Lawsuit - Time to take the gloves off

We can play by the rules and still take the gloves off in what has been a completely underhanded approach from TPTB and the Romney team.

I like the talk that I've been reading about regarding filing a lawsuit, but small claims court is not the answer. The Answer is in RICO

Civil causes can be filed under RICO. The pattern of activity across the country which has been taking place is organized, coordinated and comes from the top down. Unlike small claims court, RICO as an approach would more directly implicate the people at the top who are directing and giving orders to deceive, disenfranchise, break rules and likely break laws as well

"Under RICO, a person who is a member of an enterprise that has committed any two of 35 crimes—27 federal crimes and 8 state crimes—within a 10-year period can be charged with racketeering. Those found guilty of racketeering can be fined up to $25,000 and sentenced to 20 years in prison per racketeering count. In addition, the racketeer must forfeit all ill-gotten gains and interest in any business gained through a pattern of "racketeering activity." RICO also permits a private individual harmed by the actions of such an enterprise to file a civil suit; if successful, the individual can collect treble damages."

So you can triple the monetary damages.

"The RICO Act focuses specifically on racketeering, and it allows for the leaders of a syndicate to be tried for the crimes which they ordered others to do or assisted them, closing a perceived loophole that allowed someone who told a man to, for example, murder, to be exempt from the trial because they did not actually do it."

We need to implicate the corrupt and criminal activity which is subverting our democratic process. If you are going to take on the system through legal means, let's get a group together of delegates who have been harmed, get a lawyer who will work on contingency for a % of the amount won. In fact the lawyer could get all of it, what we really need is the legal victory that the Romney campaign and the Republican National Committee leadership has committed Racketeering and has been found guilty under RICO.

I don't think the Republicans would relish a intraparty RICO action during their well orchestrated presidential convention. If you want MSM attention this will do it! Chris Matthews would get another tingle up his leg, Hannity would go into convulsions and Rush will choke on his golden EIB microphone, as Romney only gets RICO questions from the MSM for the next 6 months. Heck newspapers may even start selling again! LOL

Hey-hey! All the better reason to get going ASAP....

so in the middle of the convention the moderator for Fox has to point out the injunctions are filed and no nomination CAN occur!

RICO is the avenue to take, it's been used before and it does

have teeth. Good luck finding a legal team. Anybody else notice how quiet the ABA has been over the past decade?

RICO is good,

I would use an array of legal remedies. Use the weapon of restraining orders against the local GOP to stop them from certifying the fraudulent slate of delegates and use the same injunction to stop them from sending that slate to national! Corporations use restraining orders all the time, they are easy to put into place, and difficult to undo. Governors have used that against businesses as well. Consider using Restraining Orders as a first step in the legal battle, then you have to go after the enables such as the chairperson that runs rough shod over everything. I would consider not only going after the local GOP for the fraud, but the chairperson himself who has enabled it. Different lawsuits from different directions is the only way to get these crooks to capitulate and sing a different tune. Convene a grand jury and provide all the information you can. Some states can still convene a grand jury. You do not need a judge to OK the process to get the ball rolling. Grand Jury's are a powerful tool if your state allows for it! Go after the chairperson in civil court for defrauding and breaking the contract you had as a delegate or GOP member. These people need to start being held accountable for wiping their collective ass on the election process. Many belong in jail. Research, and use any and all legal remedies possible. Time to go on a FULL ATTACK against this scum!

Why not do both Rico and Small claims?

These GOP minions might even talk.

should be placed on every temporary chairperson's table prior to starting the caucus.

Absolutely. Put it on the table right in front of them. Preventing corruption would be preferable to seeking remedy.
A subtle reminder that We the People have no tolerance of corruption whether it be in the highest political office or rigging a local bingo game...
Perhaps mailing it to their offices prior to the state conventions would be less likely to cause anger. Sure, they still won't like it but, it will give them a chance to cool down and also to ponder the consequences of ill conceived plans.
