You do not get your rights from the law. I keep hearing this argument such as 'so many of our rights are wrapped in the constitution' and it infuriates me. If there are to be any rights in the law then the only rights that are embedded in the law are the things it can do to the people. When I steal the law has the 'right' to imprison me and how long and under what conditions I am to be punished are also in the law. It has no 'rights' outside the law. It can not punish you where there is no violation of the law since it has no right to do so. It is a limitation on the government. It defines where and when it can act. It defines the government's rights and not the people's rights.
