Righthaven extends copyright lawsuit to individual Web posters

Las Vegas copyright enforcement company Righthaven LLC is now suing individual message-board posters, not just website operators.

"Righthaven, which files copyright infringement lawsuits over unapproved online postings of material from the Las Vegas Review-Journal and the Denver Post, filed seven infringement lawsuits Tuesday and Wednesday in U.S. District Court for Nevada, lifting its lawsuit total since March to at least 203.

Among the defendants sued Monday were message board posters identified as James Higgins and Wayne Hoehn.

The most coherent answer

I've heard about why they are doing this is something about not diluting the influence of the original source. So, if a site or person makes a reputation out of nothing but linking to news stories, they say they think the original content producers are being bilked.

Their answer, not mine. Extortion, alleged, "we all know", not going to say anything specific, just some words you can string together however you wish, given our collective ... just don't nobody sue me. I have nothing.

I'm still not clear on what they want.

Are they going to be satisfied if we credit the source (ie give the authors name and the newspaper) or will they sue anyway?

This stuff reminds me of RIAA and their insane lawyers who ran after everybody and their great-grandmothers. My feeling is this will backfire and blow up in newspaper industry's face. Newspapers are the next shoe to fall. Since their business is in deep shit because they betrayed their readers for so long now their comeuppance is due and they don't like it. They are desperate for cash, jealous that the Internet is doing a lot better job of spreading information than the garbage they publish and this tactic is simply their last-ditch attempt to save their own asses. How pathetic!!! And what will come out of this? They don't know the answer I bet ya! Well, I do - their sales will keep clumbling no matter if they sue everyone out of existence or not and they will be dead one day, and this day is coming very fast!!!

How can one company go after people that post stuff from other papers, I don´t get it, they have nothing to do with that?

But their lawsuits will drag out longer and be more costly. They better have deep pockets.

Most individuals will have the crap scared out of them and settle. It is the individuals who better have deep pockets if they want to contest the charges.

That's just how the economics of the whole thing shakes out. This is an innovative "business model" in the dying age of the old economic order.

There has to be a trump to it

The countersuits for frivolous lawsuits should get to them eventually, if their targets band together.

Otherwise, this market will be saturated until all the economy is just judges pushing settlements around.

I agree. A class-action counter-suit would be advisable to stop the monster in it's tracks.

then they can sue whoever is on the other end of it.

My library does this. They know who is on what terminals at all times.

depends on which computers I use

I do have a card...you have a point there.
But for example now I am in one of many employment centers where I can use computers totally incognito.

Well this is an interesting shift in strategy. Thank you Liberty_Belle.

The Daily Paul has a DMCA disclaimer which protects the site from future lawsuits. This does not protect individual users from getting tangled up in a lawsuit.

This is why, in the DP posting guidelines, I request users not post the full text of articles.

1) It is bad netiquette,

2) It could (has) gotten me in trouble, (suit here & here)

3) Now the possibility of you getting sued is a reality.

Trust me, you do not want to be sued. It sucks.

* This is important information for anyone that has a blog or website. This is the loophole that allowed the site suits:

An obscure section of the DMCA concerning the "safe harbor" noticing proceeders requires that in order for a website to qualify for "safe harbor" and thus require a copyright complainant to first give the webmaster notice and time to take down the material before suing them, requires (amongst other things) that each website register their contact information with the United States Copyright office..

* YOU HAVE TO REGISTER YOUR CONTACT INFORMATION with the United States Copyright Office.

You can be your own designated agent, or your company can, it doesn't have to be a law firm.

Make sure you put the actual URL of your website in the "alternative names" you do business as section.

* I had posted this comment on the forum when all this started and you acknowledged that you did see it.. but just want to be sure (and also for others here that have blogs and sites.)

* Yes, as far as this new development suing the posters ...we all DO need to tighten up and be aware of how we post news items!

Some enterprising young lawyers

need to start figuring out a way to sue these Righthaven people out of business.

Something tells me that if they are being sued from every possible angle themselves, they won't be spending as much time suing other people.

Why hasn't the Nevada AG acted?

This is extortion, plain and simple.
Has anyone told the Judge about this?
