Peter Schiff: My Dad is a Patriot, a Political Prisoner in Jail For His Beliefs Who Stood Up for His Constitutional Rights

And I was punished for it. I am a Patriot too. But Peter dropped me as Irwin's attorney because of the disfavor I received for advocating Irwin's defense that never was part of the lynch job trial he had. Of course, Irwin unfortunately represented himself at the trial and that was a mistake on his part. I understand that Peter has hired a hot shot Seattle lawyer (mucho money)who will not present the defense Irwin wants for fear of punishment by the court. Irwin is soon to file a Habeas Corpus Petition. It will be his last shot at freedom--a long shot, unless Ron Paul got a chance to Pardon him. Personally, I dislike Peter.

Seriously, the fact that he never told his father's story bothered me so much I stopped listening to him. His father IS a PATRIOT and Peter deserves to be PROUD to be his son!! And his dad deserves to KNOW his son is proud of him. As a parent, I ached for Irwin, seeing his son gain in fame and stature and never mention his father's plight... It bothered me deeply, and that is laid to rest at last.

He is not in jail for breaking the rules of the internal revenue code. They locked him up because he was selling his research so people could free themselves from the IRS tyranny. I have all his books and almost all of his information. I have been fighting the IRS for almost ten yrs now. With the same old run around. They never give you any documents that support their claim you owe them taxes. They will not give you a face to face hearing, which you have under your Due Process Rights code sections 6320 & 6330. They never give out a Final Notice and Demand as their own publication 594 says they have to, before they seize your property. They cannot get Verification from the Secretary that all administrative procedures have been met, even though they say they have, you will never see it. You have the right to see all documents they are using against you. That is why they don't give you face to face hearings. Kinda hard to hide the fact that they don't have the Verification from the Secretary. If they don't have it they are BREAKING THE LAW.

When they levy your accounts on the back of the levy they leave off the first paragraph of code section 6331. Which tells the banker who is liable for the taxes at hand.

Sec. 6331. Levy and distraint
(a) Authority of Secretary
If any person liable to pay any tax neglects or refuses to pay
the same within 10 days after notice and demand, it shall be lawful
for the Secretary to collect such tax (and such further sum as
shall be sufficient to cover the expenses of the levy) by levy upon
all property and rights to property (except such property as is
exempt under section 6334) belonging to such person or on which
there is a lien provided in this chapter for the payment of such
tax. Levy may be made upon the accrued salary or wages of any
officer, employee, or elected official, of the United States, the
District of Columbia, or any agency or instrumentality of the
United States or the District of Columbia, by serving a notice of
levy on the employer (as defined in section 3401(d)) of such
officer, employee, or elected official. If the Secretary makes a
finding that the collection of such tax is in jeopardy, notice and
demand for immediate payment of such tax may be made by the
Secretary and, upon failure or refusal to pay such tax, collection
thereof by levy shall be lawful without regard to the 10-day period
provided in this section.

They always start at paragraph b. You tell me if that applies to you and why would they leave that off? They never get writ of garnishments from judges and never give them notice of seizure which they are supposed to do. I could go on and on.

What people fail to understand is there are no laws that require anyone to pay so called income taxes, income taxes are voluntary. most people are just to afraid from years of brainwashing that the big bad IRs will get you. You never hear anything except that guy went to jail for income tax evasion. When most people are charged with income tax evasion they charge you will two things. Evading the tax and defeating the tax. Theres only one problem with this , they don't know the difference between either charge. This should make it impossible to convict you but they do because of corrupt judges.

Most people don't even know you don't even need a social security number to get a job. I will give anyone 300 Oz of silver if they can show me the law that says an individual has to pay income taxes as used in the constitutional sense. No the 16th Amendment does not give the government power to collect taxes. It's all about the wording of what is written.

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration.

The key wording is lay and collect taxes on incomes from whatever source derived. Income as used in the constitutional sense is a corporate profit. If you have Corporate profit they can tax you no matter where is comes from. But you and I are not corporations therefore cannot be taxed. The play on words is what gets people. Just like the word shall can mean may as well as must. There are lots of supreme court cases on this. Pollock case, glenshaw glass case, the merchant loan and trust case etc....

The government doesn't even define the word income. They try to fool you by using code section 61 which basically says gross income is all income. For one you can't use the same word to define itself. If I told you a bird is a big bird would that give you enough information to tell you what a bird is, if you didn't know what a bird was? The answer is No. This is the game they play people, they hope your too lazy or afraid to care or to challenge them.

If everything they are doing is so correct why wouldn't they just give me all the documents that they say proves I owe them the money I allegedly owe them? It is all fraud at the government level. Legalized extortion whatever you want to call it.

Anyways Schiff figured this all out and wrote books that told the truth about all of this. His last book The Federal Mafia how anyone can legally stop paying income taxes was banned. Because of that book is why he went to jail. They basically said that he was selling bogus info and harming people. There were like 13 charges in the indictment. If you go to his site www.paynoincometax.com he posted everything there for free now. All the court documents, briefs everything is there. Read some of it and you will see just how corrupt the system is.

If what he was saying was illegal why would they need to ban it? If people did what he said they would just arrest them. There is tons of books or information that would be illegal if you did what it said but that stuff isn't banned. The truth is they just don't want you to know the truth. His book was just to powerful. Tell me If what I was doing was so illegal then the day they got my Zero return, why didn't they arrest me? If I killed someone and they had proof they would come and get me right away, not play footsy for dam near ten yrs.

I actually have a tax court trial on Febuary 27, 2012 for my 2003, 2004 taxes. I have a frivolous penalty for 2004 income tax return of 500 which is what they always do. I went to the IRS office and got a document that says thy have no record of a return filed for 2004. Now tell me how the hell can I have a frivolous Penalty of $500 for a a tax return that they have no record of? This has been going on since 2007. I tried to get a face to face hearing, nope just a phone call and when the lady didn't like what I was saying hung up on me. Most people are either afraid or ignorant to the laws. Also the system is just so corrupt it is hard to fight them. To me it is all about principle, Schiff is the person who opened my eyes from this whole corrupt system.

Another book to read is The Power to Destroy by Sen William Roth. These hearings are what lead to code sections 6320 and 6330 which allow you to challenge anything that has to do with the underlying liability of the tax at hand.

Page 73 says "Recent internal investigations by the Internal Revenue Service itself admit that far too many of the countless assessments, seizures, levies, and liens that the IRS executes each year are inappropriate and in open violation of the law. Mistakes and abuses within the system are not rare.

Sounds a lot like what I am dealing with doesn't it. How many other are being screwed by the IRS because of their mistakes and abuses. The guys that crashed the plane into the IRS building Ring any Bells. I will end with this quote from the Federal Crop Case.

"Whatever the form in which the Government functions, anyone entering into an arrangement with the Government takes the risk of having accurately ascertained that he who purports to act for the Government stays within the bounds of his authority... and this is so even though as here, the agent himself may have been unaware of the limitations upon his authority." Federal Crop Ins. Corp. v. Merrill, 332 U.S. 380 at 384 (1947).

While I still fight the IRS. I have learned over the year and from Dr. Paul all roads lead to the Fed. End the Fed End the Abuse.
