RNC Cheats Ron Paul And "the Unit Rule" Unbinds All Delegates!

Rule 38 Is In Effect

This rule isn't referring to Super delegates which can vote for whomever they wish. The rule is referring to bound state delegates obviously. Why else would it mention the Unit Rule? RNC rules trump state rules. A state's delegates are not bound.


URGENT! - Most states don't enforce the "Unit Rule". There is always at least 1 unbound delegate, So rule 38 doesn't apply to them.

Our only solution is to use the Motion To Suspend Rules, where a majority can vote to unbind delegates, which reads:
"A motion to suspend the rules shall always be in order, but only when made by authority of a majority of the delegates from any state and seconded by a majority of the delegates from each of five (5) or more other states severally."

Since every convention sets

Since every convention sets its own rules their is no need for a motion to suspend the rules. Early on at the convention there will be a vote on the rules I'm sure the campaign will either bring forward an amendment or advise RP delegates how to vote on the question.

How did Delegates vote for Harding's Convention?

Warren G Harding went to his convention with something like 6 official delegates, yet became our next president. As I understood it, the Paul 2012 campaign is using a lot of that campaign's strategy...

So does any history buff here know how Harding's delegates side-stepped this rule?

Overall, there were more than a dozen candidates that received votes from delegates. The top two barely even combined to have enough votes to get the nomination. It would be like if Romney and Santorum each had around 600 delegates, and characters like Huntsman, Cain, Perry, Bachmann, and Gingrich each had 200 - and no one would change their minds. In 1920, no one would budge on the first several ballots, and neither of the top 2 were gaining support. Eventually, enough agreed to vote for someone who hadn't really even been a consideration at first.

There is virtually no similarity between the Paul strategy and the Harding strategy. Harding just lucked out that the convention couldn't pick someone else. If there is any split this year between forces that refuse to budge, it will be between Romney and Paul forces, and either Santorum's people would play kingmaker or they would choose someone else entirely.

Sadly this is not accurate

This understanding of the unit rule is not accurate. I wish it were that way, that delegates were free to vote from their conscience. But the unit rule as defined by Websters Dictionary is:

"a rule under which a delegation to a national political convention casts its entire vote as a unit as determined by a majority vote"

This means that if the majority of a state's delegates prefer Mitt Romney, the state cannot force all of the state's delegates to vote for Mitt Romney.

The best bet for us at this point is to:

1.) Keep spreading the word to our republican friends/parents in denial.
2.) Convince the delegates from each state that support Ron Paul to break the rules about being bound and vote Ron Paul. I would like to see the convention in Tampa crowded so that they cannot deny our desire for small government.

I clarify this only so that you might know, and not be ignorant. There is still a chance if we can avoid Romney getting 1144.

Just vote for who you want

and claim the unit rule that is all.

Republican National Party Rules prevail over state law. It doesn't matter if the state statutes say a delegate is "bound," if a delegate is refused his/her constitutional right at the RNC, the GOP/National Republican Party is responsible...

"In short, the National Republican Party, not the state statute, is responsible for the alleged infringement of plaintiffs' constitutional rights."

Hence, back in '08...

"Jennifer Sheehan, Legal Counsel for the RNC, plainly stated in a letter to Nancy Lord, Utah National Committeewoman, several weeks before the convention, “[The] RNC does not recognize a state’s binding of national delegates, but considers each delegate a free agent who can vote for whoever they choose.” And, “The national convention allows delegates to vote for the individual of their choice, regardless of whether the person’s name is officially placed into nomination or not.”"

They can't constitutionally bind delegates. DO NOT ABSTAIN. Vote Ron Paul!! And if you're denied, file a federal lawsuit against the GOP(not the state)for infringement of the First Amendment.

State law precedence over state party rules

In this case Massachusetts state law says that delegates HAVE to vote for whomever they are pledged. So I don't think this helps us at all.
And we can't use the anti-unit-rule RNC rules against it, because our at-large delegates are not technically bound.

The liability illusion

Is where they try to play off delegate "binding" onto state laws. Disillusion yourselves.

O, it is, very much, illegal to commit fraud.

From my understanding, it is very much illegal for the RNC to be doing what they are doing. Especially if money has changed hands. It's called fraud and unjust enrichment. And if they start using the United States Postal Service during this fraud, then it's mail fraud... Which I believe is a felony. In order to sue, one would have to have standing. Anyone out there give any money to the RNC?

There is not a LAW that states that someone (or something) can give money to a candidate. This is simply there own rule, therefore it is not against the law.

We can MAKE their fraud into Legal fraud...!

Rule of life in these here states:

If someone is acting fraudulently in any way, all you have to do to make their wrongdoing "illegal" is to involve money... Because if someone frauds you out of money it is against the law.

