Kentucky Supreme Court Rules Highway Checkpoints Illegal

[InfoWars] Warrantless checkpoints in the city of Liberty, Kentucky that were used by authorities to interrogate drivers who refused to display a sticker in their vehicle have been ruled unconstitutional by the Kentucky Supreme Court.

Residents who refused to buy the $10 dollar sticker were targeted after city officials ordered police to set up roadblocks. Those displaying the sticker were allowed through but refusniks were interrogated and had their vehicles searched, a clear violation of the Fourth Amendment.

After the state Court of Appeals disagreed with the Casey County Circuit Court and claimed the checkpoints to be justified, the Kentucky Supreme Court stepped in and unanimously ruled that the city had no reason to stop motorists.

“The checkpoint’s only purpose was to enforce a revenue-raising tax upon vehicles in the city,” the court ruled. “Thus, the checkpoint to enforce the sticker ordinance comports with none of the purposes which the United States Supreme Court has found to be important enough to override the individual liberty interests secured by the Fourth Amendment.”

Its funny how only last year...

lots of the things we considered a kooky conspiracy has been shown to be true. Like with everything there are always more than two sides to a story. Its our job to find the truth.

Looks good, except for this part:

. . "comports with none of the purposes which the United States Supreme Court has found to be important enough to override the individual liberty interests secured by the Fourth Amendment.”

Please use credible sources

Infowars is an Alex Jones conspiracy site. Using this stuff as sources makes us all look bad, discrediting this site, its users, and Ron Paul.

Thank you for providing some information, but please do not use such tainted sources.

And just what

Is a credible news site to you...FAUX NEWS?!? PUH-LEEZE!

Constitutional State-God bless Kentucky!

I find it disturbing when cognitive distortions are employed then presented as critical thinking. The story is real.

http://nworeport.wordpress.com/2012/05/01/kentucky-supreme-c...

It does not matter where it comes from.

All sources are suspect, now that's critical thinking. The logic of a lie is another method. Why would jones misrepresent that issue? Those who present that sources are black and white are discouraging critical thinking with baseless criticism.

jones is a hack who has no real interest in the truth. However, some of his info is quite good, and can be verified and ARE elements of knowledge that have some real use in critical thinking to understand the world.

You would have people reject news of proper constitutional performance by state courts and dissuade them from using their own judgement and thinking about sources by dissing a source that actually might have knowledge that could counter treason and usurpation of the constitution.

Can we stop doing all the things we are doing that we do not want to do while still doing what we need to do?

It matters

Some of what you write I agree with. But just because "some" of Jones' info is good doesn't change the perception that is created by linking to him. We can find some good in just about anyone. "Some" of the people Obama assassinates without due process will be guilty. Does that mean we should embrace the principle? Of course not.

BTW, the title of this thread is very misleading. It suggests that the KY Supreme Court declared all highway checkpoints illegal. That's not what the ruling says, at all. Critical thinking FTW.

no its not. grow up.

no its not. grow up.

I'm quite grown, thank you

I'm also capable of analyzing the ethos of a source, and those who use them. Your snarky "I know you are but what am I?!" answer notwithstanding, Jones is not seen by mainstream Americans as anywhere near credible. He claims that we'll be attacked with "government-lab-produced airborne Ebola" and that the government was involved in the Oklahoma City bombing.

Oh, yes, I have a source.

I'm telling you, straight up, that the source for your arguments is Alex Jones, you lose credibility. If you're so blind that you can't see that, you're too far gone to be redeemed and are a liability to any political movement.

The only mistake here is you perhaps.

how mature

I never claimed to be wiser than the good doctor. His decades of principled advocacy are something I could only dream of contributing to the cause of liberty.

But are you so naive to think that he's perfect? That the campaign is beyond criticism?

If he's perfect, and if his campaign is flawless, the nomination would be sewed up.

If we do not learn from our mistakes we will never improve and we will never fix this country. I suggest you either recognize sound political strategy or step aside in favor of those who do. Rude comments like yours are divisive. Yes, I was mildly critical of the decision to post a link to Alex Jones' site, but I voiced my criticism respectfully and constructively. You are some sort of blind zealot who lives in a fairy tale world and wants to make the rEVOLution tiny and inaccessible to mainstream America. Congrats. You win.

