WSJ Economist: Ron Paul's 0% income tax would be world's greatest job creator
Submitted by cobaltz on Wed, 02/08/2012 - 06:26Great article:
During the January 16th debates in Myrtle Beach, South Carolina, Presidential candidate Ron Paul laid down a bombshell by advocating his goal of gradually lowering the personal income tax to 0%, while at the same time shrinking government and finding new sources of revenue for Washington to use to perform its duties. In response to this, economist and Senior editor for the Wall Street Journal not only agreed that Congressman Paul's plan was feasible, but it would also be the greatest job creator for a nation in the history of the world.

REALITY CHECK!!!
First off, EVERYONE here should read Dave Champion's Book "Income Tax: Shattering the Myths"
Income Tax is an INDIRECT tax. It is NOT a direct tax.
2 US Supreme Court Cases in 1916 settled this very question. They are:
BRUSHABER v. UNION PACIFIC R. CO., 240 U.S. 1 (1916)
AND
STANTON v. BALTIC MINING CO, 240 U.S. 103 (1916)
The Court said specifically in the Stanton case the following:
" it manifestly disregards the fact that by the previous ruling it was settled that the provisions of the 16th Amendment conferred no new power of taxation, but simply prohibited the previous complete and plenary power of income taxation possessed by Congress from the beginning from being taken out of the category of indirect taxation to which it inherently belonged, "
So, to summarize, the 16th Amendment ONLY confirmed Congress' ability to lay an income tax as an INDIRECT tax ONLY!!!!
The US Constitution grants two types of taxes:
1) Direct tax Requiring Apportionment
2) Indirect Tax (Excise, Duty, Impost) requiring geographical uniformity
the 16th Amendment does not create a third power of taxation
Laying a Direct tax, not requiring apportionment DOES NOT EXIST!
Here's what the US Supreme court said in Brushaber in 1916:
"that the confusion is not inherent, but rather arises from the conclusion that the 16th Amendment provides for a hitherto unknown power of taxation; that is, a power to levy an income tax which, although direct, should not be subject to the regulation of apportionment applicable to all other direct taxes. And the far-reaching effect of this erroneous assumption will be made clear by generalizing the many contentions advanced in argument to support it"
The question they should be asking is, "if the income tax is an indirect tax, how and why am I paying it?" And this is because income taxation on "an Average human being, living and working in the private sector, earning his own living, which includes making his own money, in any one of the 50 States of this Union", DOSE NOT SHOW UP as liable for the tax in the law! That's because the law is written to SHOW that it is indeed an indirect tax related to mostly foreign commerce! That's it.
And that brings us to another topic of what the LAW actually says. Most tax professionals do NOT read the law to determine who is liable for the tax. Most tax professionals read IRS publications and just ASSUME anyone who makes money now owes an Income Tax.
IRS Publications are sort of like "New Letters" put out by the IRS to the tax industry, including mostly ALL CPA's and Tax "Professionals". The IRS has a manual available on their website which any one can go read. Here's what THEIR OWN manual says about their own publications:
4.10.7.2.8 (01-01-2006)
IRS Publications
IRS Publications explain the law in plain language for taxpayers and their advisors. They typically highlight changes in the law, provide examples illustrating Service positions, and include worksheets. Publications are nonbinding on the Service and do not necessarily cover all positions for a given issue. While a good source of general information, publications should not be cited to sustain a position.
So there you have it. Publications are NOT to be cited to sustain positions even though that is what all tax professionals do anyway.
So hopefully this has gotten you on the proper path to actually understanding what the "Income Tax" actually is and especially what it ISN'T!

Definitions In The Code
More proof is found in the custom definitions found in Title 26. Important stuff like: EMPLOYEE: How is this defined for the purposes of the income tax?? Paraphrased for brevity- An EMPLOYEE is one who works for the government or exercises a federal privilege. EMPLOYER: Federal Government. WAGES: Remuneration for services performed by an EMPLOYEE (as defined in code) Read columns by William A. Shields on EtherZone. IMO
All taxation is unethically premised upon anti-voluntary coercion and should be abolished.
To do so would be a primal step towards economic freedom and restoration while disabling corruption and abuse
THE FED/INCOME TAX
WHEN THE FED IS PLACED INSIDE THE TREASURY WHERE IT BELONGS,THE INCOME TAX WILL BE UNNECESSARY.PLEASE VISIT www.monetary.org for more info.
Fiat "money" issued by a government is no better than fiat money
issued by a private company.
Kucinich has the right motivation, but the wrong solution.
Paul's competition in currency bill (H.R. 1098) is much better than Kucinich's (H.R. 2990).

Income Tax Repeal: Make it a Top Issue
Ron Paul has made the Fed a national topic of conversation. Now, at a time when everyone's talking about reform, he can help Americans question the wisdom of having any income tax at all. Here's a column that spells out many of the income tax's "fatal flaws."

