VA Attorney General Intervenes to put Newt & Perry on Ballot

He also happens to be a Republican. He is drafting "Emergency" legislation. GOP is all hands on deck with their separate set of rules for the insiders. We do not need to ask what would have occurred if Ron Paul fell short of the needed signatures:

Dear Friends and Fellow Virginians,

As many of you read yesterday in the news (link here for the story) I was considering supporting an effort to change the rules to allow the full range of presidential candidates on Virginia's ballot on March 6th.

I obviously feel very strongly that Virginia needs to change its ballot access requirements for our statewide elections. However, after working through different scenarios with Republican and Democratic leaders to attempt to make changes in time for the 2012 Presidential election, my concern grows that we cannot find a way to make such changes fair to the Romney and Paul campaigns that qualified even with Virginia's burdensome system. A further critical factor that I must consider is that changing the rules midstream is inconsistent with respecting and preserving the rule of law - something I am particularly sensitive to as Virginia's attorney general.

My intentions have never focused on which candidates would be benefited or harmed, rather I have focused on what is best for Virginia's citizens, as hundreds of thousands of Virginians who should have been able to make their choices among the full field of presidential primary contenders have had their number of choices reduced significantly.

My primary responsibility is to the people of Virginia, and how best to fulfill that responsibility in these particular circumstances has been a very difficult question for me. I believe consistency on the part of public officials is an important attribute. And I believe that Virginians are best served by an attorney general who consistently supports the rule of law. That leads to my conclusion that while I will vigorously support efforts to reduce the hurdles to ballot access in Virginia for all candidates, I will not support efforts to apply such changes to the 2012 Presidential election.

I do not change position on issues of public policy often or lightly. But when convinced that my position is wrong, I think it necessary to concede as much and adjust accordingly.

Ken Cuccinelli generally one of the better ones...

Among the current crop of Virginia politicians, Ken Cuccinelli is one of the better ones. He is no Ron Paul, or even a Rand Paul, but I generally support him.

I am glad that he has reversed course and seems to be coming out on the right side of this issue, for the right reasons.

The rigour of ballat access.

We've had to organize to get signatures in our state for ballot access. IF we didn't have enough then we were no able to get on. The rules are to be the same for all. IF Ron Paul's people had failed (thanking them all now), there would be no mercy. Why is it now changed in mid-stream? I can only think of the following....

2012 is the year for Ron Paul!

If you live in Virginia

you may want to consider letting these folks know this is wrong and that all those who failed to get on the ballot for one reason or another should not be getting on the ballot now through special, preferential treatment and rule-bending.

Those candidates failed and that's that. Doesn't matter why they failed.

Rule-change watch

I am for ballot access fairness.

However, in this case, I fear that this intervention by party bosses can open the door to more meddling with the election process in this cycle. This especially applies to this cycle because of shifts in the Republican Party--shifts that Ron Paul represents.

Perhaps we all can be alert to potential Party rule changes and state law and procedure changes in our own states.

Right, they won't just change the ballot law, but others too.

If the corrupt get a chance to rush through some ballot legislation, they are going to tack on a bunch of other corrupt election legislation too.

That's how the corrupt work.

The more creeps on the ballot the merrier.

It's not like these guys are exactly going to steal any votes from US. If it dilutes the collectivist vote, it's all good.

More questions to AG Ken Cucinelli

Since this is Ex Post Facto. Will the Virginia treasury refund / reimburse the Paul and Romney campaigns? Since the law would be thrown out in an emergency session if passed and is no longer valid. Will Bachman, Santorium, Huntsman be on ballot, additionally to Gingrich and Perry?

What are the chances of the lawsuit winning?

I have to admit, I think Perry and company can actually win their case against VA and here is why. http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+24.2-506 In this particular law, no where, and I mean no where does it say that a candidate for president has to get the required signatures to be on the ballot.

However, another law states that political parties do have the right to set the rules for nomination, but again, excludes the presidential candidates http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+24.2-508

I am not sure about federal law. So can Perry and company win? Or is it because the party decided what the rules were, that they can change them on the dime? Wouldn't it make more sense for the Perry campaign to sue the RPV and not the state?

So, the QUESTION is~~why does Perry & the rest

even care or want to be on that ballot SO BAD?? Most candidates drop out of the race by then. Not Santorum, the warmongering idiot, no not him, not Perry or all the rest. Why? Perhaps they've gotten tapped by the GOP to create havoc for Ron Paul and to pull votes away from him. Perhaps they've been told they will get some nice campaign contributions if they "stay in the race".

Please avoid this Ex Post Facto precedent, Governor Romney and Congressman Paul followed the well-known (rules) law. It would also be unjust to the Bachman; Santorum, and Huntsman campaigns who had not expended the resources because they knew what they were up against. The law needs to be changed but after the after the election in a normal legislative session.
I also believe your opponents would use this against you in any future bid for our governorship. Please have a happy, healthy New Year for you and your family.

Virginia is an open primary

As of now Ron will be in the number position on the ballot.

What does this mean with only Romney v. Paul?

It means Ron would get 75% or more of the popular vote in Virginia via Republicans, Independents and Democrats.

The Establishment wants to avoid this embarrassment. So they want other entrants to help avoid this, got it folks?

Virginia is a winner take all by congressional district and we have will Ron's delegates in place :^)

Newt's a Distraction, Part of the Establishment's Political War

If you don't like the rules, change them by executive order if necessary. Who cares about the rule of law, i.e. the state and federal constitutions? Obviously, Virginia's AG doesn't. This act by the AG of Virginia is blatant cronyism. Newt's not going anywhere politically anyway so we simply need to ignore him. Gingrich's promotion by the establishment is simply a continuing distraction from the real enemy, Romney. Newt is finished politically. We need to set our political sight on Romney.

Maybe the Virginia AG should be looking into indicting Newt Gingrich for the fraud that he commited when he submitted forged signatures on his petition to get on the ballot.

Headquarters representing Ron Paul needs to do a COUNTER-SUIT against the State of Virginia. It is obvious that they are trying to split the delegates up to water down a Ron Paul victory in that state.
