Submitted by The_TSA_Is_A_Fraud on Wed, 11/17/2010 - 20:26SAN MATEO COUNTY, Calif. (KGO) -- The San Mateo district attorney's office has a warning for all TSA personnel at SFO -- anyone inappropriately touching a passenger during a security pat down will be prosecuted.
Incoming San Mateo DA Steve Wagstaffe says any complaints of inappropriate touching during an airport security pat down will land on his desk.
"The case would be reviewed and if we could prove the elements of it, that it was inappropriately done with a sexual or lewd intent, that person would be prosecuted," he said.
The charge -- sexual battery.

How do you prove lewd or sexual intent? People are charged with sexual battery all the time. How many times would a TSA groper need to be charged before it was obvious that there was substance to the charges?

Well that's a lot of empty rhetoric... How does one prove lewd intent when it is going on at all the airports????... but I guess it makes him look like he's on board...we'll see.

Doesn't matter if the pat-down is sexual/lewd or not. If the person being screened doesn't want to have their genitals fondled then it doesn't matter what the fondler's intent was.

That's an interesting stance since:
a) SFO is under the jurisdiction of the City and County of San Francisco
b) The TSA isn't in SFO. SFO opted-out as soon as they could to use private contractors.
