"SANTA ANA, Calif. (CN) - In a revolt against Romney, at least 40 more national convention delegates asked to join 123 previous plaintiffs in a lawsuit against the Republican National Committee, and their attorney said hundreds more may soon follow suit. The first 123 delegates, all from the 9th Circuit, sued the RNC, its Chairman Rince Priebus, and every state party chairman in the 9th Circuit in Federal Court on Monday, demanding the right to vote for the candidate of their choice on every ballot at the Republican National Convention, including the first.

The delegates claim the party violated federal law by forcing them to sign loyalty affidavits, under threat of perjury, to vote for Mitt Romney, though he is not yet the official nominee. They also claimed that state party chairmen are fixing elections at state conventions and changing ballots so that all votes cast count for Romney.

"When nominating someone for a federal office, all delegates must be free to vote their conscience," Richard Gilbert, of Gilbert & Marlowe, attorney for the delegates, told Courthouse News in an interview Thursday. "They don't want to be bound to any candidate, or even be forced to vote for the nominee," Gilbert said. "To have a real convention, the delegates must have free will so that when they meet, they can persuade each other and then decide who to vote for."

at both congressional and state level. all know RP delegates were challenged. I should check and see if I can join the law suit.

It has also been revealed this morning by "Steve Martin", prolific reply writer and proponent of the case, that the ONE "lawyer" involved in "Lawyers for Ron Paul" has no association whatsoever with Ron Paul, that he is a democrat and that he has several questionable clouds over his past.

So, buyer beware. Read the actual lawsuit. DONT BELIEVE WHAT PEOPLE SAY. See it for yourself!

9th circuit?

Hello, Can someone explain to me what the 9th circuit is? After looking it up on Wikipedia it still is not clear to me. What is their relation to other court systems? What kind of court is it? Is the highest instance also the Supreme Court?

First level of federal courts

First level of federal courts is the district courts.

Second level is the courts of appeals. Each covers several districts. The collection of districts handled by a particular appeals court is called a "circuit". (So called because, when transportation was much slower and pricier, the judges used to move around among the district courthouses ("ride the circuit") rather than making the litigants all come to them at their home office.) First appeal is to a "panel" - a three-judge subset of the judges of that appeals court. Their decision can be appealed to the full set of judges from that circuit ("en banc", i.e. the "whole bench" of judges). Details vary depending on the circuit. Decisions (and administrative rules) of a federal circuit court bind the districts within the circuit but not the other circuits.

Third and final level is the Supreme Court. It usually doesn't chose to hear a case unless two circuits have set conflicting precedents on the same issue, though something big and with time pressure (like federal election issues) might get heard in a timely fashion (as with the Bush-Gore election).

The 9th Circuit is the big one that handles the west coast area. It is notorious for activist judges that find interesting and sometimes surprising interpretations of the law - and as the one most often reversed by the Supremes. Sometimes referred to as the "9th Circus". If you want to use the courts to meddle in the guts of a political party the 9th circuit is the place you'd have your best shot. So you try to find plantifs in one of their districts and start there.

The 9th circuit court is a federal court of appeals. each district has a court and if a party wants to appeal a district courts decision to a higher authority they can do so in the 9th circuit. Essentially it is one more step up the food chain towards possibly getting the case heard by the Supreme Court. The big picture is that the 9th circuit is a federal court. Hope this helps.

A Federal Court can issue and order to make Federal MARSHALL'S available to enforce it's rulings.

If we would have had Federal Marshall's in Louisiana at their State GOP convention those cops that broke our rules committee chairman's fingers would be in FEDERAL PRISON for threatening, intimidating and coercing a party or party in inconsideration to the lawsuit.

worth listening to and enlightening

actually this interview is so worth listening to. the lawyers keeps stating that this suit was NOT agreed to by the campaign. that the people have taken over the campaign and are bringing this lawsuit forward. not only does he talk about voter fraud, unbinding delegates, criminal acts, etc., but the lawyer richard also mentions briefly that the campaign managers esp. jessie benton signed a letter violating rule 11. this rule states that the rnc and the romney campaign may not aid any candidate until they become the nominee. (listen to the area just before the 15 minute mark) i'm interested in knowing exactly what this letter says and which campaign mgrs signed it. apparently this happened back in april. so, sounds like there is real proof about some of the rumored probs in the rp campaign. also, much reference to romney's criminal acts which they liken to organized crime going state to state in dark clothing committing dark crimes.

the bottom line the lawyers state is that it is against the law to coerce a delegate to vote for a particular person. that all are unbound and can vote their conscience and that the supreme court has already ruled this in the past, so they are not trying to set a new precedence, but to uphold the constitution and the supreme court rulings over time.

Maybe the lawyers have an actual letter. This is only a statement.


