Sam, you need to know first and foremost that the taking of the fruits of ones labor one time is theft and if it is perpetual than it is slavery.

The 16th amendment is a moot point. All it did was to confirm Congress' taxing power concerning income tax as an indirect excise tax! That's it. How does that make it what you apparently think it is which is "a tax on anyone who makes money anywhere here in the US". You are way off base.

If you actually read the law, you will notice it doesn't say what you think it says...

Income Tax is an INDIRECT tax. It is NOT a direct tax as others here have suggested. 2 US Supreme Court Cases in 1916 settled this very question. They are:

BRUSHABER v. UNION PACIFIC R. CO., 240 U.S. 1 (1916)


STANTON v. BALTIC MINING CO, 240 U.S. 103 (1916)

The Court said specifically in the Stanton case the following:

" it manifestly disregards the fact that by the previous ruling it was settled that the provisions of the 16th Amendment conferred no new power of taxation, but simply prohibited the previous complete and plenary power of income taxation possessed by Congress from the beginning from being taken out of the category of indirect taxation to which it inherently belonged, "

I do not know why others on this board have posted false information as to the nature of the tax. The question they should be asking is, "if the income tax is an indirect tax, how and why am I paying it?" And this is because income taxation on "an Average human being, living and working in the private sector, earning his own living, which includes making his own money, in any one of the 50 States of this Union", DOSE NOT SHOW UP as liable for the tax in the law! That's because the law is written to SHOW that it is indeed an indirect tax related to mostly foreign commerce! That's it.

And that brings us to another topic of what the LAW actually says. Most tax professionals do NOT read the law to determine who is liable for the tax. Most tax professionals read IRS publications and just ASSUME anyone who makes money now owes an Income Tax.

IRS Publications are sort of like "New Letters" put out by the IRS to the tax industry, including mostly ALL CPA's and Tax "Professionals". The IRS has a manual available on their website which any one can go read. Here's what THEIR OWN manual says about their own publications: (01-01-2006)

"IRS Publications explain the law in plain language for taxpayers and their advisors. They typically highlight changes in the law, provide examples illustrating Service positions, and include worksheets. Publications are nonbinding on the Service and do not necessarily cover all positions for a given issue. While a good source of general information, publications should not be cited to sustain a position."

So there you have it. Publications are NOT to be cited to sustain positions about the LAW even though that is what all tax professionals do anyway.

So hopefully this has gotten you on the proper path to actually understanding what the "Income Tax" actually is and especially what it ISN'T!

I say this time and time again... MOST people have nothing to do with the Income Tax just like most people have nothing to do with the Liquor Tax!


The Income Tax is an excise tax. In fact, the phrase income tax is a poor name to describe the tax. It gives the WRONG impression about what the tax is actually on.

Granted, Irwin went about it the wrong way, but never the less, he was never the subject of the tax! And the Government knows it. An innocent man is in prison for no other reason than political reasons!


And to one of the other posters, Yes, you do have jury trials in income tax cases. It's just jurors have no idea about what the law actually says about who is liable and when.

The problem is this: I don't think you get a jury trial....

...in federal income tax cases.

In which case the people never have a chance to find you not guilty which costs the government a ton and if enough cases go that way it can lead to changes in laws.

Please correct me if I'm wrong about this.

If so, I can't wait for the day I am on a jury for an income tax evasion trial.

No evidence what so ever was ever presented at his trial just a kept jury who would convict the proverbial ham sandwich given the opportunity and a corrupt sorry excuse for a judge! 36 months for laying bare the lie that is the income tax.

Pete Hendrickson - Another Innocent Incarcerated

Indeed! Pete is a fine man with a good mind and an inviolate spirit. He is another man denied a real court because he is right and innocent of the charges brought against him. Only the actually guilty and properly charged are allowed a defense. The innocent do not get real trials, that is constitutionally protected and guaranteed due process of LAW. The innocent are made unwilling actors in a staged production show. My prayers and best wishes go out to Pete and to all of the rest whether still incarcerated or whether still struggling to conform and transition back into the community after having lost their freedom, to such degree that freedom actually exists, and having lost everything they ever worked for before their charging instruments arrived. Thank you for mentioning Pete. There are SO MANY more.

This is a great idea. Irwin Schiff should be free, spending time with his family. Think of all the good he would do in the world - maybe that is why they want to keep him locked down. It is unbearable to consider how upside down things are when good people are made out to be criminals for nothing or victimless crimes and rot in jail while the real criminals in government and Wall Street remain free, living the fine life at the public's expense. Who are the real criminals? The ones who's actions lead to the death, maiming and displacement of millions of people, the ones who bilk the public and investors out of billions of dollars, or the person who doesn't believe in taxes and harms no one?

Irwin Isn't Rotting....

Thank you, Victoria, for your input, your reasoned thoughts. People like Irwin do not rot in prison. The captured innocents in prison do the time proudly standing strong - even stronger in prison than they did in the so-called free world of living.

True, he is missing his family. He is missing the precious development of his children and grandchildren. Irwin loves his family very much. They are his greatest source of pride and the potential for their future opportunities is his greatest source of resolve and purpose. This being true, he sees his punishment for standing strong on his cause for an industrialized producing nation as his support of them.

He knows he is not a criminal. His captors know he is not a criminal. His custodians know he is not a criminal. (Several of the officers and administrators at the Federal Prison Camp in Phoenix where I was imprisoned confided in me that they knew I was a political prisoner and that they were silently hoping we would eventually win our cases.) Irwin should be set free because it is the rightest thing to do now. He should be allowed the opportunity to hold the people he loves with his arms as well as with his heart and with his good work.

I enjoy seeing his sons and reading their writings

Irwin's Sons

Peter and Andrew are brilliant! I absolutely agree! Their books and speech will, too, encourage many minds to charter a new course in a reality based economics. These two young men represent my strongest proof that Irwin Schiff cannot be broken - for a chain of thinkers are already in place.

Irwin Schiff is in prison for a good reason.

He's an honest man who doesn't believe in paying extortion to thieves and murderers. Naturally, the thieves and murderers can't let him get away with that. Sets a bad example for all their other slaves.

He doesn't capitulate to extortion, so the taxes of two others are needed to pay for his incarceration. (As a PR ploy to scare the like-minded.)

If one asks me : yes, I am thus A COWARD, there, by paying income taxes for 17 years. My sole excuse : I wouldn't be able to sustain my family, alone and from prison.

You are no coward - for you are here, and, you are standing tall for your personal causes. Irwin and the others who asked the questions and pressed for truthful answers would not want you to put yourself in harm's way. He always said that. Please stay safe.

Yeah, if enough people wear t-shirts, the court will let him go free.... how about spending soem time running for local, state or federal office and then change things from within?

I know you guys mean well, but seriously, the court is NOT gonna free Irwin. I heard the trial, and he was not railroaded. His legal argument was wrong and so was his procedural, but EVEN if he was right, no court will say he was right, so it was an exercise in futility..

In fact, no court is gonna agree with any of the arguments against the IRS and taxes, and thus reverse the whole system for 99 years..