So in this case, it sounds to my lightly-studied ears that Brannan is right: Some republican here needs to donate to the ---> GOP <---, not Romney, and then a lawsuit can be raised against the RNC for using that money towards Mitt's campaign.

If many of us did it, we could start a Class-action lawsuit and the media would have a field day!



I hit you with a thumbs up for getting what I was talking about. I am not so excited about the "class action" route... Better to give them the death of 1000 cuts, than to hinge it all on one case. Also, I think it would have to be a person who gave money previous to the fraud (for a stronger case) who would have better standing to sue the RNC. And this would do nothing for our cause in the near term... More like a "golden rule" sort of thing. What goes around, comes around. Nothing like hitting someone in the wallet to learn them from sucking eggs.

The thing I love about the Daily Paul: is here, besides the trolls and the cave boys, there are fellow travelers, like me, who's hearts burn with the fire for liberty. A tribe of Americans. What we need is some scalps. And I am not above waiting 'til after the election to get some.

Look, if you defraud someone, you can go to jail for that. It doesn't matter if you have a private club, or a laundry mat, or just an ad on craigslist. Fraud is fraud and it's against the law.

It is the political version of a bait and switch (Which is a legally prosecutionable form of fraud).

At the convention make motion to release all delegates from their pledge on the grounds of the RNC violation of rule 11. It was Arrogant, presumtuious and fraud.
Delegates would then be free to vote their conscience.

We, The GOP Establishment, Have Put A Lot Of Time,

money, and effort into 'Rigging' these elections and the LAST thing that we are going to allow to happen, is for these "Paulbots" to come to 'Our' State Conventions and 'Steal' these delegates from "Our Man", Mitt 'Flip Flopney' Romney.

Things every Paul supporter need to do

I believe we need to turn the tide in regard to most of our attitudes (including myself).

We've all been angry for many years, especially those who have been at it since 2006; becoming delegates for the 2008 race. We've had to resort to gorilla tactics and fighting tooth & nail just to survive, and you know what? We're still here.

We ALL need to start being leaders and act the part; not complainers or nay-sayers. The last thing I want is Dr. Paul win the nomination, and for us to see Americans weeping in the streets saying, "Those crazies have taken over America!"

Our greatest strength is the PROOF.

1. When posting on blogs or any forums in response to negativity, be careful! Those suckers are BAITING you! They want you to go nuts and therefore have the proof to back up their claims. We all need to show the facts, and show the support (links to photos). The facts are what Dr. Paul stands for versus other real facts...not conspiracies. Show other people the crowds of support Dr. Paul is getting.

2. Talk to people like you personally represent Dr. Paul in his campaign. Show respect, and listen. The greatest way to draw someone out is to let them talk themselves into a corner of stupidity. Then present the facts and proof. I personally did this with a 74 year-old gentleman at the grocery store last weekend. I listened to him for a while and let him ask me questions (I had my Ron Paul 2012 hat on). I asked simple questions, didn't engage in overblown theories or intellectual diatribes. "Do you feel the value of the money you've saved is in jeopardy due to the financial crisis we're in?" Etc... One thing leads to another.

3. Start saying things like: "Dr. Paul is winning!" You're not saying "what" he's winning. And the truth is, he is winning. Let them get all mad and PROVE he's not.

4. Do kind things for people in the name of Ron Paul 2012. Buy someone lunch, bring water bottles to an event with Ron Paul labels on them and GIVE them away. Wear your RP clothing and purposefully open doors for people, say hello to people, and always say "yes sir/maam", thank you, etc... This goes a LONG way. My whole family supports Dr. Paul just because I do. It's like people who say they "hate God". No they don't, they hate his representatives.

Some people are going to get mad and all red in the face. But I just feel we all need to change ourselves into what's coming next.

Just Remember

THEY is starting to look like US!

When people keep referring to the GOP changing rules at the convention we have to remember that if we keep this up we will be a large part of that convention. It may be even so that the majority of delegates present (disregarding bound, unbound, rule 38, etc.)will be Ron Paul supports.

That means THEY becomes WE and WE make the rules!


PROOF the RNC is working with the Romney campaign and violating Rule 11!

from there legal council and the plan that is best for us to implement.

People there's no need to worry about rules. The only worry is if there are a majoirty of Ron Paul supporting delegates.

If there is a majoirty then on roll call someone rises and makes a floor motion to suspend the Rules and nominate Ron Pual as RNP candidate. A second, then a vote ON THE MOTION. There is at this point not a vote on the candidate, the vote is on the floor motion. There is no delegate binding on this motion. If a majority vote in favor and the motion passes, then there is never a vote to select a candidate in which the delegates are bound to a specific candidate.