LAKE JACKSON, Texas – Responding to complaints that the Republican National Committee has violated Rule 11 by setting up RNC Victory Operations while Dr. Paul still seeks the nomination, the Ron Paul 2012 Presidential campaign issued the following statement.

“In April, the RNC asked our campaign for our blessing to begin assembling the Victory organization Republicans will require to guarantee a win in the fall. Building such an operation is no small undertaking, and our Party needed to build in a few months what the incumbent president has been building for four years.

“The RNC offered to set up a joint fundraising committee with the Paul campaign and were very clear that if Dr. Paul became the nominee, the Victory Operation would be behind him 100 percent. They also were clear that they would hold off if our campaign objected. I gave my full consent for the RNC to move forward.

“Chairman Priebus has always treated Dr. Paul and our team with respect, and we appreciate his leadership. He has been an outstanding chairman and has our full confidence.”


When I thought about this

I came to a couple of conclusions. First, Jesse Benton can give his blessing douse them with holy water, the whole nine. But I say, WHO is Jesse Benton and WHO gave HIM the grand authority to grant permission to break laws? I mean what other crimes is he permitted to authorize? I don't believe for a second that Jesse Benton's "blessing" amounts to a hill of beans!
Second, the breaking of rule number 11 MIGHT just turn out to be a MUCH bigger mistake than the RNC what's us or anyone else to realize. Because the way I see it, Now that they have used our taxes to fund Mitten's Campaign they have made this a FEDERAL issue. Before the argument could have been made and a lot of the violations may have been challenged, but they have shot themselves in the foot, and I can't say, but I wonder if this was the reason The campaign made no argument when the RNC expressed their desire to fund Mitten's, and the reason Dr. Paul refused to accept funds for his campaign, even though they were offered. The RNC might have known all this too, maybe that's why they hoped Dr. Paul would accept funds as well, and they are just hoping now we are all too stupid to figure this all out.
I know I was fussing a lot in this post, I just want to make sure you (Peggy) know its directed at the RNC not you:-)

no specifics about those things.

the lawyers mostly discussed those issues in general terms. tho i believe they mentioned broken bones and privately hired police, fraudulent voting practices, etc. also coercing delegates to sign pledges to support romney which is in violation of the rules.

If what I think I read some time ago is correct, the judge has the option to order investigations and create warrants for criminal activities if he sees fit to do so, going beyond the original case.

Does This Mean That Stealth Delegates

...are supplying their names and information, prior to the convention, to those filing the lawsuits? To the people who have "taken over the Ron Paul Campaign?"

Will their names be in the public domain or remain confidential? Please recognize that this is only a logical question...and not an attack. I am trying to feel good about this. I even wrote Judge Napolitano about the lawsuits. Doubt he will reply, but I hope he does.

In that case, I see it at best to be a huge game changer for the election and, if not, a historical case of people trying to use their legal system to demand justice.

Given the fact that our justice system is rapidly deteriorating along with everything else, time may be short to even try a legal avenue. It is certainly a protest stance (en mass) that has not been done.

Thank you for your answer. It is so important that the DP remain a place where people can respectfully ask questions. Mine was a simple one that perhaps those of you more involved in the law suits thought everyone understood. I didn't. Now I do.

And, in that case...if there is no possibility that delegate information that is unknown to the Romney camp is exposed through the law suit...then I can be supportive.

I do wish that language in posts like "Ron Paul's lawsuit" and "taking over the Ron Paul campaign" had not been used. Of course, I realize that it is possible that Ron Paul is very much aware of this and approves totally since it has always been his game plan that the grassroots recognize that they are the Liberty Campaign. no question the lawsuit will have limited effectiveness

But we have them surrounded:

1. We've hit critical mass, more than 11% of the population has come over to our side against a lockstep media that controls the tv, radio and newspapers.

2. A very lucid Gary Johnson waits in the wings for our support, the GOP has to acknowledge the wolf is at the door. One misstep and their party is dust.

3. Racketeering lawsuit has egregious examples that are numerous and nationwide. It's a crime syndicate and there's no denying it.

4. Mr. Republican is there to pull more people over, Rand Paul. They see what he's doing then think maybe they're lying about his dad. Eventually we win them over.

5. We'll have thousands in Tampa before the start of the convention, an army to back up our delegates. Good people all of them.

6. We have an army of delegates that will stand pat. We elected good people that won't back down from the establishment.

7. We have the de facto leader of the free world espousing our positions and the lies and distortions don't stick to him. We have 100 guys to step in after he's through. We have a thousand behind that. This thing is growing daily.

8. We have a philosophy that can't be argued against. We build our argument from first principles and we can break down all the welfare/warfare/Keynesian arguments into either social engineering or coercion. Neither is acceptable. Once you accept our truths the strain of holding conflicting ideas is shattered and you never go back.

It's a Revolution yall. Join us.
