Patriot Act Extension to Be Brought for Second VOTE - Thursday

The House on Thursday will again take up a bill that would extend until December key provisions of the Patriot Act counter terrorism surveillance law, two days after the measure fell seven votes short of the super-majority required for passage under fast-track rules.

The bill will be brought up again under a "closed rule," meaning that no amendments can be offered. It will need only a simple majority to pass instead of the two-thirds that was required on Tuesday.

now that the pres. primaries are coming up, you're going to hear a lot of propaganda pushing on subjects like this. since the new republican majority was elected, you've heard a lot less about cutting spending, and a lot more about "defense" and "oh my f-ing god, sharia law is coming the u.s. people!"

When the 112th Congress convenes on Wednesday, the new Republican majority will begin keeping its Pledge to America and adopting new rules that change the way Congress works by:

* Posting all bills online for public viewing at least three days before a vote: The days of quickly ramming massive bills through Congress - such as the “stimulus” that didn’t work and the job-killing national energy tax - are over. Under the new rules, the House will post all bills online at least three calendar days before a vote, giving lawmakers, the public, and the media a chance to read each proposal and understand its impact. The Sunlight Foundation called the new rule “a huge victory for the ReadtheBill movement, and for transparency in the way the House considers legislation.”

* Making it easier to cut spending -- and harder to increase spending: The new rules will reflect a new culture of fiscal discipline in Congress; no longer will the system be rigged in favor of ever-more (and sometimes automatic) spending hikes. Republicans are implementing a cut-as-you-go (“cut-go”) rule that says any new mandatory spending must be offset with spending cuts - not tax hikes. They will require legislation to show a long-term budget impact - four decades beyond current rules - to prevent lawmakers from using accounting gimmicks and sleight of hand to hide the true cost of big government proposals. And more.

* Requiring lawmakers to cite the Constitutional authority for any piece of legislation: The Constitution will get a “starring role” in the new Republican-led Congress, says the Washington Post. The fact that this is noteworthy proves just how dysfunctional the House of Representatives has become. Legislators will now be required to outline, in the text of a bill, where in the Constitution the federal government is delegated the authority to carry out a given law. As Boehner said last fall, “If we cannot do this much – we should put down the pen and stop right there.”

Dear Mr. Yoder

Sir, you supported the continued undermining of Americans 4th Amendment rights to be secure in their person and their right to privacy. It is very interesting that this is the same stance of our Democratic masters, the Obama admin banging their desks to retain more executive power, and of course Dennis Moore, who for the life of his political career, never did a thing to preserve the individual liberties of each and every one of us.

Happy to see that some Tea Party candidates had the sense to defend the rights they pledged an oath to embodied in the Constitution. Some have even gone as far as sending video messages about this to their constituents. However, even they as an association, as a whole, have failed the American people in this critical moment. Congress will have another chance to reauthorize this draconian law just like they did the banker bailouts and Obamacare and sadly, now I know where my representative stands when it comes to my rights. To him I suggest he spends some time at the Art Center in Lawrence this weekend and look at the paintings of Roger Shimomura. Watch what happens when a government out of control took the very liberties away from the people it swore to protect in the name of security. As they put Japanese men, women, and children in camps. The WWII era was big on camps. Roger and those like him will forever be traumatized by that experience and hopefully more hesitant to put so much trust in those in power regardless of the preconceived beliefs and values of the land.

To some, the Constitution is still just a "GD piece of paper." To others, like the brothers and sisters I went to war with, it meant a lot more. If you continue to enable people like this, that is the true despicable act against those that fought and died to preserve her. They were sent to preserve every letter of the law, not just parts of the 1st, 2nd, and 10th. It's not multiple choice or ala carte. Its all or nothing! We are endowed by our creator, not our representative. You sir have no business voting in favor of this act. I hope to see a change if/and when this comes up again.

Measure is considered read, bill is closed to amendments, and all points of order against provisions of the bill are waived.

This actually may be good news if there are enough House members who want more discussion on this. Maybe they will vote against it if they don't feel it has been discussed enough, or if they realize who may be enforcing it against them.........

Thanks to Justin Amash for explaining this vote today. The vote was to determine the rules on the reconsideration of H.R. 514. It will most likely pass but I got the impression that today's vote was the actual vote for the bill which it's not. Wish he was my congressman

Hi! First time comment here-

While no big fan of Democrats, with this vote (and it's 'best 2 out of 3' RE-presentation in two days), I have lost ALL faith in Republicans, saving Dr Paul. This is a shining example of politicians completely failing to walk their talk, as they've done over and over again. It may sound crazy, but at least you generally know what to expect when you vote for a Democrat, not that that's a good thing either.

Do Not Despair...

Obviously, they are going to get their majority and it will pass.

I see some "the glass is half empty" consolations this time around:

(1) The provisions of the bill they are reauthorizing expire in less than a year.

(2) Liberal Democrats are getting fed up...they don't want this any more than we do. When Obama inevitably signs onto this reauthorization, it needs to be super-glued to him. This gives us a lot of rhetorical points with liberal Democrats, whether scoring points with them or confronting them. In the latter case, they have no defense.

(3) The American people, and especially the GOP Right, are beginning to learn about the word "repeal".

(4) The best silver lining: This vote completely EXPOSES the Astroturfed GOP mainstream Tea Party Right without any political cover whatsoever. They cannot claim to be constitutionalists and vote for the Patriot Act simultaneously. This is good considering we are going into a presidential election cycle.

In other word the Constitution is the Supreme law above all others.

"The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." The Patriot Act is clearly repugnant to the Constitution.

"Whoever, owing allegiance* to the United States, levies war against them or adheres to their enemies (by breaking the Constitution), giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States."

*allegiance: Congressmen take an oath to uphold the Constitution.

It's our job to protect the Constitution if we want to keep it.
