on the circumstances and what state the incident occurred in and that states particular statutes. It's not a Federal issue.

I don't see a problem here...

Your home is your castle. This isn't England...you may stop an intruder within your castle by any means should you fear for your own safety or for the safety of your castle's invited occupants. I guess I just don't see any issue and cannot figure out why ANYONE in this situation (in America, anyway) would be jailed. What part of "...shall not be infringed..." isn't crystal clear?