Income Tax a Topic on FreedomWatch tonight !

interview.
Needs to be Front Page on RonPaul2012
This article news to be on the Paul campaign's front page.
Stupid people would still not vote for him ;(
The average American voter is really stupid you could practically give them a million reasons to vote for him and they still wouldn't.
It would be nice if the campaign staff
would get this out to every news outlet in the Country. They might not use it, but some would. I'd like to see it on Drudge. This is a gem of a find, and everybody can easily relate to the rationale. Wonder how Rush and Hannity would spin this true conservative idea. If Ron Paul would shift his message to Priority #1 - eliminate Federal Income Tax for everybody, he might kick into a higher gear.

GREAT FIND! BOO-YA!
THAT'S what I'm talking about.
This is basically my NUMBER ONE reason supporting Dr. Paul.
I am single with no kids so I get no tax write-offs because the governmnet doesn't like the life I've chosen.
So they punish people like me and make it possible for 47% of Americans to pay NO tax.
I am tired of the governmnet trying to influence behavior through the income tax code.
"We have allowed our nation to be over-taxed, over-regulated, and overrun by bureaucrats. The founders would be ashamed of us for what we are putting up with."
-Ron Paul
I'm with you, and I am married with kids!
It's hard enough supporting mouths to feed and pay the bills without the government taking a chunk of it out automatically every pay period. Besides, I don't want my kids to see me be dependent on government handouts. No WIC or foodstamps for me unless we're literally starving and there's nothing else I can do to make the dollars stretch further, and my family or friends or church or local charities cannot help. That means I'd sooner lose the internet than chose to be dependent on money taken from others.
"Moderation in temper is always a virtue; but moderation in principle is always a vice." -- Thomas Paine
You are not alone
I'm sick of my taxes being stolen to support the education, health and housing choices of others... me without a "higher education", expensive health insurance and enough personal foresight to not get tangled up in a long-term loser of a housing loan. "Society" has been engineered by and for those who multiply quicker (but not too quick, because then that would be "irresponsible"...LOL). Are we truly already living in the times of "Idiocracy"?
Support freedom and liberty candidates in 2012... Ron Paul... Gary Johnson...
Remember what Ron Paul says
with half the people not paying any income tax, we're halfway there!
I certainly understand your frustration with our Communistic Tax Code. I want to let you know that, I don't make enough of an income to owe any Income Tax. Nevertheless, when I can, I promote the "Fair Tax" based upon consumption. We would all pay the same tax as a percentage on any transactions. I'd start paying some tax! I have no problem with that, because it'd only be a tax if I decided to spend rather than save. The way it 'should be' imo. I've never believed in our current tax system as long as I've been alive.

When they took us off the Gold Standard they took away our money... in order to make it theirs. -OneTinSoldier
I hear you OneTinSoldier. A flat tax would be better but...
I still don't think our personal income should be taxed at all.
We should repeal the un-constitutional 16th Amendment and force the government to contract to a constitutionally proper level.
There are lots of other revenue streams to fund a government based on its PROPER SIZE which is based on its PROPER ROLE.
Dr. Paul has spelled all this very clearly out in his budget for his 1st year in office (ie end 5 major departments and end ALL U.S. foreign aid etc).
But if they don't abolish the income tax then yes - EVERYONE SHOULD PAY for 2 reasons:
1. So they feel the pinch of the governmnet in their wallets and
2. Because they too benefit from whatever the government supposedly does with taxpayer money
"We have allowed our nation to be over-taxed, over-regulated, and overrun by bureaucrats. The founders would be ashamed of us for what we are putting up with."
-Ron Paul
+1
And it's good to see that the Nation is having a conversation about the role of Government, and the Constitution appears to be starting to win!
Other revenue streams would work for me. :-)
Cheers

A wise campaign staff says to
A wise campaign staff says to Ron Paul:
- Boss, talk to the people so they understand you.
- OK, so what do I say?
- "Elect me and I will lower long term unemployment rate to zero.
Can you imagine America’s competitive position in the world if I make good of my promise to take our income tax rate down to zero, when other countries have 30, 40, 50% rates… you would see the most insourcing of jobs into America in the history of the world.
We would roundhouse kick China's ass!"
Some time, Rock, when the team is up against it, when things are wrong and the breaks are beating the boys, ask them to go in there with all they've got and win just one for the Gipper.
Promising zero unemployment
Promising zero unemployment rate is a bad idea - because it's impossible (absent universal slave labor).
In a free market there are always a few people (who want to be employees) between jobs. The trick is to make the economy healthy enough that the time spent on desirable jobs is long (because the companies are stable yet pay well in money, benefits, and working conditions) and the time between jobs is very short (and/or most people change jobs by finding a better one while still employed at the old one).
