MA delegates asked to sign affidavit that they will vote for Romney on first ballot

Massachusetts delegates to the RNC in Tampa have received a letter and affidavit that they are being asked to sign and return, affirming that, under the pain and penalty of perjury, they will vote for Mitt Romney in the first round of voting.

Below is the text of the letter and affidavit, transcribed by me, as it was read to me over the phone by an elected Massachusetts delegate. What should they do?

Dear Massachusetts Republican Delegates and Massachusetts Republican Alternate Delegates,

Under the rules of the Massachusetts Republican Party Plan for the Selection of Delegates and the rules of the National Republican Party, the Avocation Committee charged with certifying Massachusetts delegates for the 2012 Republican National Convention in Tampa, Florida requires each elected delegate and alternate to sign, under the pains and penalties of perjury, the herewith enclosed affirmation, and to be returned on or before 3pm May 29, 2012 to the Massachusetts Republican Party at 85 Merrimack Street, Suite 400, Boston MA 02114.

Electronic delivery, in any form, will not be accepted. Your failure to duly and timely remit the enclosed affidavit will put your status as a delegate in jeopardy.

then you can say that you never signed it, and then when it is presented to you, you can with confidence say that is not your signature....simple, i doubt this will have any consequence after tampa anyway....im only kidding, i would throw it away!

It seems to me that it is a little late for this.

They should have had people sign before they were elected as delegates. Maybe they just want to know whether they will be totally embarrassed in Tampa.

The best thing to do is to sign it, and then simply ignore it and do what you want. As others have stated, lying to the RNC is not perjury.

Once I signed a contract promising to pay rent to my landlord. I missed a couple months. That wasn't perjury ....


Do not sign or return it - this is a deliberate move by the RNC to secure Romney vote, you are under no legal obligation to sign and return this veiled threat - you can always deny receiving this declaration at any later date, so please do not feel threatened and do not play their game.


But if you don't sign it they will replace you and put some Romney stooge in. If it's not legally binding and lying to the RNC is not perjury, why give them the excuse to disqualify you?

Your signature is one of the most valuable and powerful things you have; never give it away. I'd hold off until seeking competent legal counsel that specializes in, or at least is highly familiar with, election law.

I do not see a problem

Let Romney disqualify his delegates. He is not allowed to replace them. Unfortunate they cannot vote for Paul. But on the plus side it absolutely guarantees a brokered convention and we win.

I doubt that this paper has

I doubt that this paper has any binding legal authority. And since this is in MA and the actual vote takes place in FL, I would challenge their jurisdiction…these people find a way to become more and more pathetic every day. Even when you think that it isn't possible they find a way to appear even more pathetic than before.

This is all laughable. An "affidavit" is a "sworn statement" - you can swear on it and take a #2 on it and call it a day.

It will also depend on state law.

I do not think you can change the wording of a contract, but that will depend on the state law. The best option is not to sign it. The party would be forced to have an election to replace a duly elected delegate if that is even legal. By far, the best option is not to sign it and it will cause the Romney people a real major headache. The issue of perjury in the contact is another major concern. DO NOT SIGN IT!

Not sign it, or I would sign it and still abstain or vote for Ron Paul. It sounds like BS to me. But I have no problem with lying to get Paul the nomination. I would even swear on the bible I would vote for Romney then turn around and vote for Paul. They lie, you can lie to. Treat them the way they treat us. You want respect and trust? You have to give it and earn it. The establishment has failed.

I've been getting all kinds of requests for money from the GOP at various levels. I just take their prepaid envelope, stick a couple Ron Paul slim jims in and dump it back in the mail box. To commit perjury you must be sworn in before a court or judge. Just get some legal advice from a trusted attorney, plan on signing so not disqualify your self.

Save your efforts until the morning. It is when you are presiding over the porcelain goddess of wisdom, you can truly send a "signed affidavit" back. You can even get someone to look at the affidavit and produce his / her own "sworn testament" to adduce. Just fold the piece in two and mail it back (provided it is self-addressed). I do not advocate for such true and sworn and deliberated statements and do not endorse anything that the USPS prohibits in mail transit, nor anything about mailing bodily excrements or anything contrary to the law.

At the very least, if you did run out of toilet paper, the request was not printed on sandpaper and you have no reason to discriminate in this regard.

Absolutely nothing whatsoever is meaningful other that an opportunity to send some "signed affidavit" that you deliberated on at the American Standard or the Sloan or the Crane institutes.

Another possibility

What if the delegate had someone else fill out and sign this form. The RNC has no proof or witness that the delegate signed it. And the delegate can deny signing it if and when it's brought up when they vote for Ron Paul. Unless they think they can use this signed form as admission for an automatic vote for Romney at the convention and don't bother asking the delegate since they signed this paper already in effect casting their vote for one candidate.

I would imagine,

that since party rules say that delegates are a free agents that can vote any way they want. The affidavit would be null and void. Also, Having to sign the affidavit under duress(Fear of loosing delegate status) would also make it null and void.

So the perjury laws can not be applies.

At least thats my opinion. I'm no lawyer.

Actually you could probably sue for being forced to having to sign the "promissory note" under duress. That is if you can prove the duress part.

On Second Thought...

I would gladly commit perjury to prevent tyranny. I voted for my MA delegates so that they would stand up to acts like this and I believe that they will.
