had ever experimented with the drug, Baca was unequivocal. ‘Hell no,’ he said.”

Marijuana proposition losing ground, poll shows

Californians are souring on a ballot measure to legalize adult recreational use and cultivation of marijuana, according to a new poll conducted by the Public Policy Institute of California.

The poll found that 44 percent of likely voters support Proposition 19, the marijuana ballot measure, while 49 percent are opposed. The results are a significant decline from last month, when the same survey found Prop. 19 leading 52 to 41 percent.

For Prop. 19, he noted the array of high-profile figures who have come out against the proposition, including every candidate running for statewide office, while the proponents have yet to gain such high-profile endorsements.

LA County Sheriff Baca has, unwitting, given the Prop 19 people a GOLDEN opportunity. They should organize a HUGE protest in front of the Sheriff's office and invite ALL Third Party candidates who support Prop. 19 to speak.
None of those candidates would miss the opportunity, and "Governor Moonbeam" would likely change his stance if he sees his victory margin eroding over this.

Yes, he's doing so to enforce an illegal Federal law so it's bass ackwards from how we've learned it should be done via Sheriff Mack (www.sheriffmack.com) which is to defend his constituency from the Federal tyranny but I love that he's saying the County can tell the State to go to hell as well.

Assuming Prop 19 passes, this move could be hugely beneficial as well in that it will bring the question to the forefront if a County Sheriff can tell the State (or Federal) government their laws are nullified in that county. Remember, the Supreme Court told Sheriff Mack and his fellow sheriffs in their case that the Sheriff can and that the Sheriff is "the law of the land."

We're all for decentralized localized power. Let's make lemonade like we always do. This could be yet another "gift horse." ;-) Let's not "look it in the mouth." I hope the Oath Keepers that have had success in L.A. County with this Sheriff realize this and educate him why he's both right that he can nullify but wrong in that he's nullifying the wrong law, the Constitutional one the state is creating. He should already be nullifying the Federal drug law.

Reminder from another thread, someone posted that the Feds are saying they will enforce the Federal drug laws regardless. Their hypocrisy lies in that they just told Arizona they COULDN'T enforce Federal laws. How do you expose a tyrant? Make them act like one. We're doing just that.

I would think the sheriff could be removed for misconduct...

for failing to obey his oath of office by not enforcing a state law, especially a referendum passed by the voters. He might have second thoughts if only a fraction of those voters showed up in front of his office and confronted him.

Just as the federal government cannot afford continuous

empire sustaining wars around the world, the State governments cannot afford the continuous domestic wars like the war on drugs.

But it is instructive that those with such a large financial stake in keeping marijuana illegal, like the above mentioned sheriff, are opposed to freedom.

if the Feds & Sheriff won't recognize the law

it could get really weird. The Feds never recognized the state's medical marijuana laws (they keep raiding dispensaries with guns put to people's heads). If the people of California pass this, I got a feeling that on the Feds are gonna come down harder on them. I see the possibility of retroactive unconstitutional federal laws being passed. I see the possibility that those who signed up for medical marijuana cards will end up on some Federal list. I don't trust state or federal govt when it comes to marijuana. I don't believe any of this stuff that is going on is for the benefit of marijuana users. Prop 19 is called the Regulate, Control and Tax Cannabis Act. I wouldn't be interested in any of those things. Maybe if they'd replace some of those words with 'legalize'.

They should have included in the proposition the immediate recall of all elected officials who frustrate this effort.

The Sheriff should be fired hands down. If they can't follow state law they shouldnt be given the power to enforce the law.

Drug czar: Calif. pot law could spark court action

SAN FRANCISCO (AP) — Federal officials haven't ruled out taking legal action if California voters approve a ballot initiative that would legalize recreational marijuana use in the state, President Barack Obama's drug czar said Wednesday.

In a phone interview with The Associated Press, Director of National Drug Control Policy Gil Kerlikowske said Justice Department officials are "looking at all their options" for responding to the measure, which would conflict with federal laws classifying marijuana as an illegal drug.

I don't believe in Recall.

But this sheriff should be voted out! Good thing he's an elected official and not appointed. The next election for sheriff should be really good. Get an Oath Keeper on the ballot for sheriff and it WILL be interesting.

And properly timed recalls can bypass legal cause, if any.

Recalls allow a minority of recall voters to override the majority that elected someone.

Say someone was elected during a Presidential Election Year for Township Clerk. Off season special election recalls for that single issue draw very few voters.

With a vote less than the loser in the Clerk race gets the elected Clerk recalled. The Township Board handpicked a new Clerk.
