Did Willard Mitt Romney Commit Illegal Gaming In The First Degree, A Class C Felony Offense In Iowa On National TV? Just Say'n.

As I recall Mitt twice offered a $10,000 (Ten Thousand Dollar) bet to Rick Perry on national TV. Rick Perry rightfully declined the illegal offer, if Perry had not declined he would be guilty of the same offense.

1. Except as permitted in chapters 99B [bingo] and 99D [racetracks], a person shall not do any of the following:

a. Participate in a game for any sum of money or other property of any value.
b. Make any bet.
c. For a fee, directly or indirectly, give or accept anything of value to be wagered or to be transmitted or delivered for a wager to be placed within or without the state of Iowa.
d. For a fee, deliver anything of value which has been received outside the enclosure of a racetrack licensed under chapter 99D to be placed as wagers in the pari-mutuel pool or other authorized systems of wagering.
e. Engage in bookmaking.

2. A person who violates this section is guilty of the following:

a. Illegal gaming in the fourth degree if the sum of money or value of other property involved does not exceed one hundred dollars. Illegal gaming in the fourth degree constitutes the following:

(1) A serious misdemeanor for a first offense.
(2) An aggravated misdemeanor for a second offense.
(3) A class "D" felony for a third offense.
(4) A class "C" felony for a fourth or subsequent offense.

b. Illegal gaming in the third degree if the sum of money or value of other property involved exceeds one hundred dollars but does not exceed five hundred dollars. Illegal gaming in the third degree constitutes the following:

(1) An aggravated misdemeanor for a first offense.
(2) A class "D" felony for a second offense.
(3) A class "C" felony for a third or subsequent offense.

c. Illegal gaming in the second degree if the sum of money or value of other property involved exceeds five hundred dollars but does not exceed five thousand dollars. Illegal gaming in the second degree constitutes the following:

(1) A class "D" felony for a first offense.
(2) A class "C" felony for a second or subsequent offense.

d. Illegal gaming in the first degree if the sum of money or value of other property involved exceeds five thousand dollars. Illegal gaming in the first degree constitutes a class "C" felony.

And as such, it still remains a personal liberty to engage in such vices. As Ron Paul has said, our government shouldn't engage in legislation to modify people's behavior. If Romney wishes to gamble, it should be his personal right to do so.

Any proposed prosecution of an individual for engaging in behavior that ought not to be against the law in the first place is something we shouldn't advocate. Now, in terms of Presidential material, as a nation we should hold our leaders to higher standards. Our leaders shouldn't succumb to vices and express behavior worthy of emulation.

I say he gets a "tsk, tsk", and not a set of cuffs.

We are also a law abiding bunch. Whether or not we support such laws and I don't, it's still the law of the land, which should be followed.

I was thinking about this the other day.So many of our laws are based on the christian religion. Even the IRS gives tax break rewards for being a good Christian and coveting marriage and going forth to propagate. Where is the separation of Church and state in this action?

Flood the local police in Des Moines with phone calls from Iowans citing Janet Napolitano's "if you see something say something" program. Maybe somebody creative could put up a website where activist's can get alerts to flood PDs anywhere in the country whenever a public official commits the slightest crime in the public sphere. Overwhelm the system with complaints about government crime and it might be retooled.
