ACLU sues Cranston police to return weapons seized from man thought suicidal

PROVIDENCE, R.I. -- The local affiliate of the American Civil Liberties Union is suing the Cranston Police Department for a resident whose weapons collection was seized while the man was being evaluated because a friend thought he might be suicidal.

The weapons, including firearms and ceremonial samurai swords, were taken almost nine months ago and were not returned after the man, Robert Machado, produced a letter from his psychotherapist saying he had never "demonstrated suicidal tendencies or thoughts," and "there should be no concern" returning his weapons.

The police advised Machado that he would need a court order to get them back.

The suit, which can be seen at the ACLU website, was filed by volunteer lawyer Thomas W. Lyons.

The ACLU has always acted as though the Bill of Rights comprised 9 amendments and a smudge. True, the weapons may be collector items, not an arsenal, but still this looks like a step in the right direction. Besides, this business [sic] of confiscating property without due process and making people sue to get it back is not only unconstitutional, it is reprehensible.

Lately I have seen the ACLU lean towards Liberty more

I wouldn't call them allies, but there may be instances where we can work with them towards a common goal.

since I've never personally dealt with them so I'm not familiar

with how the organization is structured, but if it's like any other national NGO with regional offices, their individual respective local state branch offices are probably much more closer to We the People's concerns than the more Leftist leaning national office.
