I think that headline's highly misleading.

From what I can see, his insurer is denying benefits because they say he's been involved in acts of war and such and there's an exception clause in his contract for that;
whereas the plaintiff (the veteran) argues that by the time he was there, the war was over -- regardless of whether it was declared or not.

Declaration of war doesn't even come up in this.