"But are you so naive to think that he's perfect?"

What about my comment that I would choose his council over yours every time made you think I believed he was perfect? In fact, I meant the opposite.. I believe you are just that much off that you aren't showing any signs of credible thought.

You make a lot of assumptions, call other divisive while jumping onto a thread to criticize, which is hypocritical. Pardon me, if I'm seeing some canyon sized cracks in your ability to be mature, yourself.

You speak as if you have the finger on the pulse of mainstream and then assume that even if you did, which you don't, that we'd somehow care, when it's obvious that mainstream is off it's rockers. They've ran us into the ground, so again, pardon me while I "cling" to those that had the foresight for what was coming and were right. Not always right, just right enough to make the rest of mainstream look as wrong as it is.

A City Goes Too Far-The State Court Intervenes Using Federal Law

Yes, when we show we care and understand anywhere, official discretion is challenged to be as good as it can.

Here is an opportunity to lay some praise on courts, but then be sure to ask them to stand with the constitution when the issue is not so obvious, but perhaps even more important.

State legislators (no just courts) have a duty to the citizens to work in upholding the US constitution by advancing their need for amendment to the constitution to exert guidence and control over the federal government.

Well, congress has been violating their oaths, US law and the constitution for 100 years by refusing to convene states delegates for an Article V convention. Find out here about that.

http://www.dailypaul.com/228404/soldiers-citizens-defense-re...

And, what can be done about it.

Logically, if there has been a covert infiltration of the US government over the last 30 years, and congress's nonfeasance with Article V has been enabling it, then it is safe to assume that part of the design was to embed unconstitutional officials in state government that would work agains the state effort to gain an Article V, our first constitutional right.

BTW: The fears of runaway are nonsense if an effort is made by Americans to first understand Article V "all intents and purposes of this constitution" are the words to heed.

Before an Article V occurrs, the people of the nation need to be made more constitutional and ending the abridgment of free speech is the only thing that can do it.

Then campaign finance reform needs to happen.

Voting methods need to be secured.

With 3 amendments this can be done. Give America 6 months with actual free speech, which can be done equitably despite corporate control over national networks, and America will be ready to elect state delegates for a convention.

Then we will make a difference.

Can we stop doing all the things we are doing that we do not want to do while still doing what we need to do?

WTG KY !

Kentucky has a no bull attitude. Too many horse traders who know the value of a plug nickle live in Kentucky. I was born in Indiana but like many Hoosiers our families moved from "home" to take factory work here "in this country" during WWII, but we still have a great attachment to "home". Lincoln said more than he knew in 1852.
“From whence shall we expect the approach of danger? Shall some trans-Atlantic giant step the earth and crush us at a blow? Never. All the armies of Europe and Asia could not by force take a drink from the Ohio River or make a track on the Blue Ridge in the trial of a thousand years. If destruction be our lot we must ourselves be its author and finisher. As a nation of free men we will live forever or die by suicide.”
LIVE IT, THIS REAL PEOPLE !!!

very nice!

i drive through liberty a few times every summer on my way to my favorite lake...the "main drag" is probably 2 miles long...glad the courts stepped in for such a small town...

Good going!!

Down with the commies / fascists! No to the NWO!!!

misleading headline

Standard operating procedure at Infowars. Don't get me wrong, Alex Jones' has been waking people up for years and I appreciate what he does. I also couldn't care less about his motivations, whatever they may be.

The Kentucky Supreme court did not rule that highway checkpoints are illegal, but ruled that this one particular checkpoint, for a very particular reason, in this unremarkable little town, was illegal.

Not picking on you LL, but when you break down what actually happenned, it's just not that big of a story. Great for the citizens of Liberty, KY but it will have zero impact on unlawful searches anywhere else in the country.

πολλα γαρ πταιομεν απαντες ει τις εν λογω ου πταιει ουτος τελειος ανηρ δυνατος χαλιναγωγησαι και ολον το σωμα

The headline is not

The headline is not misleading; it is simply open to interpretation. Like you, I myself misinterpreted it. After reading the article, I realized the "sensationalist journalistic flashy" nature of the headline had reeled me in real good; yet, given the context of the article, the headline is still accurate and wholly appropriate.

Good post!

Good post!

Exactly!!!!

There has to be individual punishment for breaking the law or whey would they care!
