There is no case! The government took no action against him. He was asked to be searched and he consented. He must refuse the search and let them act against him because of his refusal. He them would have a case.

appeals court has no jury

The court said TSA policy is secret. They send Ventura to the appeals court to get a verdict from a panel of federally paid judges instead of a jury trial.

What is so disturbing, is the ignorant internet comments calling Ventura a kook, suggesting he drive or take a train if he doesn't like it, move to Mexico, etc. Our constitutional republic is nearly dead and many people are cheering on the death.

I have been reading a lot

I have been reading a lot about courts lately. I am challenging property taxes, so wish me luck. One thing that I have found is, courts will not accept hypothetical cases. Jessie has allowed the searches and therefore consented to them. He would have to deny the search and have the TSA take an action against them to have a case. The only thing the TSA has done so far is request the search. You can not sue for intent, it must be a wrongful action. I may be wrong here, but it is one thing that I have already taken into consideration regarding my efforts.
